If you think an insurer used AI or automated analysis to deny a claim, end coverage, or make another consequential decision, appeal through the insurer’s stated process and ask for a substantive review by a qualified person who can change the outcome. Explain the specific error, attach relevant evidence, and ask what data and criteria informed the decision.
AI involvement alone does not establish a universal right to human review. Whether a legal right applies depends on your location, the type of insurance decision, and whether the decision was made solely through automated processing. Treat a request for human review as part of a timely, documented appeal—not as a reason to miss the deadline in your notice.
Start with the insurer’s decision notice and appeal route
Read the decision notice alongside your policy or plan documents. Identify what the insurer decided, the reason it gave, how to appeal, and the deadline. If the notice does not explain the route or deadline clearly, ask the insurer in writing and check the rules for your jurisdiction and insurance product.
For health coverage, HealthCare.gov explains “How do I appeal an insurance company decision?” and the National Association of Insurance Commissioners (NAIC) offers “Health Insurance Claim Denied? How to Appeal the Denial.” Their procedures are health-insurance guidance, not a single process for every kind of insurance.

How to ask for a human review
- Identify the decision. Give your name, policy or claim number, the decision date, and the specific action you are appealing.
- Explain what is wrong or missing. Address the reason in the notice and explain why the decision should change under your policy or plan. Point out factual errors, missing records, or information that was not considered.
- Attach supporting evidence. Include relevant policy pages, correspondence, bills, treatment records, or other documentation. For a health claim, a clinician’s explanation may help support why care was needed.
- Ask about automation and the information used. Ask whether AI, an algorithm, or other automated processing materially informed the outcome; what information and criteria were used; how to correct inaccurate information; and how to submit additional evidence.
- Request a substantive review. Ask for review by a qualified person with the authority and capability to change the result. A request is not, by itself, proof that the law gives you a right to that review.
- Send it through the stated channel and keep proof. Save the appeal, attachments, delivery confirmation, notice, policy, and replies. Keep a log of calls, including names, titles, dates, and what was said. If delay could cause urgent harm, ask whether expedited handling is available under the applicable process.
Sample wording
“I am appealing the decision dated [date] concerning [claim or policy number]. Please confirm whether automated or AI-supported analysis materially informed this decision. I request a full review by a qualified person who can change the outcome, including consideration of the attached information. Please identify the appeal deadline and any next stage of review, explain what information and criteria informed the decision, and tell me how to correct inaccurate information used in it.”
Adapt the wording to your case and submit it by the insurer’s deadline. The request does not create a legal entitlement where one does not otherwise apply.
Health-insurance appeals in the United States
For a U.S. health-insurance denial or termination of coverage, HealthCare.gov describes an internal appeal and, for eligible cases, an independent external review. The notice should explain the reason for the decision and how to dispute it. External review generally follows the insurer’s final determination or completion of the internal appeal, subject to the process that applies to the plan.

| Review stage or situation | Who reviews | Timing or requirement |
|---|---|---|
| Internal health appeal: urgent-care claim | The insurer | NAIC consumer guidance gives 72 hours as a typical decision period for urgent-care claim appeals. This is not a universal deadline for every insurance appeal. NAIC guidance |
| Internal health appeal: treatment not yet received | The insurer | NAIC consumer guidance gives 30 days as a typical decision period. NAIC guidance |
| Internal health appeal: treatment already received | The insurer | NAIC consumer guidance gives 60 days as a typical decision period. NAIC guidance |
| External review of an eligible health-plan decision | An independent reviewer | HealthCare.gov says a request generally must be made in writing within four months after the insurer’s notice or final determination. State processes may apply if they meet federal standards; expedited external review can be available in urgent cases. The insurer must accept the reviewer’s decision. HealthCare.gov external-review guidance |
The internal-appeal periods in the table are typical periods reported in NAIC guidance, not a substitute for checking the deadline and rules that apply to your plan. The four-month external-review period is also subject to the applicable process. For example, North Carolina’s Department of Insurance describes a 120-day request period after completion of the insurer’s appeal; do not apply that state-specific period elsewhere.
When preparing a health appeal, NAIC recommends gathering the policy, Summary of Benefits and Coverage, denial letter, relevant treatment evidence, and clinician support. If the insurer is not cooperating, its guidance advises contacting your state Department of Insurance.

When data-protection law may provide a human-review right
Insurance companies may use AI in areas such as underwriting, pricing, claims handling, customer service, marketing, or fraud detection. The NAIC notes that insurers remain responsible for applicable insurance laws and that regulators oversee insurer conduct. AI may assist a person rather than make the decision on its own, so ask what role automation actually played instead of assuming the outcome was fully automated.

Some data-protection laws provide safeguards for certain decisions made solely by automated processing, especially where a decision has significant effects. The details depend on whether the law applies to you and the decision, and exceptions may apply.
European Union
Your Europe’s GDPR guidance describes a right not to be subject to a decision based solely on automated processing, subject to exceptions. Its summary says people should be informed about such a decision, be able to request human review, and have an opportunity to contest it. It says responses to rights requests are due without undue delay and, in any case, within one month. This summary is not a determination that a particular insurer, decision, or request falls within the rule; verify the law’s territorial and substantive applicability for your case.
United Kingdom
The UK Information Commissioner’s Office (ICO) explains the quality of human involvement expected under its guidance: “Human intervention should involve a review of the decision, which must be carried out by someone with the appropriate authority and capability to change that decision.” The ICO also says the review should consider relevant data, including information supplied by the person. UK guidance does not determine which law applies to someone outside its scope, or whether a particular insurance decision qualifies.

If the insurer does not resolve the appeal
Check whether your policy and local rules provide an external review, an ombudsman or other complaint process, or a route to your state or national insurance regulator. Eligibility, order of steps, forms, and time limits depend on location and insurance product. For U.S. health coverage, eligible decisions may qualify for the external-review process described above; other disputes require checking the relevant regulator’s current guidance.
