A state business court is a specialized forum for certain commercial disputes, but its structure, judges, appeal route, and fees depend on the state. There is no uniform national business-court system. If you are considering a filing or handling an active case, check the current statutes, court rules, and fee schedule for the jurisdiction where the case belongs.
What is a state business court?
“Business court” is an umbrella term for state-level arrangements that handle eligible commercial cases. A state may establish a dedicated court, create a specialized docket within its existing trial courts, or operate a pilot program. The label alone does not tell you which cases qualify, where they must be filed, or what procedures apply.
Texas: a statewide court organized into divisions
Texas Government Code Chapter 25A establishes a Business Court whose judicial district encompasses the state and provides for divisions, judges, case assignment, rules, and fees. The statute is the starting point for determining the court’s authority and procedures; the name “Business Court” does not by itself establish that a particular dispute is eligible.

Iowa: a statutory court after September 1, 2026
Iowa illustrates why it is important to check for changes over time. Under the Iowa Judicial Branch’s court information, cases commenced on or after September 1, 2026 are governed by Iowa Code sections 602.6801–602.6814, which establish the statutory Business Court. The original Business Specialty Court stopped accepting new cases on that date, while matters already pending there may continue.

Who are the business court judges?
There is no single national appointment or assignment system for business-court judges. Their roles and selection depend on the state’s statute, court structure, and local rules. Confirm whether the relevant court uses dedicated judges, judges assigned from existing trial courts, or another staffing arrangement.
For Iowa’s new statutory court, the Iowa Judicial Branch announced the appointment of Jeffrey Bert and David Nelmark as full-time judges, with six visiting judges appointed to assist as needed. That is Iowa’s arrangement, not a model that can be assumed to apply in other states.

Can you appeal a business court decision?
Yes, a business-court ruling may be subject to appeal, but the route and requirements are jurisdiction-specific. A secondary law review discussion reproduced in a 2024 Wisconsin Supreme Court filing describes the ordinary civil appeal route as common and direct appeals to a state’s highest court as an option in some states. That broad historical observation does not establish the current rule for any particular state.

- Which appellate court has jurisdiction and whether an intermediate appellate court is part of the route.
- The filing deadline and any required notice or record materials.
- Whether permission, certification, or another threshold step is required.
A specialized trial court does not, by itself, mean that an appeal goes directly to the state’s highest court or receives faster review.

A filing fee is only one possible litigation expense. Attorney time, expert work, discovery, and other court costs may also contribute to the total, and the cited materials do not quantify those costs.

What should you check before filing or responding?
- Identify the court and current governing law. Confirm whether the business court is a separate court, a specialized docket, or a pilot, and check the current statute and court rules.
- Confirm case eligibility and assignment. Review the court’s jurisdictional requirements and procedures for assigning or transferring a case; do not rely on the court’s name alone.
- Check the judge and case-management rules. Find out how judges are appointed or assigned and whether local procedures apply.
- Map the appeal route early. Locate the applicable appellate rules and deadlines, and determine whether permission or certification is required.
- Use the fee schedule for the actual procedural step. Check its effective date and whether the fee is for a complaint, first appearance, or acceptance into the business court after an earlier payment.
