Preserve the page promptly, but treat it as evidence of what appeared—not proof of who or what caused it. Record the exact URL, capture time and timezone, how you reached the page, and the method and limitations of collection. Keep the original files unchanged and preserve relevant logs through authorized channels; a screenshot alone cannot establish that an AI agent performed an action.
What to preserve—and what it can show
A useful record combines the page’s visible content with context about where it came from and how it was collected. A screenshot can show a rendered view at a particular moment, but it does not preserve site functionality. A web archive may retain more of the page and its linked resources, but no capture method guarantees completeness.
- Visible state: screenshots can document the page as displayed, including text and layout.
- Underlying web content: where feasible, make a web capture that retains the page and linked resources. The National Archives describes website snapshots accompanied by site maps and discusses retaining hypertext functionality for permanent web content (NARA web-records guidance).
- Context and collection details: retain the source URL, capture time and timezone, collection method, response information where available, tool or operator, and any gaps.
- Related records: preserve relevant browser, platform, or service logs only through authorized channels. Logs may be volatile or retained only briefly; CISA’s advice on preserving such evidence is framed for incident response (CISA #StopRansomware Guide).
The Library of Congress prefers WARC for web archives and recommends considering non-proprietary formats. Even web archiving can miss multimedia, streaming, deep-web, or database content (Library of Congress Recommended Formats Statement).
How to collect a useful record
- Capture promptly. If the page or related records may change or disappear, preserve what is available without delaying to perfect the process.
- Record the route. Note the exact URL and the steps, links, or other route that led to the material. If relevant, record the account or environment used, while protecting credentials and personal information.
- Record time and method. Write down the date and time with timezone, the capture method, the browser or tool used, and the person or operator who collected it. Preserve response details where available; archive indexes can include original URL, GMT timestamp, HTTP status, and a payload digest (Library of Congress CDX format description).
- Capture both view and context where practical. Save a screenshot of the displayed page. When the matter warrants it and the site permits it, also create a web archive that retains available page resources. WARC can carry contextual metadata such as harvest time and response code (Library of Congress WARC format description).
- Document gaps. Note content that did not load, access restrictions, missing resources, or other limitations. Do not present a partial capture as a complete record.
- Preserve the collected originals. Keep original files unchanged in a controlled location. Make separate working copies for review, and record who collected, transferred, or accessed the evidence. For formal review, maintain an appropriate chain-of-custody record.
- Check copies when appropriate. A cryptographic hash or digital signature can help establish that a later copy is identical to the file that was checked; it does not prove when the original was created or whether the captured content was true. NIST discusses integrity and preservation of digital evidence in its general guidance (NISTIR 8387).
Choose a capture method for the question you need to answer

Choose based on fidelity, context, coverage, integrity controls, and lawful access—not on an assumption that one format proves the whole event. The Library of Congress’s discussion of web-archive formats and limitations is available in its Recommended Formats Statement. NIST’s digital-forensics guidance provides general process context, not an all-inclusive procedure or legal advice (NIST SP 800-86).

Keep observations separate from attribution
A preserved page can document what was visible or captured, but page content alone does not establish that an AI agent caused a particular action. Describe the event as suspected AI-agent activity unless independent evidence supports attribution. Preserve associated records that may help evaluate the hypothesis, and avoid presenting an inference as a finding. NIST’s digital-evidence guidance is general preservation guidance, not a validated test for identifying AI agents (NISTIR 8387; NIST Digital Forensics Glossary).
