There is no single nationwide list of information protected in every protective-order or foster-care case. Federal courts require filers to redact certain personal identifiers, judges can seal specific records, and child-welfare confidentiality is largely governed by state law. A protective order may also limit access to discovery material without automatically sealing court filings. The answer depends on the jurisdiction, who holds the record, the kind of record, and the wording of any order.
First, identify what kind of record you mean
“Protective-order records” can mean the order itself, a petition or other document filed in court, evidence exchanged during discovery, or a hearing record. “Foster-care records” can mean a child-welfare agency’s case file or documents filed with a court. Those materials do not necessarily have the same access rules.
- Court filings and proceedings: Federal court files are generally accessible, subject to redactions, sealing orders, and other exceptions. State and local court rules may differ. The U.S. Courts explains that most federal case files are available through PACER or at the clerk’s office: Accessing Court Records.
- Discovery: Information exchanged by parties in a lawsuit is not necessarily part of the public court file. A discovery protective order may restrict who can use or disclose it.
- Child-welfare agency files: State statutes generally determine who may receive child-abuse, neglect, or foster-care information and under what conditions.
“Confidential” and “sealed” are not interchangeable labels. A record may be protected by a statute or an order, while a court filing may remain public unless it is properly redacted or sealed.

Federal filing rules specify personal identifiers that must be redacted in court filings. The U.S. Courts’ guidance lists Social Security and taxpayer identification numbers, dates of birth, names of minor children, and financial account information. In criminal cases, home addresses are also included in the redaction categories. See the Judiciary Privacy Policy.

PACER says the filer is responsible for ensuring private information is not included in case files: Do the federal courts redact information in case files? These requirements do not mean every sensitive detail is automatically removed, or that every case involving a child is closed. A judge may seal particular documents or close a hearing in specific circumstances, such as to protect a victim or informant, avoid harm to an investigation, or safeguard due-process rights.
What a protective order can cover
A litigation protective order can regulate the handling, use, and disclosure of discovery materials. Its scope comes from the order and applicable law; it is not a universal rule that makes every document in a case confidential. If protected discovery is later filed with a court, separate sealing requirements or local procedures may apply.

For example, the U.S. District Court for the District of Oregon requires a party seeking a restriction to identify specific prejudice or harm tied to particular materials or categories. A party asking to file material under seal must explain why redaction would not suffice. That is a local rule, not a nationwide standard: District of Oregon LR 26-4.

It covered certain child records restricted by statute, nonpublic information about other children in state custody, foster-care provider and foster-child records, sealed court records, and medical records. It limited use to the litigation and specified who could receive the information. The order also said that placing a confidentiality label on a document did not, by itself, give it statutory protection beyond the order. These terms applied to that case; they are not a standard list for every court. See the 2018 District of Kansas protective order.

How foster-care and child-welfare confidentiality works
Federal funding requirements under the Child Abuse Prevention and Treatment Act (CAPTA) require states to preserve the confidentiality of child-abuse and neglect reports and records, subject to limited exceptions. State statutes set out eligible recipients, what information they may receive, and the circumstances for disclosure. The Children’s Bureau’s Disclosure of Confidential Child Abuse and Neglect Records summarizes these state-law approaches.
Depending on the jurisdiction and circumstances, authorized recipients may include medical professionals, law enforcement, judges and court personnel, a person who is the subject of a report, an alleged child victim, parents or guardians, their counsel, or a guardian ad litem. The list and the permitted information vary by state or territory. Public disclosure is generally restricted, though some jurisdictions allow limited disclosure after a child fatality or near fatality under specified conditions.

The same 2025 Child Welfare Information Gateway publication reports statutory data current only through February 2022. At that time, approximately 37 states, the District of Columbia, Guam, Puerto Rico, and the U.S. Virgin Islands allowed case-record information to be shared with placing agencies or treatment providers as needed for a child’s care. Approximately 19 states and Guam provided some record information to prospective foster or adoptive parents to help them meet a child’s needs. These are dated, qualified figures—not current 2026 counts—and do not establish what a particular person may see in a particular case.

Disclosure of a survivor’s confidential address—including a shelter location or new housing—or statements in a safety plan can increase danger to the survivor and children. Child Welfare Information Gateway advises safeguarding such information in domestic-violence-related child-protection matters. In some states, a caseworker or agency attorney may ask the court to seal it; a survivor or counsel can also raise disclosure risks with the judge. See The Role of Domestic Violence Advocates in Child Welfare Practice.
The available federal guidance establishes redaction rules and the possibility of sealing specific material, but it does not establish a nationwide rule that every protective-order petition, hearing, or order is confidential. Check the relevant court’s rules and any order in the case.
Quick Recap
How to find the rule for a specific case
- Identify the jurisdiction. Find the state or territory and the particular court. Federal rules, state statutes, and local court procedures are not interchangeable.
- Identify who holds the record. Determine whether it is in a court file, an agency case file, or discovery held by the parties or their lawyers.
- Identify the record type. A filed petition, an unfiled medical record exchanged in discovery, an agency case file, and a hearing transcript may have different access rules.
- Read the controlling language. Check applicable statutes, current court rules, and the actual protective or sealing order. A discovery order does not necessarily seal a court filing.
- Ask about local access procedures. Contact the court clerk for court-specific filing and access procedures; the clerk can explain process, though not provide legal advice. The U.S. Courts directs readers to local rules or the clerk for court-specific matters.
