The Senate failed to advance the CLARITY Act on September 15, 2026, in a 49–50 procedural vote—short of the 60 votes needed to move it forward. That leaves the bill’s path uncertain, not permanently closed. Meanwhile, the SEC has continued to interpret existing securities law, propose rules and grant limited relief in specific areas of crypto markets. Those actions are not a finished substitute for a law establishing a broader market-structure framework.

Why is the CLARITY Act stuck?

The immediate obstacle is political disagreement over the bill’s ethics provisions, alongside the Senate’s 60-vote threshold to advance it. The Associated Press reported that Democrats withheld support amid debate over restrictions tied to President Donald Trump’s crypto interests. Massachusetts Senator Elizabeth Warren, the top Democrat on the Senate Banking Committee, argued that the bill should not allow Trump to profit from crypto while in office. Supporters, by contrast, said the legislation would provide legal certainty and consumer protections.

Those are competing arguments, not settled findings about the bill’s effects. Several Democrats remained open to negotiation, according to AP, but the September 15 vote did not resolve the disagreements. AP also reported that Congress would be out of session in October and before the elections, making the near-term path uncertain. As of October 3, the legislation had stalled at the procedural stage; it had not been formally declared dead.

What is the SEC doing while Congress is stalled?

The SEC is using several distinct tools under its existing authority. Their legal status and reach differ: an effective interpretation explains how the agency applies existing law; a proposed rule could change if adopted after public comment; and an exemptive order grants relief only on specified conditions. None by itself creates the comprehensive statutory framework Congress could enact.

SEC Chairman Paul S. Atkins has said the agency’s steps fall within its statutory authority, while also arguing that durable legislation remains indispensable. In remarks on September 14, he said the Administration would deliver “with or without” the legislation. That is the SEC’s stated rationale for continuing its work, not a claim that agency action has the same scope or durability as a congressional statute.

What would the SEC’s proposed offering rules do?

Announced on August 18, proposed Regulation Crypto Assets would create two exemptions for certain offerings involving investment contracts tied to crypto assets, plus a conditional safe harbor. These are proposed terms, not available exemptions today.

  • Smaller offering exemption: proposed to allow up to $5 million in offerings over a four-year period.
  • Larger offering exemption: proposed to allow up to $75 million in each 12-month period. The proposal includes disclosure requirements and, for this exemption, financial statements and ongoing reports.
  • Conditional safe harbor: proposed to address when an asset would no longer be subject to an investment contract in specified circumstances—after promised essential managerial efforts are completed or permanently cease.

The SEC’s release specified a 60-day public-comment period beginning after publication in the Federal Register. The proposal could be revised following comments; its limits, reporting duties and safe-harbor conditions should not be treated as final requirements.

Who qualifies for the Innovation Exemption?

The September 17 order provides temporary, conditional relief from certain Exchange Act definitions: “exchange” for qualifying Tokenized Securities Venues and “dealer” for specified Covered Firms providing liquidity. It applies to certain tokenized NMS stock activity, not crypto trading generally or every tokenized security.

Participating venues face conditions that include limits on the symbols and volume they may handle, verifying that tokenized shares carry rights equivalent to the corresponding stock, and making smart contracts publicly auditable. The relief is stated to last five years after publication, and it applies only while participants meet the order’s requirements. It is therefore a targeted bridge, not a permanent rewrite of securities law.

What does the new custody proposal cover?

On October 1, the SEC proposed a tailored custody framework for registered investment advisers and regulated funds—registered investment companies and business development companies. The proposal contemplates conditional pathways for advisers and funds to use self-custody in some circumstances and to use state trust companies as custodians.

The framework is not final. Its comment period runs for 60 days after Federal Register publication, so its provisions may change before any final rule takes effect. It concerns how covered advisers and funds safeguard crypto assets; it does not settle custody requirements for every crypto holder or business.

Can the SEC regulate crypto without Congress?

The SEC can act within authority granted by existing statutes, as illustrated by its effective interpretation, proposed rules and conditional exemptive order. But the legal tools do different jobs and have different limits. An interpretation states how the agency views existing law; a proposal is subject to public comment and may be changed; an exemption applies only to qualifying conduct under its terms. None resolves every question of crypto market structure or binds Congress to the same policy choices.

The CLARITY Act, if enacted, could establish a broader statutory framework. As of October 3, it had not advanced in the September vote. The agency’s parallel work may address particular issues in the meantime, but it should not be mistaken for the bill’s passage or a comprehensive legislative settlement.

What to watch next

  • The bill: whether lawmakers resume negotiations and whether ethics provisions or other disagreements change enough to attract the support needed to advance it.
  • Regulation Crypto Assets: Federal Register publication, the comment deadline and any subsequent revisions or final action.
  • Custody rules: Federal Register publication, comments and whether the SEC changes the proposed self-custody or state trust-company pathways.
  • Innovation Exemption: how qualifying venues and liquidity providers meet its conditions during the order’s limited term.

The status of each measure can change. The SEC described the innovation order in its September 17 statement, “Statement on the Innovation Exemption: A Bridge Toward Durable Rulemaking,” and announced its custody proposal on October 1. AP’s September 15 coverage reported the Senate vote and the political debate around it.
