The latest reported arithmetic points to a baseline of seven seats for the BJP-led NDA and two for the Samajwadi Party (SP) with Congress support, leaving the tenth seat as the main uncertainty. Uttar Pradesh’s 10-seat Rajya Sabha poll is scheduled for October 16, 2026; until voting and counting take place, each outcome remains a scenario, not a result.
What is being decided, and when?
Ten Uttar Pradesh seats are being filled in this round. Nine are regular vacancies because their members’ terms end on November 25, 2026. The tenth became vacant when Dinesh Sharma resigned on September 11 after being appointed Lieutenant Governor of the Andaman and Nicobar Islands. Polling is scheduled for October 16, alongside one Rajya Sabha poll in Uttarakhand. News On AIR reported October 6 as the UP nomination deadline. The Election Commission’s terms table lists the Uttar Pradesh Assembly at 403 seats. That is its full size, not the effective strength used in the latest reported quota estimate. The ECI terms-of-houses table provides the full Assembly figure.
How many seats can the BJP-led side and SP win?
Hindustan Times reported on October 2 that the Assembly’s effective strength was 397 and that 37 first-preference votes were needed for a seat. Its working baseline is seven NDA seats and two for SP with Congress support. Those figures leave a tenth seat whose destination depends on candidate choices and support beyond the blocs’ reported baseline. The outlet estimated the BJP at roughly 255–257 MLAs, core NDA partners at 288–289 combined, and a broader NDA-supporting total as high as 292 if some unaffiliated legislators back the alliance. An earlier Indian Express report, published September 22–23, gave a different snapshot: BJP 256, SP 101, 36 additional MLAs from BJP allies, and two Jansatta Dal (Loktantrik) MLAs supporting the NDA. It used 36 MLAs per seat as shorthand and said the BJP-led side could claim eight seats while SP and Congress could secure two. That earlier estimate should not be mixed with the October 2 figures: vacancies alter the effective electoral college and the quota, and the newer 37-vote figure is attributed to Hindustan Times rather than independently recalculated from a final poll-day roll. What are the three reported scenarios?

These are configurations described in the October 2 Hindustan Times analysis, not a final candidate list. A settled slate could make one or more scenarios irrelevant.

Why does the tenth seat make the vote sensitive to numbers?
The 37-vote quota in the October 2 report is the working figure for this round, while the September 22–23 Indian Express account’s 36-vote shorthand belongs to an earlier strength snapshot. With nine seats represented in the regular term-end group and one already vacant, it is especially important not to treat the full 403-seat Assembly as the poll’s effective voting strength or to combine numbers from different dates.
On the latest reported baseline, seven NDA seats and two SP-Congress seats are the clearer claims; the tenth is where additional support or a candidate decision could change the outcome. The relevant uncertainties include whether NDA partners and unaffiliated MLAs support a BJP candidate, whether SP and Congress coordinate, and whether either side fields an extra candidate. Those are the October 2 report’s political variables, not evidence that any MLA has changed sides in 2026.
How does Rajya Sabha voting work?
MLAs elect Rajya Sabha members through proportional representation by the single transferable vote (STV), not by a simple plurality. The Election Commission explains that voters mark preferences and that later preferences may be transferred during counting if no candidate reaches the quota. The ECI’s election FAQ describes the system under Article 80(4).
In practical terms, an MLA marks candidate preferences on a ballot. The count uses first preferences toward the quota; where required, preferences can transfer under the STV process. The 37 figure in the October 2 report refers to first-preference votes per candidate, not a claim that every seat is decided by an ordinary first-past-the-post count.

What do cross-voting fears mean in this election?
Cross-voting is a concern about MLAs failing to vote as their party expects, or supporting another side’s candidate. The October 2 Hindustan Times report invokes the 2024 UP Rajya Sabha poll as precedent, naming SP MLAs it says aligned with BJP amid cross-voting allegations. That is historical context and an allegation, not a finding about the 2026 contest.

Party leaders’ focus on discipline and ballot oversight reflects the possibility of a contested vote; it does not establish that cross-voting has occurred this year.
