You cannot guarantee that recorded bhajans will be claim-free on YouTube Live. India’s Copyright Act includes a limited exception for music used in the course of a bona fide religious ceremony, but that wording does not automatically clear every devotional livestream, commercial recording or archived replay. The practical way to reduce risk is to secure permission for the exact recording and online use, ask the relevant rights owner to allowlist your channel in Content ID, and prepare for a possible interruption or later claim.
Does India’s religious-ceremony exception cover a YouTube Live bhajan stream?
Section 52(1)(za) of the Copyright Act, 1957 describes an exception for performing a musical work, or communicating a musical work or sound recording to the public, in the course of a bona fide religious ceremony. The Copyright Office’s exceptions page, last updated 16 July 2026, sets out that statutory wording: Copyright Office: Exceptions to infringement under the Copyright Act.
The phrase “in the course of” matters. The statutory text does not itself establish that every online transmission qualifies, that a devotional programme is necessarily a bona fide religious ceremony, or that an archived replay may remain online indefinitely. The reviewed official materials do not resolve those specific applications. Do not treat the label “religious ceremony” as an automatic clearance for a YouTube stream or its replay.

A YouTube Content ID claim is a platform action, not a final court ruling about whether a particular use is lawful. YouTube says it does not decide copyright ownership disputes. The legal question and the platform’s automated detection process are separate.

Why a stream can still be interrupted or claimed
YouTube says all live streams are scanned for matches to third-party content, including another live broadcast. If a match is detected, YouTube may replace the stream with a placeholder image and warn the streamer to stop using the material. If it remains, the stream may be interrupted or terminated. A copyright strike can also end a live stream. See YouTube Help: Copyright issues with live streams.
Even if the live broadcast finishes without interruption, an archived replay is not thereby cleared. YouTube says Content ID claims are made after a live stream is complete if the creator archives it. A claim may therefore arrive after the event.

YouTube recommends that creators who have licensed third-party content ask the content owner to add their channel to the Content ID allowlist. YouTube warns that a licensed stream can still be interrupted without allowlisting, including when the licence limits the permitted territories. Allowlisting helps reduce platform-detection risk; it is not a legal licence and does not guarantee that no claim or strike will occur.

A bhajan can involve more than one set of rights. YouTube explains that a song may involve rights in the underlying composition and in the particular master recording. Record labels commonly control master-use rights, while publishers and collecting societies may handle composition rights and public-performance licensing. An old devotional composition does not automatically make a modern recording free to use. Likewise, permission from a singer, performer or devotional group should not be assumed to cover a commercially released recording or every right in the composition. Identify the exact track and recording, then establish who controls each relevant right.
Reduce the risk before going live
- Identify the exact recording. Record the track title, performer, release and version. Do not rely on “it is a bhajan” or “the song is traditional” as proof that the recording is cleared.
- Get written permission for the intended use. Ask the relevant rights holders to confirm that permission covers the specific sound recording and composition rights, live transmission on YouTube, the territories where viewers may watch, and the period of use. If you want to keep the replay, ask explicitly for archive and continued availability too.
- Request Content ID allowlisting. Ask the rights owner or its administrator to add your YouTube channel to the allowlist before the event. Keep the written permission and confirmation that the channel was allowlisted. A licence alone may not prevent automated interruption.
- Choose what happens to the replay. If an archive is unnecessary, decide whether to disable it. If you need the replay, ensure the permission covers it and be prepared for a post-stream Content ID claim.
- Prepare a fallback. Keep an alternative track that you have cleared, or be ready to stop playback if YouTube detects third-party content. Do not assume the stream will continue simply because the event is religious or the recording has been used before.
These measures reduce risk; they do not guarantee a claim-free stream. For a specific disputed use or uncertainty about whether an event qualifies under Indian law, seek advice from an India-qualified copyright lawyer.

Choose an approach based on the rights and replay you need

Safer-use options are not guarantees
YouTube lists permission, terms-compliant Creative Commons material, copyright exceptions such as fair dealing, public-domain works, and YouTube Audio Library or Creator Music as possible approaches to using music. It explicitly warns that none guarantees avoiding a copyright issue such as a Content ID claim or strike.
