Before listing your parking space, confirm you are allowed to rent it, check local planning and parking rules, and ask your insurer whether paid use is covered. Then agree in writing on the space, access, payment, and what happens if problems arise. Requirements vary by country and locality; the planning example below is for England, with a separate local-levy example from Victoria, Australia.
1. Confirm you have the right to rent the space
Start with the agreement or title that governs the property. Owning the home does not automatically settle whether a particular bay can be let: mortgage terms, shared-property arrangements, and local restrictions may still matter.
- If you own the property: review your mortgage terms and ask your lender for written consent if the agreement requires it.
- If you rent or lease: check your tenancy or lease and ask the landlord, freeholder, or managing body for consent where required. A designated or shared space may have separate restrictions.
- If the space is part of a home business: GOV.UK says permission may be needed from a mortgage provider or landlord, a local planning authority, or the council, depending on circumstances. See GOV.UK guidance on running a business from home.
Ask the relevant party to confirm the proposed paid parking use, rather than relying on a general permission to use the property.
2. Check planning permission and parking restrictions
England: one space is not an automatic exemption
For England, the government’s current planning guidance says: “The government’s view is that it should be possible to rent parking spaces without planning permission, provided there are no substantive planning concerns such as public nuisance to neighbours.” The guidance was revised on 26 July 2023. Whether renting the space materially changes its use is a case-by-case decision for the local planning authority; planning conditions and other local considerations may also apply. A dedicated off-street bay is different from converting a garden into a car park or operating a commercial vehicle rank. A 2013 government announcement discussed that distinction, but the later planning guidance provides the current framing: government announcement on parking spaces in gardens.
Check the rules that apply to your exact space
Ask your local planning authority if the arrangement could increase traffic, noise, or other nuisance, or if a planning condition restricts the space. Also check any rules for shared drives, controlled parking areas, or common property with the relevant council or managing body. Do not assume that a general statement about renting one space resolves a restriction attached to your property.

3. Ask your insurer before advertising
GOV.UK warns that home insurance may not cover business activity and says separate insurance may be needed for a home business. That is general guidance, not a ruling about parking-space rentals. Contact your insurer before accepting payment and ask for written confirmation about the specific arrangement.
- Does the policy permit paid use of the space?
- Are visiting drivers, their vehicles, or damage to your property covered?
- What liability, if any, is covered if a visitor is injured or causes damage?
- Are there conditions, exclusions, or limits on how often or by whom the space may be used?
Do not promise renters that their vehicles or belongings are insured unless the relevant insurer confirms it. The renter should check their own motor-insurance terms as well.

4. Check tax and any local parking levy
Tax treatment depends on your location and the legal and practical details of the arrangement. UK government guidance says rental income may be taxable, but its general property-rental advice does not determine the treatment of every parking-only arrangement. Check with HMRC’s guidance on tax when renting out property or a tax professional, and explain that the income is from a parking space.
Local levies can also depend on how a space is used. In Victoria, Australia, the State Revenue Office says an owner may need to register for the congestion levy when a space is used for a non-exempt purpose, including parking while working in the CBD. Listing the space on a parking website does not by itself change whether the levy may apply; use and exemptions matter. See the State Revenue Office of Victoria’s congestion levy guidance. Check the rules for your own location rather than treating this example as a general rule.

5. Choose how to find a renter
You can arrange a rental directly, use a parking marketplace, or rent to someone you know. A marketplace can help match drivers and owners, but its current fees, protections, and terms vary. Before choosing a route, compare the practical details below and verify the current terms in writing.

6. Put the arrangement and access rules in writing

- Identify the space: describe the exact bay or driveway, and confirm the vehicle fits without blocking a path, neighboring access, a dropped kerb, or a shared drive.
- Set the schedule and route: record the start and end dates, recurring days and hours, entry and exit route, and any gate or key arrangements.
- Agree the money: state the fee, due date, any deposit, cancellation notice, and whether a refund is due if access is unavailable.
- Define permitted use: say whether the space is for parking only, and whether storage, repairs, overnight stays, or charging are excluded.
- Keep contact details proportionate: record the vehicle registration and a reliable contact method, collecting only what is needed to manage the arrangement.
- Plan for problems: agree how to report damage, blocked access, late payment, or a vehicle left behind. Check local rules before threatening removal, clamping, or towing.
- Document handover: photograph the space and note existing damage. Keep records of consent, insurance confirmation, and payments.
A contract or disclaimer does not automatically remove legal duties or guarantee recovery for damage. If a dispute or abandoned vehicle arises, use the appropriate local process instead of assuming you can clamp or tow it.
