The New York Times disclosed on December 16, 2005, that the National Security Agency had been conducting a post-9/11 surveillance operation without the warrants normally associated with domestic intelligence collection. The story raised two connected questions: how far the government could go in monitoring communications, and when a newspaper should publish classified reporting that officials said could damage national security.
What the NSA wiretapping story revealed
Contemporary Times reporting, reproduced in the Pulitzer archive, said the operation began soon after the September 11, 2001 attacks. The initial collection described in follow-up reporting involved calls and email between the United States and Afghanistan. President George W. Bush later authorized a broader version.
“Warrantless wiretapping” and “domestic surveillance” are shorthand labels, not a description limited to conventional telephone calls made entirely inside the country. The reporting concerned international communications involving people in the United States. The National Security Archive’s retrospective summary also describes cooperation from telecommunications companies and some wholly domestic communications being intercepted accidentally. Classified aspects remain unavailable in the public record, so these accounts do not amount to a complete operational history.
Why the program became a legal and oversight dispute
The administration presented the surveillance as an urgent counterterrorism measure after 9/11. Critics questioned whether the executive branch could conduct the collection without the warrants and oversight associated with the Foreign Intelligence Surveillance Act (FISA), and raised statutory and constitutional concerns. The controversy centered on the relationship between presidential authority and FISA oversight; the available reporting does not establish that a court definitively resolved every legal issue.

These are competing arguments, not interchangeable descriptions of what the program did. The stated security purpose does not settle the legal question, and the existence of legal objections does not by itself establish the operation’s effectiveness or lack of value.
Why the New York Times held the story
The Times had known about the program for more than a year before publishing. In its next-day account, The Washington Post reported that administration officials urged the paper to withhold the story, arguing that disclosure could give terrorists clues and impair a security tool. The paper conducted additional reporting, while its own timing became part of the debate.

The Post also noted that the Times had not publicly explained what changed after the long delay and that the information was included in James Risen’s forthcoming book, State of War. Those details justify scrutiny of the newspaper’s process, but they do not prove that the book’s timing caused the decision to publish.

What later accounts add—and what they do not establish
The National Security Archive’s retrospective summary adds the telecom-cooperation and accidental domestic-interception details. Later reporting by Lawfare on a declassified inspectors-general report said secrecy hampered the program’s effectiveness and that personnel later struggled to identify specific attacks it had thwarted. That account is not proof the program had no value; it describes difficulty assessing its results and does not supply a complete public record.
Former AT&T technician Mark Klein later spoke publicly about his experience. In a Computerworld interview, he said: “I came to view the government with great suspicion like a lot of people back then and I still do.” The quotation conveys Klein’s view; it is not, on its own, evidence proving every technical detail of the surveillance system.
