In New York City, a rent-stabilized apartment generally gives tenants regulated renewal increases and the right to renew for one or two years. In a market-rate apartment, rent and lease terms are negotiated with the owner. The distinction affects rent and renewal rights, but an unregulated rental is not necessarily free of tenant protections.
How rent stabilization and market-rate rentals differ
“Market-rate” is commonly used to mean an unregulated rental. NYC guidance says market-rate rent and lease terms are negotiated between the owner and tenant; they are not set by the Rent Guidelines Board. Stabilized rents, by contrast, are subject to renewal rules and applicable Rent Guidelines Board orders.
| Issue | Rent-stabilized apartment | Market-rate or unregulated apartment |
|---|---|---|
| Rent increases | Renewal increases are governed by Rent Guidelines Board rules. Other lawful adjustments may also apply, so the guideline percentage alone may not explain every rent change. | No Rent Guidelines Board cap applies. Rent and terms are negotiated, subject to applicable laws and notice requirements. |
| Lease renewal | Generally, the tenant may choose a one- or two-year renewal. | There is no automatic rent-stabilization renewal right. Other protections, including Good Cause Eviction for some rentals, may apply. |
| How to check status | Review the lease and request the unit’s rent history from New York State DHCR. | DHCR does not regulate market-rate rent. Check separately whether other laws cover the home. |
| Other protections | Qualifying tenants may have succession rights, and eligible older adults or people with disabilities may qualify for a rent freeze. | Some homes may be covered by Good Cause Eviction, subject to statutory exceptions. |
These rules are specific to New York City and do not describe every rental in New York State or elsewhere. Protections depend on location, apartment, and circumstances.

For rent-stabilized leases beginning or renewing from October 1, 2026 through September 30, 2027, NYC guidance states the Rent Guidelines Board increase is 0% for both one- and two-year renewal terms. That percentage applies only to leases in this period. It does not establish the total lawful rent change in every case, because special lawful adjustments may also apply. See the NYC Rent Guidelines Board information and confirm the order that applies to your lease.

For market-rate rentals, there is no Rent Guidelines Board percentage cap. The owner and tenant negotiate rent and terms, while applicable law may impose notice requirements or other limits. NYC 311 summarizes the distinction: “Market rate apartment rental rates and lease terms are negotiated between the owner and tenant.” See NYC 311’s rent-increase guidance.
How do I know if my apartment is rent stabilized?
Do not rely only on a rental listing or a landlord’s label. Check the lease and request the apartment’s rent history from the New York State Division of Housing and Community Renewal (DHCR). NYC’s tenant guidance also directs renters to DHCR for help determining whether a home is regulated.
- Review your lease for rent-stabilization language and the terms of any renewal offer.
- Request the apartment’s rent history from DHCR and compare it with the rent and dates in your leases.
- If the history is unclear or the rent appears too high, ask DHCR to explain the record and consider an overcharge complaint where appropriate.
Building age, rent amount, or a listing alone cannot establish a unit’s status. DHCR records may need interpretation; raise inconsistencies with the agency rather than treating an unclear record as a definitive answer. Start with New York State tenant-protection guidance and NYC tenant resources.
Does market-rate mean the landlord can raise rent by any amount?
It means the Rent Guidelines Board does not set a renewal increase for the apartment. The parties negotiate rent and terms, subject to applicable law and required notices. Some unregulated rentals may also be covered by Good Cause Eviction, but coverage depends on the particular home and statutory exceptions. Check NYC’s Good Cause Eviction eligibility guidance rather than assuming either that the law applies or that it does not.

Unregulated status also does not remove protections that apply broadly to tenants, including required notices and the housing-court process. If you face a rent increase or eviction threat, check the rules for your home and seek qualified tenant legal help when needed.

Beyond regulated renewal increases and renewal rights, qualifying tenants may have succession rights for certain family or nontraditional family members. Eligible older adults and people with disabilities may also qualify for rent-freeze programs. These benefits have specific eligibility requirements; consult NYC tenant resources or DHCR before relying on them.

Rent stabilization covers a substantial share of the city’s rentals: NYC’s Mayor’s Office to Protect Tenants describes almost half of rental apartments as stabilized. Separately, the Rent Guidelines Board’s 2023 NYC Housing and Vacancy Survey estimated approximately 960,600 stabilized apartments. The latter figure is an approximate count for that survey year, not a current census.

Where to get help if the records or rent do not add up
- Request the rent history from DHCR and ask the agency to explain inconsistencies.
- Consider filing a rent-overcharge complaint if the records and rent suggest one may be warranted.
- For a renewal, increase, or eviction dispute, consult qualified tenant legal assistance about the facts and applicable rules.
