An edit is materially misleading when it could change a viewer’s reasonable understanding of the property—its features, condition, or surroundings. Correcting exposure or color can improve clarity without changing what the image represents; adding a window, removing a power line, or digitally changing a view can make the property appear different. The precise boundary and any disclosure requirements depend on the applicable law and MLS rules.
How to tell a clarity correction from a misleading change
Ask whether the edit merely makes the photo easier to see or changes what a buyer could reasonably conclude is there. Rules differ, but CRMLS and ARMLS both distinguish common image adjustments from edits that misrepresent the real property.
Usually clarity-focused
Modest adjustments to lighting, exposure, white balance, color, sharpness, cropping, or straightening may be permitted when they do not change the representation of the property. CRMLS lists common adjustments of this kind as outside its definition of a digitally altered image when they leave that representation unchanged; ARMLS likewise permits standard clarity adjustments that do not misrepresent the property. These are examples from particular MLS guidance, not blanket permission for every listing or jurisdiction.

An edit becomes materially concerning when it changes an actual feature or something visible from the property. CRMLS examples include modifying walls, windows, structural elements, cabinets, flooring, paint color, fixtures, landscaping, the façade, floor plans, utility poles, window views, or neighboring properties. NSW government guidance similarly warns that digitally adding or removing features can change a property’s appearance and mislead consumers.

A practical test is to compare the edited image with the property as it exists: would a viewer infer a feature, finish, improvement, view, or surrounding condition that is not actually present? If so, the edit is not simply a cosmetic correction.
Virtual staging and AI edits
Virtual staging can show how a room might be furnished, but it should not imply that furniture, appliances, finishes, permanent improvements, or views are included when they are not. AI-generated changes raise the same accuracy issue: the tool used does not make an inaccurate depiction acceptable. Follow any local requirement to label staged or altered images and provide an original image.

A practical check before publishing an edited listing photo
- Compare against the actual property. Check whether the edit adds, removes, or changes a feature or visible surrounding condition.
- Separate clarity work from representation changes. Routine adjustments may be acceptable if they leave the property’s appearance materially unchanged; changes to features, views, or surroundings need closer scrutiny.
- Identify staging or generated elements. Make sure the image does not imply that staged furniture, appliances, finishes, improvements, or other elements are part of the property when they are not.
- Check the applicable rules. Confirm current MLS requirements and relevant local advertising rules rather than relying on a procedure used elsewhere.
- Provide and label images as required. Where the applicable rule calls for an original or as-is image, include it in the required position and label the altered version accurately.
