Property tax can apply to much more than an AI data center’s land and building: depending on state law, power, cooling, and other site infrastructure may also be assessed as real property. Servers and related computer equipment may instead be taxed as personal property under separate depreciation schedules. The distinction can materially affect a project’s tax base, but rules vary by jurisdiction; available examples do not establish a typical national bill or show that all operators overlook the issue.

How property tax applies to data centers

Local property tax is generally tied to the assessed value of taxable property under the rules of the jurisdiction where it sits. For a data center, the first question is not simply how much the project cost. It is which assets are taxable, how each asset is classified, and how the assessor values it.

A project may have land and buildings, extensive electrical and cooling systems, and racks of computer equipment. Those assets can fall into different assessment categories and may be valued on different schedules. A tax incentive for one type of tax does not automatically change the property-tax treatment.

Which data center assets may be treated as real property?

Virginia’s Code defines data-center fixtures to include a broad range of infrastructure: generators, radiators, exhaust fans, fuel storage tanks, substations, power-distribution and cogeneration equipment, batteries, chillers, computer-room air conditioners, cooling towers, HVAC, water systems, monitoring systems, and transmission and distribution equipment. The statute excludes computer equipment and peripherals, external surveillance and security equipment, and fire and burglar alarm systems from that particular fixture definition.

That definition is specific to Virginia law, not a nationwide classification rule. An asset’s treatment elsewhere depends on the applicable state and local law. Developers should therefore verify classifications for the actual facility and jurisdiction rather than assume that every item installed inside a data center is assessed in the same way.

How qualifying Virginia fixtures are valued

Virginia requires qualifying data-center fixtures taxed under its real-property chapter to be assessed using the cost approach. Under the statute, that approach determines reproduction cost or suitable replacement cost and deducts physical, functional, and economic depreciation. The method is not simply a tax on the original project budget: the statutory valuation includes depreciation adjustments.

How servers and other computer equipment may be assessed

Computer equipment can be assessed separately from real-property fixtures as business personal property. The schedules below illustrate why the distinction matters: they apply jurisdiction-specific percentages to equipment cost or value, and they do not establish the tax bill. The applicable tax rate, assessment rules, reporting requirements, and the equipment’s classification also matter.

Loudoun County’s 2026 computer-equipment schedule

Loudoun County, Virginia, says its business personal-property assessments are based on a percentage of original cost. Original cost includes capitalized costs to place an item into service. The county’s 2026 data-center computer-equipment schedule is:

Beginning with tax year 2026, Loudoun taxpayers must summarize capitalized costs by acquisition year for the most recent year and the prior five years. These are Loudoun County rules, not a standard that can be applied to data centers in other counties or states.

Utah’s 2026 recommended factors

Utah’s 2026 recommended personal-property schedule classifies computer hardware as data-processing equipment and peripherals subject to rapid functional and economic obsolescence. Its acquisition-year percent-good factors are:

These are Utah recommendations, not a universal depreciation schedule. The differences between the Utah and Loudoun factors also show why a schedule from one jurisdiction should not be used to estimate another jurisdiction’s taxable value.

Do data-center tax breaks reduce property taxes?

Not necessarily. Incentives must be identified by tax type and program. A sales or use tax exemption on qualifying purchases is not the same as a property-tax exemption or a reduction in assessed value.

Texas describes sales and use tax exemptions for qualifying data centers and qualifying large data-center projects. Eligibility includes facility and operator requirements, including specified investment and job commitments. Texas also says facilities with agreements limiting appraised value under Tax Code Chapter 313 do not qualify for that sales and use tax exemption. The program description does not make the exemption a general property-tax break.

Washington has its own sales and use tax incentive rules and eligibility limits, including an eligibility change in 2026. Those rules are distinct from Texas’s program. For a particular project, the relevant agreement and current program requirements determine which taxes may be affected; the existence of an incentive alone does not answer how the property is assessed.

What assessment appeals can—and cannot—tell you

Assessments may be contested through the applicable local appeal process, but a local result is not evidence of a national pattern. In a July 24, 2026 account of the 2025 appeals cycle, the Cook County Assessor’s Office said several data centers received only minor reductions after the office defended their assessments. The report lists a 28.94% assessment reduction for Digital Realty ORD-15. That figure concerns one property’s assessment reduction, not a typical data-center tax reduction or a percentage of its tax bill.

The Assessor’s report described the office’s effort to defend assessments at appeal hearings; it should be read as the office’s account of its own work and reported outcomes, not as an independent national assessment study.

What to check when evaluating a project’s property-tax exposure

A useful comparison between proposed sites starts with comparable local evidence, not a national average. The available sources do not establish comparable effective tax rates, project-level bills, or a typical tax cost per megawatt.

  1. Build an asset inventory. Separate land and buildings, power and cooling infrastructure, servers and peripherals, and other equipment. Ask the local assessor how each category is classified under the rules that apply to the site.
  2. Confirm valuation and depreciation methods. Identify whether assets are assessed under a real-property cost approach, a personal-property schedule, or another locally applicable method. Check how physical, functional, and economic depreciation or obsolescence are handled.
  3. Check the assessment date and reporting rules. Determine the relevant tax year, how acquisition costs must be reported, what costs count as original or capitalized cost, and whether the assessor requires acquisition-year summaries.
  4. Establish local rates and practices. Obtain the applicable property-tax rate and review the local assessment process. The schedules in this article are valuation factors, not tax rates or tax-bill estimates.
  5. Map the appeal route. Identify the deadlines, forum, evidence requirements, and records needed to challenge an assessment. A result for another property is not a prediction of the outcome for this one.
  6. Read incentive terms by tax type. Verify the incentive’s eligibility, duration, tax covered, and exclusions in the current program rules and any project agreement. Do not treat a sales-tax exemption as property-tax relief.

Assessment systems differ by jurisdiction. California’s State Board of Equalization, for example, maintains a State-Assessed Properties Program with assessment manuals and valuation materials; it illustrates the jurisdiction-specific nature of valuation systems, but is not itself a data-center-specific local tax guide. For a named site, the county assessor, current state statutes, local tax rate, incentive agreement, and assessment and appeal records are the relevant starting points.
