Brazil’s president can propose federal tax laws and budgets, oversee execution of the enacted federal budget, and nominate Central Bank leaders. The president cannot unilaterally rewrite the tax system, spend outside legal appropriations, or direct the Central Bank’s monetary-policy decisions. Congress, the Senate, constitutional limits, fiscal rules, and the Bank’s statutory autonomy all shape what can happen.

At a glance: proposal is not the same as control

Area What the president can initiate or administer What limits the president
Taxes Set a federal policy agenda and submit legislative proposals. Congress legislates, and the Constitution allocates taxing powers among the Union, states, Federal District, and municipalities.
Spending Submit federal budget proposals and execute the budget once enacted. Appropriations, mandatory expenditures, and fiscal rules constrain execution.
Central Bank Nominate the Bank’s president and directors. The Senate approves nominees; statutory terms and autonomy limit presidential control of the Bank’s operations.

These distinctions follow Brazil’s Constitution, Complementary Law No. 179 of 24 February 2021, and the Fiscal Responsibility Law. The government-hosted English translation of the Fiscal Responsibility Law is labeled revised 2025; for close legal interpretation, the Portuguese text controls. This overview reflects the legal framework available as of 4 October 2026, not a prediction about political negotiations or a year-specific budget outcome.

What the president can change about taxes

Federal taxes require legislation

The Constitution assigns taxing powers separately to the Union, states, Federal District, and municipalities. A president can make federal tax changes a priority and propose legislation, but a proposal must go through Congress and the constitutional legislative process. An executive decision cannot permanently rewrite tax law on its own.

The president also cannot take over state or municipal taxing powers by decree. Changing the constitutional allocation of those powers requires a constitutional amendment, not an ordinary presidential order.

The 2023 reform created shared governance

Constitutional Amendment 132 of 2023 amended the Constitution’s tax provisions and established a revised goods-and-services tax framework that includes the IBS Management Committee. The Constitution describes that committee as a public entity with technical, administrative, budgetary, and financial independence, with state and municipal representation. As a result, the post-reform framework is not simply a matter of presidential command: it involves constitutional rules and shared institutional governance.

What the president can change about spending

The president proposes; Congress considers and authorizes

Brazil’s budget framework includes a multi-year plan, a budget-guidelines law, and an annual budget law. The president’s government submits budget proposals, while Congress considers them. Once the annual budget is in force, the Executive is responsible for implementation, but it must work within enacted appropriations and other legal requirements. Federal spending is not one freely adjustable pool: some outlays are mandatory, and some resources are legally tied to particular uses.

Execution is subject to fiscal rules

Under the Fiscal Responsibility Law, after the budget is published the Executive Branch establishes financial programming and a monthly disbursement schedule within 30 days. If revenue projections indicate that fiscal targets may be missed, the law calls for restrictions on commitments and financial execution in accordance with the Budget Guidelines Law. The law exempts legally or constitutionally mandatory spending, debt service, and specified other categories from those restrictions.

The exact adjustments available in a particular year depend on that year’s budget laws and appropriations. The general rule is that the president’s government administers execution within legal limits; it cannot spend beyond authorized amounts or freely cut every line item.

What the president can change about the Central Bank

Appointments require Senate approval

The president nominates the Central Bank president and directors, but the Senate must approve the nominees. Under Complementary Law No. 179, the president and directors serve staggered four-year terms. The law defines the Central Bank as a special autonomous agency without ministerial subordination and grants it technical, operational, administrative, and financial autonomy.

That autonomy also limits removal. The statute lists specific grounds, including resignation, incapacity, certain final or collegial convictions, and proven recurring insufficient performance. For removal on the insufficient-performance ground, the Monetary Policy Council must submit the proposal and the Senate must approve it by an absolute majority. Presidential appointment power therefore does not amount to an at-will dismissal power.

Monetary policy is not a presidential instruction

The Monetary Policy Council sets monetary-policy targets, and the Central Bank has exclusive responsibility for conducting the monetary policy needed to meet them. The Bank’s fundamental objective under Complementary Law No. 179 is price stability; the statute also identifies financial stability and efficiency, smoothing fluctuations in economic activity, and promoting full employment as objectives.

The Constitution gives the Central Bank exclusive authority to issue the Union’s currency and prohibits it from lending directly or indirectly to the National Treasury. It does permit the Bank to buy and sell Treasury securities to regulate the money supply or interest rates. That limited monetary-policy tool is distinct from the government’s budget and fiscal relationship with the Bank.

How to assess a proposed change

  • Identify the mechanism: Is the president proposing a bill or budget, implementing an enacted law, or nominating an official?
  • Check who must approve it: Tax and budget legislation goes through Congress; Central Bank leadership nominations require Senate approval.
  • Check the legal boundary: The Constitution, appropriations, fiscal rules, fixed terms, and Central Bank autonomy may limit what an executive action can accomplish.
