The Supreme Court has given Bihar a final eight weeks to remove unauthorised structures and encroachments from the Ganga floodplain between Nauzar Ghat and Nurpur in Patna. The Court warned that failure to comply could lead to summons for senior state officials and further contempt proceedings.
What the Supreme Court ordered
In an order dated 28 September 2026, the Court gave the state “for one last time” eight weeks to carry out its directions to remove unauthorised structures and encroachments from the specified floodplain stretch. The Court had previously allowed six weeks on 21 July 2026. Read the 28 September order.
The order requires Bihar to submit a full compliance report at the next hearing and says no further time will be granted. It warns that, if the state does not comply, the Court may summon the Chief Secretary and four other authorities and may proceed further with contempt.
“We grant for one last time, eight weeks’ time period to comply with our directions, failing which, we shall have to summon the Chief Secretary of the State of Bihar and other 4 authorities before us and we may also proceed further with contempt.”

This is the Supreme Court’s wording in the order, not a statement attributed to an individual judge.
Where the removal directions apply
The specified area is the Ganga floodplain between Nauzar Ghat and Nurpur in Patna, Bihar. The order concerns that stretch; it should not be read as a finding about every property along the Ganga or every disputed parcel in Patna.
Why Bihar said work was delayed
On 28 September, Bihar’s Advocate General told the Court that the directions had been only partially complied with. He attributed the delay to a rise in the Ganga’s level after a natural calamity in Nepal, saying the area was submerged and removal work was impeded. The order records the state’s explanation; it does not independently establish the cause or describe current site conditions.
Can people who claim ownership make a representation?
Yes. Intervenors who say their structures are on their own land and outside the floodplain may make a representation to the competent authority. They must attach title documents and any sanctioned or authorized building permission. The order says a representation without those materials will not be considered.

Submitting documents is a route to have a claim considered; the order does not decide whether any particular claimant owns the land, establish a parcel boundary, or say that a representation automatically stops removal.
How the case reached this point
The dispute is part of Civil Appeal No. 3367 of 2020. In an earlier order dated 12 March 2026, the Supreme Court described the appeal as challenging the National Green Tribunal’s 30 June 2020 dismissal of an application about alleged Ganga floodplain encroachments in Patna. The NGT had dismissed the application for lacking particulars of the violations and violators.

The Supreme Court’s account also refers to state reporting and survey work, including a Patna district survey report and use of historical survey maps and revenue records. That procedural history does not prove that every survey step was completed or that the Court accepted a particular parcel boundary. Official Supreme Court case material.
