A website visitor, a sales lead, and an existing customer describe different points in a relationship—not fixed legal categories. What a business may responsibly do with information about each person depends on where it came from, whether it can identify someone, why it is being used, and what the person was told. This guide explains those distinctions and practical checks for collection, analytics, and marketing. Legal guidance below is UK-specific; rules differ elsewhere.

What is the difference between a website visitor, a lead, and a customer?

These are useful working labels for organizing information and deciding what to do next. They are not universal legal definitions, and a person may move between categories or fit more than one at once.

The Information Commissioner’s Office (ICO) says direct-marketing information may come from people with whom an organization has a relationship, third parties, or public sources, and may be used to reach prospects, add contact channels for existing customers, or profile customers. The source and purpose still matter; the category label does not settle whether a particular use is appropriate. ICO guidance on collecting information and generating leads.

What counts as customer data?

Customer data is not one uniform type of information. It can include details a person provides, records created through a service relationship, online identifiers, linked attributes, opinions, or inferences. Under the UK GDPR definition summarized by the ICO, personal data is information relating to an identified or identifiable individual. A name is not required: an identifier or combination of details may make someone identifiable. ICO guidance on personal data.

For each data item or collection, distinguish four questions:

  • Source: Did the person provide it directly, did it come from a public source, or did a partner or data broker supply it?
  • Purpose: Is it needed to deliver a service, improve the service using aggregate statistics, send direct marketing, profile someone, or share information with another organization?
  • Identifiability: Is it an aggregate count that cannot identify a person, or can it be connected to an individual through an identifier or linked information?
  • Choice and access: What were people told, which channels did they choose, who can access individual-level information, and how can they object?

These distinctions are more useful than assuming that a label such as “first-party” makes a practice privacy-safe. The ICO says whether a storage or access technology is called first-party or third-party is not the main privacy consideration; responsibility for the storage or access and the purpose are more important. What should a lead form tell people?

When collecting information for direct marketing, be upfront about that use. The ICO says privacy information should be clear, visible, and suited to its audience. A just-in-time notice near the relevant field or a layered notice that presents the key point first can help people understand what they are being asked to provide and why. Explain relevant sharing and how people can object or opt out; do not bury the important point in dense or hard-to-find wording. A practical form review asks whether a person can tell:

  • which organization is collecting the information;
  • what the information will be used for, including direct marketing where relevant;
  • which channels the person is choosing or being asked to use;
  • whether information will be shared with another organization; and
  • how to object or opt out later.

Do not treat a request for one kind of contact as a blanket choice of other channels. The ICO says additional email addresses or phone numbers obtained from another source without agreement are likely to be unfair in most cases, because people should be able to choose the channels used to contact them. It also cautions against tracing someone for direct marketing when contact details are stale: consent for old details does not automatically extend to an address the person never supplied. Can a business use publicly posted information for marketing?

Public visibility is not permission for any use. The ICO says that information on a public social-media page is not automatically fair game for direct marketing: a person may not expect a business to collect it and use it to make marketing contact. Consider whether the intended use is reasonably expected and whether collecting and using the information is fair and lawful under the applicable rules. What should a business check before buying or renting a lead list?

Buying a list does not transfer responsibility for how the information was collected or how it is used. The ICO says an organization remains responsible when it buys or rents marketing data, and supplier assurances alone are not enough. Ask for evidence and assess the list before using it.

  1. Identify the source. Establish who compiled the information and whether it came directly from people, public sources, or other suppliers.
  2. Check collection details. Find out where and when the data was gathered and how people were told it would be used.
  3. Examine consent evidence. If the supplier relies on consent, check what people agreed to, including the organization and marketing purpose covered.
  4. Confirm channel scope. Check whether the evidence covers the channels the business intends to use; do not assume permission for one contact method covers another.
  5. Check objections and suppression. Establish how opt-outs and objections are recorded and applied so that people who have objected are not contacted.

If these points cannot be established, the list does not become suitable for marketing simply because it was purchased. ICO guidance on collecting information and generating leads.

What is the difference between aggregate website analytics and tracking visitors?

Aggregate analytics summarizes behavior across a group without identifying individuals; visitor tracking links activity to a person or an individual identifier. The distinction affects what the data reveals and how it may be used.

Use Examples in ICO guidance How to interpret the distinction
Aggregate service-improvement statistics Total visits, aggregate page interactions, device types, referrers, A/B testing, coarse non-identifying location, page-loading statistics, and bounce statistics The ICO describes a limited UK exception for statistical purposes where information is aggregated so the result cannot identify people and is used to improve a service.

The distinction is about the actual processing, not merely the tool or its “first-party” or “third-party” label. The ICO also says individual-level information used to produce aggregate analytics should be kept only as long as needed for aggregation. This exception and consent guidance are UK-specific and concern the described storage and access uses; do not treat them as a universal rule for every country or analytics setup. How to manage customer data across its lifecycle

A workable process connects collection, use, access, retention, and people’s choices instead of treating privacy as a notice written once and forgotten.

  1. Label the relationship and source. Record whether someone is a visitor, prospect, customer, or service user, and where each important item of information came from.
  2. Set a specific purpose. Separate service delivery, aggregate service improvement, direct marketing, profiling, and sharing rather than treating all later uses as interchangeable.
  3. Explain collection in context. Put clear information where people make the relevant choice, especially when asking for contact details or proposing marketing use.
  4. Limit channels to the person’s choice. Do not append contact details or assume old contact permissions authorize a newly found address or a different channel.
  5. Restrict individual-level access and retention. Make clear who receives identifiable information and keep it only as long as needed for the stated purpose. For UK aggregate analytics, the ICO specifically says to keep individual-level data only as long as needed to produce the aggregate result.
  6. Apply objections and opt-outs. Treat a person’s choice as part of the record and the ongoing process. The ICO’s direct-marketing guidance says people have an absolute right to object to or opt out of direct marketing at any time.

Which rules apply outside the UK?

The legal explanations here describe ICO guidance for the UK, not a universal privacy standard. The ICO’s cited guidance notes that some material is under review following the Data (Use and Access) Act. If a business operates elsewhere, it must check the current laws and regulator guidance that apply to its customers, channels, and technologies rather than carrying over a UK-specific conclusion. Frequently Asked Questions

Is a website visitor automatically a lead?

No. A visitor is someone interacting with a site; a lead is a working label for someone who has entered a prospect or sales process. A visit alone does not establish that relationship or permission for marketing.

Does publicly available information count as personal data?

It can. Under the UK GDPR definition summarized by the ICO, information relating to an identified or identifiable person may be personal data, and public availability does not by itself make direct marketing fair or expected.

Does permission to email someone also allow a business to call them?

Do not assume so. The ICO says people should be able to choose which channels are used to contact them, and additional contact details obtained without agreement are likely to be unfair in most cases.

Can a business keep visitor-level data after creating aggregate analytics?
