In the UK, a home video doorbell or security camera is generally outside data protection law when it records only your own private property. If it captures identifiable people beyond that boundary—on a pavement, a neighbour’s land or a shared landing—data protection duties can apply. That does not automatically make the recording unlawful, but you need a justified purpose and should minimise the intrusion.
When do UK home CCTV rules apply?
The key question is what the camera captures, not simply whether it is a doorbell or CCTV camera. The Information Commissioner’s Office (ICO) says the domestic exemption generally applies when a camera is confined to your private property. If it records identifiable people or their voices on neighbouring property, a public area or a communal space, data protection law applies. The government’s domestic CCTV guidance gives the same boundary-based distinction.
Capturing a small area outside your boundary is not automatically an offence. It does mean you should be able to explain why the capture is necessary and show that the security benefit outweighs the effect on other people’s privacy. The ICO says consent will rarely be required for home CCTV; that does not remove the need to justify and limit recording. See the ICO’s home CCTV guidance.

- Define the security purpose. Decide what risk the camera is meant to address and what area it genuinely needs to cover. Consider whether a less intrusive measure, such as improved lighting, could help.
- Point it at your property. Adjust the angle to avoid neighbours’ homes and gardens, pavements and shared spaces where possible. Use privacy zones, filters or masking if your device offers them and some out-of-boundary capture cannot be avoided.
- Choose recording settings carefully. Ask whether continuous recording is necessary or whether motion-triggered capture is sufficient. Disable audio unless you can identify and justify a specific need. The ICO considers audio more intrusive than video, particularly where private conversations may be recorded.
- Tell people about recording. Inform neighbours where appropriate and display a clear notice when recording takes place beyond your property. A sign is one transparency measure; it does not by itself make excessive or unjustified recording acceptable.
- Control access and retention. Secure the device and its app, keep software updated, limit who can view footage and delete recordings when they are no longer needed for the security purpose. UK data protection law does not set one universal number of days for keeping surveillance footage; the purpose determines how long it is necessary to retain.
- Keep the footage’s use limited. Do not upload identifiable clips to social media or repurpose them casually. GOV.UK says recordings should be used for the purpose the system was installed for and specifically warns against social-media sharing.
- Review the setup. Periodically check the camera’s field of view and settings to confirm it still captures only what is needed.
The government’s domestic CCTV guidance recommends minimising capture and considering privacy filters. The ICO’s surveillance data protection principles explain the related duties, including secure storage, limited access and regular deletion.

What to do if your camera records beyond your boundary
When data protection law applies, you should be ready to explain the purpose and scope of recording and take practical steps to reduce its impact. That includes limiting the images or audio captured, displaying appropriate notice, protecting footage, deleting it when no longer necessary and responding properly to requests from people who appear or can be heard in it.
If someone objects, consider their concern and whether you can change the camera angle, use masking or reduce recording. An objection does not automatically require you to move the camera, but the ICO says you should have a strong reason to continue collecting that person’s information after they object.

The Data (Use and Access) Act 2025 received Royal Assent on 19 June 2025. GOV.UK says most of its data protection and privacy provisions came into force on 5 February 2026, and the ICO says relevant guidance is being updated. Can you record audio on a video doorbell?
Audio can capture private conversations that people would not expect a security camera to record. The ICO says audio recording is generally more intrusive than video, and recording private or face-to-face conversations is unlikely to be justified in most circumstances. Keep audio off by default unless you can evidence a specific need, have considered less intrusive alternatives and make audio recording clear to people.

Some smart doorbells can stream live video, save or edit recordings, share footage and use facial recognition. The ICO’s smart doorbell guidance is written for commercial use, so it is not a household checklist. It does explain that facial recognition used to uniquely identify people is likely to involve special-category data and require additional protections.
What can you do if a neighbour’s camera points at your home?
- Ask the owner what the camera captures and why. A calm conversation may clear up whether it records your property or whether the angle is adjustable.
- Ask about privacy controls. The ICO suggests asking whether the owner can show a sample of the recording and whether privacy filters or blockers are in use.
- Make a request if you appear in footage. You can request a copy of footage in which you appear or can be heard, ask for deletion, or object to the use. In most cases, the owner should respond within one calendar month.
- Escalate if the concern remains. You can complain to the ICO. For an ongoing neighbour dispute, the ICO suggests informal resolution, contacting a landlord or housing officer where relevant, and mediation; legal action is a last resort. CCTV use alone is unlikely to be considered harassment without other misconduct.

Does a home CCTV sign make recording lawful?
No. A notice helps people understand that recording is taking place, but it does not replace a justified purpose, careful camera positioning, limited access, secure handling or appropriate deletion. If the camera only records your private property, the data protection duties described here may not apply; if it captures people beyond that boundary, notice is one part of your responsibilities.

The government says the Biometrics and Surveillance Camera Commissioner does not regulate domestic CCTV. The Surveillance Camera Code has statutory application to relevant authorities’ overt systems in public places in England and Wales; household operators are encouraged to adopt it voluntarily, rather than being legally required to comply with it as a domestic CCTV code.
