Not automatically. Wanting to watch a video privately does not by itself make downloading it lawful. The answer depends on your country, the video’s copyright and permissions, the platform’s rules, and whether your method bypasses technical controls.
Why personal use alone does not settle the question
Downloading creates a copy. If a video is copyrighted and you copy it without authorization, that can raise a copyright issue even if you keep the file to yourself. In the United States, the Copyright Office explains that unauthorized downloading may infringe the copyright owner’s reproduction rights; sharing or reposting can raise additional issues. Whether a particular work is protected and whether a copy was authorized depend on the facts.
Three separate checks matter: copyright law, the platform’s terms, and any rules against bypassing technical access controls. Passing one check does not automatically pass the others. For example, a platform feature may authorize offline viewing under its terms, while a third-party method may violate those terms even if the video is otherwise available to watch.

Is downloading a video illegal if you do not share it?
Not sharing may matter to the facts, but it is not a blanket defense. In the United States, fair use is a case-specific analysis under 17 U.S.C. §107, not an automatic allowance for private copies. Courts consider the purpose and character of the use, the nature of the work, the amount and substantiality copied, and the effect on the potential market or value of the work. The statute lists purposes such as criticism, comment, news reporting, teaching, scholarship, and research, but using one of those labels does not by itself make a copy fair.

The U.S. Copyright Office says there is no fixed number of seconds, percentage, or other amount that automatically qualifies as fair use. A complete copy for later personal viewing is not automatically lawful merely because it is not distributed; the circumstances still matter.
Can I download YouTube videos for personal use?
YouTube’s rules and copyright law are related but distinct. YouTube says creators generally own the copyright in their original videos and decide who else may use or distribute them. Its copyright guidance identifies permission, applicable copyright exceptions, Creative Commons terms, and public-domain status as possible bases for lawful use, while noting that rules vary by country.

The UK version of YouTube’s Terms of Service surfaced as effective March 17, 2025. It restricts downloading except where the service specifically permits it, YouTube and any applicable rights holders have authorized it in writing, or applicable law permits it. The same terms restrict interference with features that prevent or limit copying. The personal, non-commercial viewing language in those terms should not be read on its own as permission to download.
Use YouTube’s own options when available
- YouTube Help says offline watching in the YouTube app is available with YouTube Premium. Availability and eligibility can vary by content, market, and current service terms; this is app-based offline access, not a general right to extract an unrestricted video file.
- YouTube Help says you can download videos you uploaded through YouTube Studio, but not other users’ videos through that feature.
Use the official download or offline controls shown for your account and video. Do not assume that a third-party downloader is permitted simply because it produces a file.

What changes if a technical control is bypassed?
In the United States, the Copyright Office describes Section 1201 as prohibiting circumvention of technological measures used to control access to copyrighted works. Its examples include decrypting a protected DVD and bypassing a password control to access a subscription video-streaming service. This is a separate legal question from whether your intended viewing is private or whether a copyright exception might apply. The U.S. rule should not be assumed to describe the law in every country.

Unauthorized copying of a protected video may implicate the owner’s exclusive rights. Fair use is assessed using the four statutory factors, not a personal-use rule or a fixed safe percentage. Circumventing an access control may raise a separate Section 1201 issue.

Canada
Canada’s Copyright Act provides a limited private-purpose reproduction provision in section 29.22, subject to conditions. Among them, the source copy must not be infringing and must have been legally obtained within the provision’s limits; the person must not circumvent a technological protection measure or give away the reproduction, and the copy must be used only for private purposes. Section 29.23 separately addresses recording a broadcast for later viewing, but excludes works received through an on-demand service. These provisions do not establish that every privately intended download of an online video is allowed.

The current UK position is not established here. A historical version of the Copyright, Designs and Patents Act surfaced in a page dated November 3, 2021, which is not enough to establish today’s law. Check current local law rather than relying on that old text. Other countries may have different copyright exceptions and anti-circumvention rules.

A practical check before saving a video
- Identify the country whose law applies. Do not assume the U.S. fair-use framework applies elsewhere.
- Check who controls the video and what permission exists. Look for rights-holder permission, an applicable open license, public-domain status, or an official download feature. Do not infer permission merely because a video can be streamed.
- Check the platform’s terms and the specific feature. Confirm that the service allows the kind of download you intend, rather than relying on a general statement that personal viewing is permitted.
- Consider the method. If saving would bypass a password, encryption, or another access control, that can create a separate legal issue.
- Consider what you will do with the copy. Keeping it private, sharing it, reposting it, using it commercially, or incorporating it into another work are not interchangeable uses and may have different consequences.
