Under the Open Source Initiative’s Open Source AI Definition (OSAID) v1.0, an AI system is open source only when the necessary code, data information, and parameters are available on terms that allow people to use, study, modify, and share it. The terms overlap, but they are not interchangeable under OSI’s definition.
What does “open-weight” mean?
An AI model’s weights are the learned parameters that shape its behavior. Calling a release open-weight indicates that those parameters can be obtained under the distributor’s stated terms. The label alone does not say what else is available, or what uses and redistribution the terms permit.
The separate Open Weight Definition v0.3 sets criteria for access to usable weights, permission to create derived works, and nondiscrimination by person or field of endeavor. Its introduction expressly does not require distribution of the source used to produce the weights, such as training data. That definition is distinct from OSI’s OSAID; the two labels should not be treated as equivalent. Open Weight Definition
What does “open-source AI” mean under OSI?
OSI’s Open Source AI Definition v1.0 focuses on whether people have the freedoms to use, study, modify, and share an AI system, and whether the release supplies the materials needed to exercise them. Those materials include code, data information, and parameters. OSI’s FAQ explains that the preferred form for modifying a machine-learning system may include data-processing software, training software, training results such as parameters, and all training data that can legally be shared. OSI says the definition applies whether a release is described as an AI system, model, or weights and parameters. In other words, the name attached to a release does not decide the question: assess the artifacts and legal terms as a whole.
How the two labels differ in practice

A downloadable weights file, then, is evidence of weight availability—not by itself proof that a model meets OSI’s open-source AI definition. Conversely, a developer’s “open source” description is not a substitute for checking the complete release and its terms.

Examples—and what their labels do not prove
OSI’s validation examples
OSI’s FAQ says volunteers in its OSAID validation phase found Pythia (EleutherAI), OLMo (AI2), Amber and CrystalCoder (LLM360), and T5 (Google) passed. It lists Llama 2 (Meta), Grok (X), Phi-2 (Microsoft), and Mixtral (Mistral) among systems analyzed that did not pass because required components were missing and/or legal agreements were incompatible. OSI describes these as validation outcomes, not certifications. They concern the named systems, not every release from those organizations or later versions. OSI’s OSAID FAQ
OpenAI’s gpt-oss models
OpenAI describes gpt-oss-120b and gpt-oss-20b as open-weight models. Its documentation says they can run on infrastructure users control or through hosting providers, under Apache 2.0 subject to the gpt-oss usage policy. They are not served through the OpenAI API or ChatGPT. The documentation names vLLM, Ollama, and llama.cpp as compatible inference stacks. These details illustrate deployment options for those models; the open-weight label alone does not establish that the complete release meets OSAID. OpenAI’s gpt-oss announcement and documentation

Meta’s Llama 4 license
Meta’s Llama 4 Community License, effective April 5, 2025, grants limited royalty-free rights and sets conditions for redistribution and use, including an acceptable-use policy. It also requires a separate license request for a licensee above the stated threshold of 700 million monthly active users. This is an example of why available weights do not settle what a user may do; these conditions apply to that license and should not be generalized to other Llama versions or providers. Can you use an open-weight model commercially?
Do not infer commercial permission from the words open-weight. Check the exact license and policies for the model version you plan to use, along with any conditions on commercial use, redistribution, acceptable use, or access. A model may make weights available while its terms impose conditions; those terms, not the label alone, determine the permitted use. For instance, OpenAI’s gpt-oss documentation specifies Apache 2.0 subject to its usage policy, while Meta’s Llama 4 Community License contains its own conditions.

What to check before choosing a model
- Identify the exact release. Record the model name and version; do not assume that terms for an earlier model apply to a newer one.
- Inventory what is actually provided. Check for weights, inference code, training code, data information, and documentation. If your goal is to study or modify how the system was built, weights alone may not provide what you need.
- Read the governing terms. Look for permissions and restrictions on use, modification, redistribution, and commercial activity, plus any separate acceptable-use policy or access condition.
- Apply the standard you mean. If you mean “open source” according to OSI, compare the full release and its terms with OSAID v1.0 rather than relying on the developer’s label.
- Assess deployment needs separately. A license permitting local use does not ensure your hardware, software, or expertise is sufficient to run the model.
What does local deployment require?
Requirements depend on the specific model, its implementation, and the inference setup. OpenAI’s documentation says its gpt-oss-safeguard-120b model is designed to fit on one 80 GB GPU. That is a specification for this named model, not a general minimum for open-weight AI. The gpt-oss documentation also lists vLLM, Ollama, and llama.cpp as compatible inference stacks for the gpt-oss models. OpenAI’s gpt-oss documentation
Before attempting a local run, consult the model’s own deployment documentation for memory and software requirements. A hosted inference option may avoid managing the hardware yourself, but it means running through a provider rather than solely on infrastructure you control.

Why the terminology is confusing
In AI discussions, “open source” is sometimes used loosely to mean that weights can be downloaded. OSI’s OSAID gives the term a more specific test: the freedoms to use, study, modify, and share, supported by the necessary code, data information, and parameters under suitable terms. The Open Weight Definition is a separate framework centered on weights and their distribution terms. When comparing claims, state which definition you are using and inspect the release itself.
Licenses and model releases can change. Verify the exact version’s current terms before relying on a model for a project; OSI’s definition is OSI’s published standard, not a universal legal ruling or certification.
