Contact the police or sheriff’s department that stopped, cited, investigated, or contacted you, and ask whether it or another agency searched an automated license plate reader (ALPR) system for your plate. Make a focused written records request using the plate, issuing state, approximate time and place, and any case number. The steps and rights depend on where the search occurred; the California process below is an example, not a nationwide rule.
What an ALPR search can—and cannot—tell you
An ALPR system can record a vehicle observation, including a plate, time, location, and associated image. A record of a plate hit does not, by itself, establish who was driving. If you are trying to find out whether police searched for your plate, seek both the underlying hit or image and records about who accessed the system, what they queried, and why.
Start with the agency involved in your stop, citation, investigation, or contact. Ask whether another department, shared system, or vendor held or accessed the records. An agency policy may identify its ALPR program contact or records custodian.
How to request the records
- Identify the records custodian. Use the agency’s records-request process and address the request to its records custodian. In California, this generally means submitting a California Public Records Act request to the relevant agency.
- Pin down the search. Give the license plate and issuing state, a reasonable date and time window, the location if known, and any incident or case number. These details help distinguish a particular observation or query from unrelated records.
- Ask for the access trail as well as the hit. Request available query or access-log entries, query terms, user or agency identity where releasable, stated purpose, associated case number, related image or alert, audit records, and dissemination or sharing records. Also request the applicable usage and privacy policy, retention schedule, and any record of review or correction.
- Ask whether the records still exist. Request the agency’s retention schedule and whether responsive information remains in its possession. Records may be held by a different participating agency or vendor, so ask where else to direct the request if the agency does not hold them.
- Request preservation if there is an active dispute. Identify the specific date range and types of records, and ask the agency to preserve query, image, audit, and dissemination records while the complaint or case is reviewed. This is a practical request; it does not mean every record is automatically subject to a particular preservation duty.
For California requests, the California DOJ’s model ALPR policy describes access controls and annual audits of access, use, and sharing, with audit information retained for three years. That is a policy period for audit information, not a promise that every hit, image, or query record will exist for three years. The DOJ also says requests for ALPR information are evaluated under applicable privileges and exemptions. A particular investigative hit may therefore be withheld, even if other policy or administrative records are released.

- Possible misread or wrong vehicle: explain how the plate, vehicle, image, time, or location appears inconsistent, and identify any documents or photographs that support your concern.
- Questionable purpose or access: identify the suspected query or user, if known, and ask the agency to review whether the access complied with its policy.
- Questionable sharing: identify the record or recipient you are concerned about and ask what was shared, with whom, and for what stated purpose, to the extent those records can be disclosed.
Ask for a written determination and the agency’s process for correcting or annotating a disputed record. California sources describe policies, access records, and audits, but do not establish a universal individual complaint form or a guaranteed right to amend an ALPR hit. Keep copies of the complaint, request, responses, and any reference numbers.

The California policies discussed here do not establish that every ALPR search requires a warrant or that a policy violation automatically results in evidence being suppressed. Whether a challenge is available depends on the facts and applicable law in the case.

What changes outside California
Do not assume California procedures or safeguards apply where you live. Before requesting records, check the law and policy for the agency that operated or accessed the system; a city department, sheriff, state agency, or vendor may hold different parts of the record trail.
- Which agency or vendor holds the data, and whether systems are shared.
- Whether law or policy requires query logs and audits, and how long each type of record is retained.
- Which public-records exemptions may cover investigative, personal, or otherwise sensitive information.
- How the agency handles complaints and requests to correct a suspected misread.
- What limits govern interagency sharing and what remedies may be available in a pending case.
California DOJ guidance interprets SB 34 to prohibit California law-enforcement agencies from sharing ALPR information with out-of-state or federal agencies. The DOJ has also announced litigation alleging unlawful sharing by El Cajon; the announcement describes allegations and requested relief, not a final ruling. Check current law, policy, and case status before relying on either point.
