There is no single nationwide procedure for a failed lethal-injection execution. The response depends on how far the attempt progressed and on the state’s law and protocol: officials may stop before administering drugs if they cannot establish IV access; if drugs have been given and the person survives, emergency medical care may follow. A failed attempt does not automatically erase the death sentence or bar another attempt.
What counts as a failed attempt?
The phrase can describe different events, and the distinction matters. An attempt that stops before lethal drugs enter the body is not the same as a person surviving after receiving one or more doses. States’ protocols may also specify backup access or repeat-dose steps, but the instructions differ by state.

Even a stopped attempt before drug administration can cause serious physical and psychological distress. In Romell Broom’s Ohio case, the team tried multiple access sites for roughly two hours; the attempt ended before lethal drugs were administered. The Ohio Supreme Court’s case summary describes bruising and tissue damage.
What happened in Christa Pike’s Tennessee execution attempt?
On September 30, 2026, Tennessee attempted to execute Pike using the state’s single-drug pentobarbital protocol. The attempt followed an approximately eight-hour delay after an appellate stay and action by the U.S. Supreme Court, according to the Associated Press. Witnesses reported that a second dose was administered and that Pike continued breathing.

What officials and attorneys said
The Tennessee Department of Correction said it followed each step of the approved protocol and that Pike had been transported to an off-site medical facility. In its September 30 media advisory, TDOC stated: “The lethal injection chemical in the protocol has consistently been effective, and the protocol does not allow for additional procedures beyond what was carried out this evening.” That is the department’s assertion, not independent proof of the drug’s effectiveness.
Pike’s attorneys said she was in critical condition, unconscious, and on a ventilator while hospital staff worked to clear the two doses. The Associated Press reported those details from a court filing; they should be understood as the attorneys’ account, not as a judicial finding. Her later clinical outcome is not established here.

What Tennessee did next
Governor Lee ordered a comprehensive third-party review and canceled the state’s remaining scheduled execution for 2026. He said the review should be thorough and continue as long as needed to answer the questions raised. These are known state actions; they do not establish what a court might decide about a future execution attempt.
What medical response follows if a person survives?
There is no universal post-failure response described for every state. What officials do depends on the stage reached and the applicable protocol. In Pike’s case, TDOC confirmed transport to an off-site medical facility. Her attorneys’ description of her condition and treatment came from their account reported by AP.

The available public account does not establish the precise moment when execution procedures ended and life-saving treatment began, or the full written Tennessee protocol instructions for a person who remains alive after the second dose. TDOC said the protocol did not allow additional procedures beyond those carried out that evening; reporting also described no specified procedure after a second dose fails to produce death. Those statements describe different kinds of evidence: the agency’s account of what it did and reporting about the protocol’s contents.
Can the state try again?
A halted attempt does not, by itself, resolve whether or when a state may carry out the sentence. The answer depends on state law, how far the attempt progressed, the circumstances of the attempt, and any constitutional claims raised afterward. There is no nationwide rule that categorically permits or bars a second attempt.

Ohio’s decision in the Broom case
In 2016, the Supreme Court of Ohio ruled 4–3 that another attempt to execute Romell Broom would not violate the federal or state prohibitions on cruel punishment or double jeopardy. The court reasoned that under Ohio law the punishment began when lethal drugs were applied; that had not occurred in Broom’s halted attempt. The ruling is specific to Ohio law and the record before that court, not a national rule.
A legal claim is not the same as a court ruling
Kenneth Smith’s 2024 petition to the U.S. Supreme Court raised whether a second attempt after a prolonged, painful IV-access attempt would violate the Eighth Amendment. The petition records a litigant’s claim and asserted facts. Its question presented is not a Supreme Court decision resolving that question.

For Pike, the Governor’s ordered review and cancellation of another scheduled 2026 execution are established state actions. The available account does not establish a final court ruling on whether or when Tennessee could attempt another execution.

Protocols are state-specific. The relevant questions are not just whether a state has a repeat-dose provision, but what triggers it, what checks must occur first, and what instructions apply if the last authorized step does not produce death.
- Failure stage: Does the protocol distinguish inability to establish IV access from a problem during drug delivery or survival after the stated doses?
- Access contingencies: Does it specify a backup IV site, an alternative access procedure, and when to stop?
- Dose contingency: Is another dose authorized, and under what conditions?
- Consciousness safeguard: What must be determined before additional substances are administered? Nebraska law, for example, requires a determination sufficient to reasonably verify unconsciousness before additional substances are given.
- Post-failure instructions: Does the protocol say who may stop the attempt and what medical response follows if death does not occur after the last authorized step?
- Legal status of another attempt: What do the state’s statutes and court decisions say, and how might the circumstances of the first attempt or a new constitutional claim affect the answer?
The Tennessee episode illustrates why post-failure instructions matter: a protocol’s provisions for a second dose do not necessarily answer what happens if that dose also fails to produce death. The public account of the episode does not supply the full protocol text.
How to assess claims about a failed execution
Accounts of an attempt may combine official statements, witness reports, court filings, judicial decisions, and statutory text. They are not interchangeable. TDOC’s statement describes the agency’s position; an attorney’s account describes what counsel reported; a court filing may present a party’s allegations; a court decision states what the court held. For example, the Death Penalty Information Center’s executive director, Robin M. Maher, called Pike’s survival after receiving lethal-injection drugs “singular and unparalleled” in AP reporting. That is her attributed characterization, not a formal statistical study.

For any particular case, check which stage the attempt reached, what the state itself confirmed, whether medical details come from a filing or an official record, and whether a claimed legal protection was actually decided by a court. Protocols and laws can change; Tennessee’s agency overview dates its revised single-drug pentobarbital protocol to December 2024.
