If a selected giveaway winner has not responded, go back to the rules you published before the drawing. Follow the stated claim deadline and contact method, keep a dated record of your attempts, and take only the next step those rules and applicable law allow. There is no universal waiting period for private stream giveaways.
What happens if a giveaway winner doesn’t claim the prize?
It depends on the promotion’s original terms, the applicable jurisdiction, and any relevant platform requirements. If the rules say an alternate winner may be selected after a specified deadline, follow that process as written. If the rules do not say what happens, do not assume that you may keep the prize, choose another entrant, or run the giveaway again.
Before deciding, preserve the original announcement and rules and get advice specific to the promotion and organizer’s jurisdiction if the next step is unclear. The outcome can depend on details such as the prize, entry mechanics, and what participants were promised.
How long should I wait for a giveaway winner to respond?
Use the claim window stated in the rules. The available sources do not establish a default response period for private creator giveaways, so do not substitute an arbitrary 24-hour, 48-hour, or seven-day deadline. If the terms specify no deadline, do not invent one after the drawing; seek jurisdiction-specific advice before treating the prize as unclaimed or moving it to someone else.

What to do when a winner has not responded
- Find the rules that applied when entries opened. Check the original announcement and any linked terms. Identify the organizer, prize, eligibility requirements, claim method, response deadline, information needed to deliver the prize, and any stated process for an alternate winner or an unclaimed prize.
- Check that you used the promised contact route. Send the notice through the channel or account identified in the rules. If the rules or your established procedure allow a reminder, send one without arbitrarily shortening or extending the claim window. Avoid posting the winner’s private contact details or messages publicly.
- Keep a dated record. Save the announcement and rules as they appeared when entries opened, the drawing or selection record, timestamps and copies of winner notifications, any replies, and the date the stated claim period expires. This is prudent administration, not a recordkeeping deadline established by the sources cited here.
- Apply the disclosed next step when the deadline passes. Follow the published alternate-winner or other unclaimed-prize process consistently. If the rules are silent or unclear, pause rather than treating silence as permission to keep, redirect, or redraw the prize.
- Arrange delivery safely if the winner replies. Request only information reasonably needed to provide the prize. Do not charge a claim, processing, or shipping fee as a condition of receiving it, and do not request bank or credit-card details to send a prize.
- Close the loop carefully. If useful, post a brief factual update. Do not reveal private messages or personal information, or say the winner forfeited unless the rules and applicable requirements support that statement.
How to handle unclear or missing rules
Preserve the exact announcement, entry instructions, and any messages explaining the promotion. Then pause before keeping the prize, selecting someone else, or running another drawing. The right answer cannot be settled without facts such as the organizer’s jurisdiction, platform, prize, entry mechanics, and terms. Get advice that addresses those specifics rather than borrowing a deadline or procedure from a different kind of promotion.
Keep prize claims free and protect personal information
The Federal Trade Commission’s guidance says, “If you have to pay to get your prize, it’s a scam.” It also warns about requests for financial information. Do not make a winner pay a fee to claim a prize or collect sensitive information that is not needed for delivery. See the FTC’s guidance on fake prize, sweepstakes, and lottery scams.

That consumer guidance is useful for safe prize communications; it does not set a waiting period for a livestream giveaway. Likewise, a rule for a government lottery should not automatically be applied to a private creator promotion. For example, North Carolina G.S. 18C-132 addresses prizes in the North Carolina lottery and how lottery prizes unclaimed after the applicable claim period are handled. It is not a universal rule for stream giveaways.
Federal law also has requirements concerning mailed sweepstakes, including disclosures and representations about winning. Because the statutory text could not be verified from the available source, do not rely on this summary as a legal determination for a particular promotion. Consult the current law applicable to your giveaway.

Check the rules of the platform you used
Platform requirements are an additional check, not a substitute for your published terms or applicable law. Review the current policy for the platform where you ran the promotion before taking action. Do not assume one platform’s rules apply to another, or that a government-lottery procedure governs a creator giveaway.
