No—fixed-odds esports betting offered to people in Brazil is prohibited under Provisional Measure 1,394/2026, as of October 3, 2026. The measure covers online-game events as well as real sports-themed events, and also reaches offers from operators based abroad to people located in Brazil. It supersedes the earlier system under which authorized operators could offer fixed-odds bets.
What Brazil’s current rule prohibits
Provisional Measure 1,394/2026 prohibits the exploitation, offer, intermediation and advertising of fixed-odds betting lotteries throughout Brazil, whether physical or online. Article 1 expressly includes bets on online-game events, the category relevant to esports betting, and says the prohibition applies when an operator based abroad offers bets to someone located in Brazil. The Ministry of Finance repeats the prohibition on its fixed-odds overview page.
This answer is specifically about fixed-odds betting lotteries. The measure’s stated scope should not be stretched into a conclusion about every activity that might be described as betting or gaming.
The measure is provisional, so its status may change through amendment, review or expiry. This article reflects the rule in force in the official sources checked on October 3, 2026.

How the rule changed from the earlier authorization system
Law 14,790/2023 established a fixed-odds framework building on Law 13,756/2018. Under the former system, operators needed prior authorization, and the Ministry of Finance said only operators authorized by its Secretariat of Prizes and Betting (SPA) could operate nationally from January 1, 2025. Authorized sites used the “.bet.br” domain. That history does not make a current fixed-odds offer lawful: the later provisional measure prohibits the activity and sets a transition out of the former authorizations.

The prior rules do not settle whether any particular esports tournament qualified as a “real sports-themed event.” Brazil’s Electronic Games Industry Law, Law 14,852/2024, defines electronic games and excludes lotteries and games involving bets from that law’s definition; that distinction is not a ruling that all esports events either did or did not meet the former sports-event test.

What happens to existing accounts and unsettled bets
The measure establishes transition duties for operators. Deadlines below run from the measure’s publication; they are not dates calculated here.

- Ten days after publication: operators must make their betting websites and apps unavailable. An open bet whose result has not been determined by that cutoff is void, and the full amount staked must be returned. The measure preserves payment of prizes for bets settled by the cutoff.
- From publication: new funds may not enter bettors’ transaction accounts, subject to a narrow exception for specified financial assets already held and used only to meet transition obligations.
- Thirty days after publication: existing permissions and authorizations under Law 14,790/2023 end. The measure also bars new fixed-odds concessions, permissions or authorizations from its publication date.
- During the transition: operators must make sufficient funds available for refunds, voided stakes and winnings.
If you have an old balance or unsettled wager, use the operator’s official communication channel and keep account statements, transaction records and relevant messages. The transition provisions describe operator payment duties; they do not, by themselves, resolve the outcome of every individual dispute.

Risks fans should keep in mind
A familiar site or old license is not current permission
Do not treat a historical Brazilian authorization, a “.bet.br” address or the availability of a foreign site as proof that it may currently offer fixed-odds bets. The Ministry’s operator register and fixed-odds information must be read in light of the later prohibition.
Do not infer a personal penalty that the measure does not state
The provisions reviewed prohibit operation, offering, intermediation and advertising, and set operator transition duties. They do not specify a separate criminal or civil penalty for a fan merely for placing a bet. That is not a guarantee about every possible consequence under other laws; individual liability questions are not resolved by the cited provisions.

Older responsible-gambling rules do not mean betting remains available
The Ministry identifies Portaria SPA/MF 1,231/2024, as amended, as the former regime’s responsible-gambling and marketing regulation. Those rules should not be read as preserving permission to make fixed-odds bets after the prohibition.
