You can request federal body-camera footage through the Freedom of Information Act (FOIA), but a request does not guarantee that footage exists, is still retained, or can be released in full. Start by identifying the federal agency or component that controls the recording, then describe the incident and records clearly enough to support a search. The agency may release the video, redact portions, withhold it under a FOIA exemption, or find no responsive record.

Identify the agency that controls the recording

Federal agencies process their own records, and Department of Justice (DOJ) components handle their own records. Send the request to the agency or component most likely to have the footage; DOJ advises that directing a request to the likely component can produce the quickest response. If you do not know which DOJ component holds a record, DOJ’s Mail Referral Unit can forward a request. See DOJ request guidance and FOIA.gov’s FAQ.

Before filing, check the agency’s FOIA page and reading room for records already available. FOIA.gov provides agency request information and public-record resources: FOIA.gov. If several federal agencies took part in the incident, consider submitting a separate request to each likely custodian; one agency’s search does not automatically cover another’s records.

Describe the records so the agency can search for them

FOIA provides access to existing agency records. It does not require an agency to create a record, answer questions, conduct research, or compile new information. A request must reasonably describe the records sought. You may specify a preferred format, such as electronic delivery. See FOIA.gov’s how-to guide and the DOJ request guidance.

To make an incident easier to identify, include the details you know. They are useful drafting prompts, not a mandatory checklist for every request:

  • Incident date or a narrow date range, approximate time, and location.
  • The federal agency, component, operation, or officers involved, if known.
  • A case, incident, or event number, if available.
  • The particular records requested, such as body-worn-camera video and, if relevant, incident reports, dispatch records, evidence logs, or policies.
  • Your preferred delivery format, such as electronic copies.

Ask for only related records that will help meet your purpose. A broader request can encompass more material to search and review; a focused description gives the agency a clearer target. Do not include unnecessary personal information about other people.

Know what FOIA can and cannot require the agency to release

An agency reviews records it locates and may release them with redactions. FOIA’s law-enforcement Exemption 7 is not a blanket exemption for anything associated with policing: it applies when disclosure would cause one of the harms specified in the law. These include interference with enforcement proceedings, an unwarranted invasion of personal privacy, disclosure of a confidential source or investigative techniques, or danger to a person’s life or physical safety. The agency must consider releasing reasonably segregable nonexempt portions. See the FOIA statute and FOIA.gov’s FAQ.

Body-camera footage can show identifiable bystanders, witnesses, sources, investigative methods, or events tied to an active proceeding. Depending on the circumstances, an agency may release a redacted recording, withhold some or all of it when an exemption applies, or say it found no responsive record. Where appropriate, ask for reasonably segregable portions rather than assuming the choices are an unredacted video or no disclosure.

In a narrow set of law-enforcement or national-security cases, FOIA permits exclusions under which an agency need not acknowledge that certain records exist. That is different from an ordinary exemption decision. DOJ discusses the distinction in its FOIA FAQ.

Understand the DOJ body-camera rules—and their limits

A June 1, 2021 memorandum from the Deputy Attorney General directed leadership at ATF, DEA, FBI, and the U.S. Marshals Service to develop body-worn-camera (BWC) policies for planned arrests and search or seizure warrants. It called for policies addressing equipment, activation and deactivation, buffering, collection, storage, access, retention, use and dissemination, and expedited public release after serious bodily injury or death. It did not make every recording automatically public. Read the DOJ BWC memorandum.

DOJ’s Justice Manual also addresses recordings made by deputized task-force officers during federal task-force operations. Those recordings are federal DOJ records controlled by the sponsoring federal agency, even when held by a parent agency or a third-party storage provider. They generally cannot be disseminated without written DOJ permission. The manual describes an expedited public-release process for footage showing conduct solely by a task-force officer that results in another person’s serious bodily injury or death, subject to specific and compelling objections that cannot be resolved through redaction or other means. Exceptions can involve undercover personnel, confidential sources, sensitive techniques, and sensitive investigations.

These are DOJ rules, not a universal policy for every federal department. Confirm the current policy and submission instructions of the agency involved. Plan for fees and decide whether to request expedited processing

There is no fee to submit a FOIA request, but agencies may assess allowable search, review, or duplication fees under the statute and their regulations. For many noncommercial requesters, the first two hours of search and first 100 pages of duplication are not charged; fees depend on the requester’s category and the agency’s rules. Set a maximum amount you will pay and ask the agency to contact you before exceeding it. If the estimate is too high, you can ask to narrow the scope. See the FOIA statute, FOIA.gov’s FAQ, and DOJ request guidance.

A fee waiver is not based simply on inability to pay. Explain how disclosure is likely to contribute significantly to public understanding of government operations and why the request is not primarily in your commercial interest. A personal request for your own records usually does not, by itself, establish that public-interest basis.

Request expedited processing only when the facts meet the agency’s standard, and provide supporting details. DOJ recognizes grounds including an imminent threat to life or physical safety and an urgent need to inform the public about actual or alleged federal activity for someone primarily engaged in disseminating information. Its guidance also describes substantial due-process consequences and specified exceptional media interest as grounds. Check the agency’s own instructions rather than assuming DOJ’s criteria apply elsewhere: DOJ request guidance.

Track the request, read the determination, and use review options

An agency generally acknowledges a request and may provide a tracking number. It searches for responsive records, reviews them, and issues a determination about release, redactions, or withholding. The statute generally provides a 20-working-day period for the determination, subject to provisions for unusual circumstances and limited tolling. That is not a guarantee that a complete video will arrive within 20 working days; DOJ warns that complexity, backlogs, and line-by-line review can extend actual processing time. See the FOIA statute and DOJ request guidance.

If a response denies access in whole or in part, read the determination letter for the reasons, appeal deadline, and filing address. DOJ says appeals from component decisions should be submitted to its Office of Information Policy within 90 calendar days. Identify the determination you challenge and include the component and tracking number. For requests to other agencies, follow that agency’s appeal instructions and deadline; do not assume DOJ’s period applies. The DOJ appeal guidance explains the DOJ process.

FOIA.gov recommends contacting the FOIA professional or public liaison before appealing when that may resolve a question or narrow a dispute. After the administrative appeal process, the Office of Government Information Services (OGIS) offers mediation. Federal-court review may also be available after applicable administrative steps. See FOIA.gov’s FAQ.

Before you submit: a practical checklist

  • Have you identified the federal agency or DOJ component most likely to control the recording?
  • Have you checked its FOIA page and reading room for records already posted?
  • Does your request identify the incident with the date, time, location, and any known case number or personnel?
  • Have you named the records you want and requested electronic delivery if suitable?
  • Have you set a fee ceiling, and, if seeking a waiver or expedited handling, explained the relevant factual basis?
  • Can you track the request and follow the deadline and instructions in any determination letter?
