Event contracts are derivatives whose value or payout depends on whether an event or other specified occurrence happens. They are often designed as yes/no contracts, but “event contract” describes the underlying subject matter, not one mandatory legal form. Depending on its terms, an event contract may be structured as a swap, a futures contract, or an option. A swap is a particular legal category, so the terms are not synonyms.
What is an event contract?
An event contract links a financial position to an objectively defined event, contingency, index, or other interest. The underlying question might concern weather, an economic release, a financial index, an election, a sporting result, or a scientific or cultural occurrence. The contract rules specify what counts as the event, how the result will be verified, and what payment follows.
The Commodity Futures Trading Commission (CFTC) says “event contract” is not a term defined in the Commodity Exchange Act (CEA) or in CFTC regulations. In a proposed rule published March 16, 2026, the agency uses the term for derivative contracts that are typically based on the outcome of an occurrence or event and often have a binary payoff. The word typically matters: some event contracts can have a variable or otherwise non-binary payoff.
The CFTC has used the phrase since at least 2008. Its official wording is: “While the term ‘event contract’ is not a defined term in the CEA or the CFTC’s regulations thereunder, the CFTC has used this term to describe derivative contracts, typically with a binary payoff structure, based on the outcome of an underlying occurrence or event since at least 2008.”

How does a yes/no event contract pay out?
Consider the CFTC’s illustrative question: “Will it rain tomorrow?” A market could offer a “yes” position at 70 cents and a “no” position at 30 cents. Those prices express the market’s current expectations; they are not a guaranteed probability or forecast. Prices can move before settlement as information and demand change.
- Choose a side. You buy the yes or no position under the venue’s contract rules.
- Pay the quoted price. In the illustration, one yes contract costs $0.70 and one no contract costs $0.30. The actual price, contract unit and fees depend on the listed product.
- Wait for the defined observation. The rules identify the date, location, data source or other test used to decide whether the event occurred.
- Settle against the outcome. If the event occurs, the winning side receives the contract’s stated payout; if it does not, the other side wins. Ambiguous outcomes are handled under the venue’s published procedures.
- Calculate the result. For a purchased position, profit is the settlement payout minus the initial purchase cost and any applicable fees. A losing position can expire with no payout.
This example describes one common design, not every event contract. Before trading, read the contract’s payout amount, price convention, expiry time, source of information and rules for corrections or disputed results.
Are event contracts swaps?
Sometimes, but not automatically. “Event contract” identifies what the derivative is based on. “Swap” identifies one possible legal structure under the CEA. The classification turns on the contract’s terms, the underlying event and the statutory definitions and exclusions that apply.

The CEA’s swap definition covers certain agreements, contracts or transactions involving payments that depend on an event or contingency associated with a potential financial, economic or commercial consequence. An event-dependent payment can therefore fit within the swap definition in some circumstances. The CFTC’s 2026 proposal also discusses event contracts that are options or binary options under relevant statutory language.
Futures contracts are a critical exception to any blanket statement. The CEA excludes futures contracts, and options on futures contracts, from the definition of “swap.” An event contract listed and legally structured as a futures contract is therefore not classified as a swap merely because its payout depends on an event.

CFTC Staff Letter No. 26-14 emphasizes that the contract’s structure and terms—including the underlying event—determine whether a product is a swap, future or option. The same label used in a marketing description cannot settle the legal question.
Event contract versus swap: the differences that matter
| Comparison point | Event contract | Swap |
|---|---|---|
| What the term describes | A derivative tied to an occurrence, contingency, index or other event-related interest. | A legal category defined by statutory characteristics and exclusions. |
| Relationship between the terms | Can be structured as a swap, future or option. | Can include some event-dependent contracts, but not every event contract. |
| Typical payoff | Often binary, although the CFTC says “typically,” not always. | May use payment formulas that are fixed, variable or contingent; the payoff follows the swap’s terms. |
| Underlying subject | Could be weather, a financial or economic indicator, politics, sport, science, culture or another specified event. | May reference rates, currencies, commodities, securities, indices or event contingencies, depending on the instrument. |
| Trading format | May be listed on a designated contract market (DCM) or offered through another permitted venue, depending on its legal form. | May be negotiated bilaterally or executed on a swap execution facility (SEF) when applicable; venue and clearing requirements depend on the product. |
| Key legal test | Read the actual terms and apply the CEA classification, including exclusions. | Determine whether the transaction meets the swap definition and whether an exclusion or different category applies. |
Some products look similar in practice even when their legal labels differ. Staff Letter No. 26-14 notes that certain fully collateralized, binary-payout contracts listed on DCMs may meet the swap definition while also using standardized terms, exchange trading protocols, fungibility and position offset features commonly associated with futures and options on futures. Trading experience alone therefore cannot determine classification.
What determines an event contract’s legal classification?
1. The contract’s written structure
Start with the instrument’s definitions, payment obligations, collateral terms, maturity and settlement provisions. A binary payment does not by itself decide whether the product is a swap, future or option.
2. The underlying event or interest
Identify exactly what drives value: a weather measurement, an economic number, an index level, a political result, a game outcome or another contingency. The statutory analysis can differ with the type of underlying and the consequence connected to it.
3. Statutory exclusions
Check whether the transaction is a futures contract or an option on a futures contract, which the CEA excludes from the swap definition. Other facts and regulatory provisions may also matter, so a product description is not a substitute for the governing rules.

4. Where and how it trades
A DCM is an exchange authorized to list futures and other permitted derivatives. An SEF is a facility for trading swaps that brings together multiple participants using a system or platform and follows the CFTC’s applicable requirements. The venue, access model and listing process provide context, but they do not replace analysis of the contract language.
How event contracts are traded and settled
Standardized exchange contracts
Listed products generally publish a standard contract unit, tick or price increment, expiration, trading hours, margin or collateral rules, and an official settlement source. Standardization can make positions fungible: one contract can be offset by an equal and opposite position rather than held to the final event.
Position offset before settlement
If the market allows offset, a trader can sell a purchased position or buy back a sold position before the event is decided. The exit price may produce a gain or loss independent of the eventual outcome. Liquidity, spreads, trading halts and venue rules affect whether an offset is available at a useful price.
Final settlement
Settlement rules should state the observation window, geographic scope, data provider, rounding method, time zone and process for corrected or missing data. They should also explain who makes the determination and how an ambiguous result is handled. Those details can change the economic result even when the headline question sounds simple.

- financial indices and economic indicators;
- weather conditions;
- political and international events;
- scientific and cultural events;
- current events; and
- sporting events.
The subject matter does not, by itself, reveal the legal category. A weather question could be implemented through different structures, and two contracts about the same event could have different settlement, trading and regulatory terms.
How large has the listed event-contract market become?
The CFTC’s proposed rule reports a sharp increase in the number of event contracts certified for listing:
| Period | Figure reported by the CFTC | What it measures |
|---|---|---|
| 2006–2020 | Approximately five event contracts per year on average | Average annual listings described by the agency |
| 2021 | 131 newly listed event contracts | New listings during that year |
| 2025 | Approximately 1,600 event contracts certified for listing | Contracts certified for listing, not trading volume |
These figures count listings discussed in the proposal. They are not counts of trades, customers, open interest or contracts that remained active, and they should not be read as evidence that every listed product was liquid or successful.

The CFTC document published March 16, 2026 is a proposed rule, not a final rule that resolves the classification of every event contract. It asks for comment on how event contracts should be classified and regulated. Rulemaking, agency action and court decisions can change the outcome, so the proposal’s positions should be treated as current regulatory context rather than settled law.

The proposal states that a prediction market offering swaps or futures to the general public must register with the CFTC as a DCM. It also discusses SEFs and the difference between their access model and DCM markets. The appropriate registration and venue depend on the product’s legal form and the activities being conducted.

Registered venues have general obligations when listing derivatives, including a requirement that listed contracts not be readily susceptible to manipulation. The CEA also gives the Commission authority to prohibit certain event contracts if it determines that they are contrary to the public interest. Oversight and listing approval do not mean the CFTC has endorsed every contract, predicted its outcome or guaranteed that a trader will be paid.
How to evaluate an event contract before trading
The CFTC’s consumer guidance points to a practical review. Use this checklist for the specific market, not just its headline question:
- Read the contract rules. Confirm the event definition, contract unit, expiration, payout and settlement source.
- Understand the outcome process. Find out who determines whether the event occurred, when the determination is made, and what happens if information is revised or inconclusive.
- Calculate the maximum loss. Include the purchase price, potential collateral or margin obligations and every stated fee. A position that expires without a payout can lose the amount committed.
- Check trading and exit mechanics. Determine whether the position can be offset, whether trading can be halted, and how bids, offers and spreads affect an early exit.
- Monitor open positions. Use the venue’s alerts or, where appropriate and available, stop-loss orders. A stop order cannot guarantee a particular execution price during a fast or illiquid market.
- Use only risk capital. The CFTC defines this as money that can be put at risk after living expenses and savings needs are covered.
- Confirm customer information. Customers should receive timely, transparent terms covering payout, prices and how settlement decisions will be made.
Common mistakes and how to avoid them
Calling every event contract a swap
This ignores futures and options classifications and the statutory futures exclusion. Use the contract’s legal terms and applicable CEA definitions.

Binary yes/no products are common, but the CFTC describes them as typical rather than universal. Verify the actual payoff formula.
Treating a market price as a guaranteed probability
A 70-cent yes price in the CFTC’s example reflects market expectations at that time. It can change and does not guarantee that rain will occur.
Ignoring settlement fine print
A precise event question can still produce disputes if the rules do not clearly identify the location, time window, data source, corrections policy or tie procedure.
Confusing listing with liquidity or endorsement
A contract being certified or listed does not establish its trading volume, active users, ease of exit or likelihood of a particular outcome.

- Describe the event. Write the exact occurrence and measurement that determines value.
- Identify the payoff. Is it binary, variable or another formula? What is the maximum amount payable and receivable?
- Read the legal terms. Look for language identifying a swap, future, option, option on a future, collateral and settlement obligations.
- Check the venue. Is the product on a DCM, traded through an SEF or offered under another regulated arrangement?
- Test the practical risk. Can you afford the maximum loss, understand the fees and exit before settlement if needed?
- Verify the regulatory status. Distinguish a final rule from a proposal and check for current agency or court developments before relying on a legal conclusion.
Bottom line
An event contract is a broad description for a derivative tied to an event or occurrence. A swap is one possible legal structure, not a synonym. Some event contracts are swaps; others are futures or options, and futures contracts are excluded from the CEA’s swap definition. To classify a particular product, examine its written terms, underlying event, payoff, settlement process, venue and statutory exclusions. For trading decisions, the practical questions are equally important: what can be lost, how the event will be decided, what fees apply and whether the position can be offset before settlement.
