The phrase is used in everyday conversation, business and policy, but what counts as fair depends on the context.
What “level playing field” means
The expression comes from sport: a level field gives neither side an inherent advantage. Figuratively, it describes a situation where participants have a fair opportunity to succeed. Cambridge defines it as “a situation in which everyone has the same chance of succeeding” (Cambridge English Dictionary); Collins likewise emphasizes the absence of an initial advantage (Collins English Dictionary).
It does not necessarily mean everyone will get the same result. It means the conditions are fair enough that success is not unfairly tilted in someone’s favor before the competition begins.
How the phrase is used
Everyday situations
In ordinary conversation, it means giving people a fair chance. For example: “The revised application process gave every candidate a more level playing field.” The phrase describes the opportunity, not a guarantee that all candidates will have the same outcome.

Business and competition
In business, a level playing field means companies can compete on their merits rather than being unfairly helped or hindered by the rules. The U.S. Department of Justice Antitrust Division describes competition as allowing businesses to compete on price, quality, innovation and wages in an open market, without anticompetitive restraints (DOJ Antitrust Division mission).
Policy and competitive neutrality
In policy discussions, the phrase often concerns whether businesses face neutral competitive conditions. The OECD’s concept of competitive neutrality focuses on avoiding undue advantages tied to factors such as state support, regulation, ownership, nationality or legal form (OECD Competitive Neutrality Toolkit; OECD on competitive neutrality in competition policy). The relevant question is which differences distort competition in the particular market.

Equality and opportunity
In discussions of equality, a level playing field can mean making opportunities fairer. But applying the same rule to everyone does not always give everyone the same practical chance to benefit from it. The Law Society of England and Wales distinguishes formal equality—treating people in the same way—from substantive equality, which considers broader circumstances and outcomes; an identical policy may disadvantage people who share a protected characteristic (Law Society D&Ictionary).
Does “level playing field” have a legal definition?
Not one universally precise definition. The phrase can appear in legal and policy discussions, but on its own it does not specify a single test for fairness or the remedy required. In UK parliamentary oral evidence, Professor Andrea Biondi said that someone seeking a “very tight legal definition” of the phrase would probably struggle to find one (UK Parliament, House of Lords Committee oral evidence). That was his view in a particular discussion, not a ruling that the phrase can never have legal significance.

For a legal question, identify the jurisdiction and the relevant statute, treaty, contract or policy instrument. That is where the enforceable obligations and applicable standard must be found.

- Starting advantage: Is someone said to have an undue head start?
- Same rules or fair practical opportunity: Would identical treatment work fairly, or do circumstances affect people’s ability to benefit from the rules?
- Market neutrality: Is the concern state ownership, regulation, nationality or another source of competitive advantage?
- Legal obligations: Which jurisdiction and legal instrument supplies the actual standard?
These distinctions help explain why people may use the same expression while disagreeing about what fairness requires.
