To run a timed charity giveaway fairly, publish complete rules before entries open, make entry free, state the exact closing time and time zone, and use the selection and prize-claim process you announced. Keep the fundraiser and the giveaway distinct: explain where donations go, and do not make a donation necessary for entry or improve a viewer’s odds for donating in a US sweepstakes-style random drawing.
This guide focuses on US federal guidance and platform rules. State and local requirements vary, and the rules outside the United States are not covered here.
What should you decide before announcing the giveaway?
First settle the fundraiser and promotion mechanics. A donation appeal raises money for a beneficiary; a giveaway awards a prize under stated eligibility and selection rules. One event can include both, but viewers should be able to understand each part separately.
Confirm the beneficiary and your authority to fundraise
Name the intended charity and confirm in writing whether you are authorized to fundraise on its behalf. The IRS explains that when an outside organizer conducts a fundraising event, a qualified charity should clearly authorize that organizer as its agent if donors are to document gifts as contributions to the qualified charity. Verify the charity’s status where relevant and agree how it will account for funds received.

Choose the entry format honestly
Decide whether the winner will be selected by chance, judged for skill, or chosen by another disclosed method. Do not describe a random drawing as a skill contest to disguise how it works. The legal treatment can depend on the actual mechanics, prize, organizer, and entrant locations; raffles and lotteries are commonly regulated by state and local law.
For a US sweepstakes-style random drawing, do not require a purchase or donation to enter, and do not give donors extra chances or better odds. The FTC says purchase-required sweepstakes are illegal in the United States. A different raffle or chance-based structure may have additional requirements, so get advice specific to the places involved before using one.

Check where you and entrants are located
Before soliciting donations or accepting entries, check applicable state and local charitable-solicitation, contest, raffle, and gaming requirements. The IRS notes that many states require charities to register before soliciting residents and may require periodic financial reporting; local governments may impose additional obligations. If viewers can enter from outside the United States, check those jurisdictions separately rather than assuming US rules settle the question.

Write and publish official rules before accepting entries. Use plain language and make the entry route, deadline, eligibility, prize, selection, and claim process easy to find. On YouTube, contest rules must comply with applicable law and Community Guidelines, include required disclosures and a privacy notice, say YouTube is not a sponsor, and be followed when selecting and awarding the prize.

Include the practical details entrants need
- Organizer and beneficiary: Identify who runs the giveaway and which charity is intended to benefit.
- Eligibility: State who may enter, any age or location restrictions, and how eligibility will be checked.
- Entry method: Explain exactly how to enter, when entries open, and whether there is a free alternative entry route. For a US sweepstakes-style drawing, entry must not require a donation or purchase.
- Timing: Give the opening and closing date, exact time, and time zone. Say whether the deadline is based on a displayed stream countdown or another clock reference.
- Prize: Describe what is awarded, including material restrictions or delivery limits, and any number of prizes.
- Selection: Explain whether the winner is drawn randomly or selected by stated judging criteria, when selection occurs, and how the result will be recorded.
- Notification and claim: State how and when the potential winner will be contacted, the response deadline, eligibility verification, and what happens if the person does not claim the prize.
- Privacy: Explain what entrant information you collect, why you need it, how it will be used or shared, and any choices entrants have.
- Platform disclosures: Include YouTube’s required contest disclosures, including that YouTube is not a sponsor, and link to YouTube’s Community Guidelines as required by its contest rules.
Once entry opens, do not change the prize, eligibility, timing, or selection method unless the published rules explain a permitted change and you have checked that it is lawful. YouTube requires organizers to conduct contests and award prizes as their official rules state.
Can people enter by donating?
For a US sweepstakes-style random drawing, keep donating entirely separate from entry and odds. Make the no-purchase entry route genuine and accessible, not hidden behind a donation page or burdensome extra steps. If you are considering a raffle or another chance-based promotion, do not assume that calling it a fundraiser makes it permissible; state and local rules may apply, and the specific structure needs jurisdiction-specific review.

Make the separation visible both in the written rules and on stream. For example: “Donations support [charity] and do not enter you in the giveaway or change your chances. To enter, use [free entry method] before [deadline and time zone].” Adapt the wording to match the actual rules and donation route.
Where does the donation money go?
Before asking viewers to give, tell them plainly what happens from payment to charity receipt. The FTC’s online giving-portal guidance, dated June 2018, emphasizes clear, prominent disclosures about the recipient, fees, timing, and information sharing. Put the key facts next to the donation link and before a donor submits payment.

Compare donation routes on these points
- Recipient and intermediary: Identify who takes the payment first and whether that is the charity or a fundraising platform.
- Fees and net proceeds: Disclose any fee or percentage withheld and, where known, what amount is expected to reach the charity.
- Transfer timing and failure handling: Say when the charity is expected to receive the funds and what happens if a transfer is delayed or fails.
- Donor information: Explain whether donor details go to the charity, the organizer, or another party, and what choice the donor has.
- Authorization and accounting: Confirm the charity’s authorization and how the funds will be reconciled and reported.
Do not imply that the charity receives money directly if a portal or intermediary handles it first. When reporting the total after the event, distinguish donations collected from fees deducted and amounts that are still awaiting transfer.

Use one time reference throughout the event and follow the deadline in the rules. A visible timer can help viewers follow along, but it is an operational aid, not a substitute for an exact written deadline and time zone.
- Choose the clock: Decide which clock or countdown will define the close, and check it before the stream.
- Write a precise deadline: Publish the date, time, and time zone, plus the entry channel and whether submissions arriving at the stated instant count.
- Display and read it aloud: Put the same deadline and free entry route in a pinned message or on-screen card, and announce them during the stream.
- Close entries as stated: Stop accepting entries at the published moment. Do not extend the window selectively or make exceptions that conflict with the rules.
- Preserve the record: Keep the entry record and selection result so you can resolve questions about timing or eligibility.
What should happen during and after the stream?
During the stream
- State the beneficiary, donation route, entry method, start and end times with time zone, and no-purchase entry option before inviting participation.
- Keep the written instructions visible in a pinned message or on-screen card; correct any mismatch between what is displayed and the official rules before entries open.
- Use the disclosed selection method, protect entrant data, and do not change eligibility or prize terms after entries open.
- If fundraising on Twitch is paid for by a charity or corporate partner, Twitch’s branded-content guidance says to use its branded-content tool. Its guidance distinguishes this from independent charity fundraising, which it says does not require the tool; verify Twitch’s current policy before the event.
After the stream
- Contact the selected entrant by the method in the rules, confirm eligibility, and arrange delivery within the stated schedule.
- Report the fundraiser total accurately, showing any fees or amounts still pending transfer rather than presenting them as already received by the charity.
- Retain the published rules, charity authorization, donation-flow details, entry and selection records, and prize-fulfillment record for follow-up or disputes.
Common problems and how to avoid them
- Viewers think a donation buys an entry: Separate the donation appeal from the entry instructions, state the free entry route plainly, and do not increase odds for donors in a US sweepstakes-style drawing.
- The charity receives less or later than viewers expect: Disclose the intermediary, fees, transfer schedule, and failure handling before donations are made; report pending transfers separately afterward.
- Viewers dispute the deadline: Publish the time zone and precise closing time, use the same clock reference on screen and in the rules, and retain the entry record.
- A winner cannot be reached or does not claim the prize: Set a response deadline and next step in the rules before entries open, then follow that process consistently.
- Entrant information is collected without a clear purpose: Ask only for information needed to administer the giveaway and explain its use and sharing in the privacy notice.
- The promotion reaches places with different rules: Restrict eligibility clearly or obtain jurisdiction-specific advice for the locations where you solicit and accept entrants.
