MSRP is a manufacturer’s suggested retail price; MAP is a policy about the minimum price a retailer may advertise. They describe different things. MSRP is a suggested price, while a MAP policy concerns public price displays or advertising. Neither term alone tells you the final amount a customer will pay: the retailer’s advertised price and transaction price can differ, subject to the policy’s wording and applicable law.

What does MSRP mean in practice?
MSRP stands for Manufacturer Suggested Retail Price. The word “suggested” matters. The FTC’s Manufacturer-imposed Requirements guidance says a dealer does not have to charge the MSRP: it may charge MSRP or another price if it makes that pricing decision independently.
That does not mean a manufacturer must continue working with every distributor. The same FTC guidance says a manufacturer may choose not to use distributors that do not adhere to its MSRP. That is a separate question from whether the MSRP itself legally compels a retailer to charge that amount.
What does a MAP policy cover?
MAP usually means Minimum Advertised Price. A MAP policy concerns the price a retailer advertises, rather than automatically setting the amount charged at checkout. For example, a policy might restrict a price shown in a public advertisement while leaving open whether a lower price can be offered through another permitted process or in the transaction itself. The policy’s actual language determines what it covers.

So, when someone asks whether a retailer can “sell below MAP,” the label alone is not enough to answer. Check whether the policy applies to the specific display or communication in question, what remedies it describes, and what law applies. The FTC-hosted 2016 discussion paper by Asker and Bar-Isaac also distinguishes restrictions on advertised prices from the retailer’s selling price; it is economic analysis, not binding legal guidance.
MAP is not the same as resale price maintenance
Resale price maintenance (RPM) concerns a supplier’s effort to control the price a retailer charges in a sale. A restriction on advertised prices is not automatically the same thing: the advertisement and the transaction are separate. The FTC and the FTC-hosted discussion paper distinguish these concepts, so avoid treating “MAP” and “RPM” as interchangeable labels.

Nor does calling a rule “MAP” settle its legal status. The substance, reach, implementation, and effect of the policy matter; so do the jurisdiction and the facts.
Is a MAP policy legal?
There is no safe blanket answer that every MAP policy is legal or illegal. The FTC’s Manufacturer-imposed Requirements guidance says that, following the Supreme Court’s 2007 decision, manufacturer-imposed vertical price programs are evaluated under the federal rule-of-reason approach. It also cautions that some state antitrust laws and international authorities treat minimum-price rules more strictly.

The FTC’s historical prerecorded-music example illustrates why a policy’s scope can matter. The agency described policies that restricted discounts in retailer-funded advertising and in-store advertising, and under which one violation could lead to forfeiture of funds across stores for as long as 90 days. The FTC treated the breadth of those policies as unreasonable in that context. This example is not a universal legal test for MAP programs.

What price does the customer actually pay?
MSRP, MAP, the advertised price, and the checkout or transaction price are not necessarily identical. For ordinary MAP questions, do not infer the final sale price solely from the advertised-price policy; check the actual policy and the price presented to the customer.
Automobile advertising has a distinct FTC transparency issue. The FTC’s Automobile Industry Pricing Transparency: FAQs says advertised vehicle prices generally should reflect the price a consumer can actually pay, excluding only charges the government requires the consumer to pay. The FTC’s September 2026 summary, FTC Publishes Price Transparency FAQs for Auto Dealers, covers that auto guidance. It should not be generalized into a definition of MAP for other product categories.

Do not confuse MAP with competitor price fixing
A manufacturer’s policy for its own retailers is a different issue from competitors agreeing with one another on prices. The FTC’s Price Fixing guidance discusses agreements among competitors; the fact that a business uses or encounters a MAP policy does not by itself establish such an agreement. Keep the parties and conduct distinct when describing a pricing concern.
