In the United States, owning a physical game does not automatically authorize downloading its ROM from someone else. A ROM may contain copyrighted game software or other protected content; downloading or sharing an unauthorized copy can infringe copyright. Making an archival copy, using an emulator, and bypassing copy protection raise separate questions, and the law does not provide a blanket permission for every ROM-related activity.
What does “legal” depend on?
There is no single answer for every ROM. The relevant facts can include who authorized the file, how you obtained or made it, whether you share it, whether the game is protected by an access control, your purpose, and which country’s law applies. This article covers U.S. federal law; other countries may have different rules, and state-law or contract issues can require separate analysis.
The U.S. Copyright Office advises treating original works fixed in a computer file as protected unless there is clear information to the contrary. A game’s age, its absence from current stores, or a website’s claim that a download is a “backup” does not by itself establish permission. The Office’s Fair Use FAQ puts the general rule this way: “Uploading or downloading works protected by copyright without the authority of the copyright owner is an infringement of the copyright owner’s exclusive rights of reproduction and/or distribution.”

Is it legal to download ROMs if I own the game?
Not automatically. Owning a cartridge or disc is not the same as having authorization to download another copy from an unrelated website. The Copyright Office’s general guidance concerns the authority to make or distribute a copy; it does not create a download license just because you own the physical game.

A file from an official store or another rights-holder-authorized source is different from a file offered without established authorization. If a website labels an unauthorized download a “backup,” that label is not proof that the copyright owner approved it. The status of a particular file depends on its source and authorization.
Can I make a ROM from my own cartridge?
U.S. Copyright Act Section 117 provides a limited archival-copy privilege for a computer program. The Copyright Office describes the conditions as requiring that the person making the copy lawfully own the program copy and make the additional copy solely for archival purposes. If the original is sold, given away, or otherwise transferred, the archival copy must also be destroyed or transferred with it. The Office advises checking the software’s terms of sale or license.
This is not a general rule that cartridge ownership makes any ROM acquisition or use lawful. Section 117’s guidance addresses a qualifying archival copy made by the lawful owner; it does not establish permission to download a copy supplied by someone else. Nor does it settle whether a particular game copy, copying method, or use satisfies the requirements.

There is also a separate issue if making the copy requires bypassing an access control. Section 117’s archival-copy rule does not itself answer whether that circumvention is allowed under the DMCA. The Copyright Office also says the Copyright Act has no equivalent general statutory backup authorization for other kinds of works, such as music or films, even when distributed digitally.
Is playing ROMs on an emulator legal?
An emulator program, a ROM file, and the method used to obtain or run that file are distinct things. The official material reviewed here does not establish a general rule that every emulator is unlawful or that every use of one is lawful. The Copyright Office’s 2024 recommendation said that “the record on the use of emulation technologies is inconsistent and incomplete and the technologies are not addressed in the exemption text.”
That means the current video-game exemptions should not be presented as a general emulator permission or ban. Whether a particular setup is lawful can depend on the ROM’s authorization, how the copy was obtained, whether access controls were circumvented, and the applicable jurisdiction.

Can I share a ROM with a friend?
Sharing raises a distribution question separate from merely possessing or playing a file. Uploading or sending a protected ROM without the copyright owner’s authority can implicate the owner’s distribution right, even if you own the physical game yourself. Do not assume that a private transfer is authorized simply because it is limited to one friend.

Not as a general rule. DMCA Section 1201 generally prohibits circumventing technological measures that control access to copyrighted works. Congress directs the Librarian of Congress to consider limited, temporary exemptions through a rulemaking process; a preservation interest alone does not establish that an exemption applies.
What the current video-game exemptions cover
The 2024 regulation in 37 C.F.R. § 201.40 contains defined exceptions, not an all-purpose right to obtain or share old games. Among the covered circumstances are:

- Lawful users of complete games may circumvent when a necessary external authentication server has ceased operation, for personal local gameplay that restores access.
- Eligible libraries, archives, and museums have certain preservation permissions subject to institutional, noncommercial, and access limits.
- A separate preservation provision covers complete games no longer reasonably available commercially, but is limited to eligible institutions and their premises.
These conditions do not give every individual a general right to download an old game or bypass protection to play it. The Copyright Office initiated the tenth triennial Section 1201 proceeding for the 2027 cycle. Its 2026 page says renewed exemptions, if renewed, would run from October 2027 through October 2030; the 2024 exemption text is the current text as of October 4, 2026.

Copyright infringement can expose a person to legal claims. The Copyright Office’s Fair Use FAQ lists possible statutory damages of up to $30,000 per work and up to $150,000 per work for proven willful infringement. These are statutory-damages ceilings, not automatic penalties, predictions about a particular case, or evidence that such awards are common in ROM disputes.
