In the United States, the federal depreciation rules reviewed here do not create a separate regime simply because a data center runs AI workloads. Compare the tax treatment asset by asset, then check the state and locality for incentives that may depend on the project’s location, investment, equipment, electricity use, or other conditions. This article covers U.S. federal income-tax depreciation and selected state and local examples; it does not establish the rules in other countries or determine a particular project’s tax liability.
What should you compare: the AI label or the project’s assets?
Start with the facility’s actual assets and transactions, not its marketing label or workload. The federal depreciation guidance discussed here sets general rules for depreciable property, section 179 expensing, and section 168(k) additional first-year depreciation. It does not establish a distinct federal depreciation classification for servers merely because they run AI workloads. That is a conclusion about these depreciation rules, not proof that AI is irrelevant to every tax provision or incentive.
AI and other data centers may differ in hardware mix, power and cooling requirements, project spending, or timing. Those differences can change the assets, costs, dates, or eligibility facts being analyzed. They do not, by themselves, show that a tax rule treats AI facilities differently.
| Comparison point | AI data center | Ordinary data center | What determines the tax analysis |
|---|---|---|---|
| Federal depreciation category | No separate category is established solely by AI use in the reviewed IRS depreciation guidance. | No special category is established by being an ordinary data center. | Asset classification, taxpayer ownership, business use, applicable recovery period, dates, and elections. |
| Equipment and facility mix | May include a different mix or scale of compute, power, or cooling assets. | May have a different mix or scale of those assets. | The tax classification of each asset; do not assume every system or component receives the same treatment. |
| State or local incentives | Eligibility depends on the applicable jurisdiction’s rules and the project’s facts. | Eligibility likewise depends on those rules and facts. | Statutory definitions, location, qualifying purchases or uses, thresholds, approvals, reporting, and effective dates. |
How do you analyze federal depreciation?
Build an asset-level record before estimating deductions. IRS Publication 946 (2025) states: “To be depreciable, the property must meet all the following requirements.” It identifies ownership by the taxpayer, use in a business or income-producing activity, a determinable useful life, and an expected useful life of more than one year. Land is not depreciable under these general rules.

- Durability: Made of high quality cold rolled steel holds up to 110lb (50kg) (Easy Assembly Required)
- PCI & HIPPA and EIA/ECA-310-E compliant
Separate the facility into tax-relevant assets
Identify land, the building and structural components, servers and networking equipment, power and cooling systems, software, and later improvements. The IRS guidance provides general tests and categories, not a blanket recovery-period assignment for every data-center component. In particular, do not assume that all electrical or cooling equipment has the same classification or deduction schedule. Accounting labels alone do not settle the tax classification.
Consider section 179 only for qualifying property
Section 179 is an elective deduction, not an automatic write-off for a data-center project. IRS guidance covers qualifying tangible personal property and certain nonresidential real-property improvements, subject to eligibility and acquisition requirements, business-use rules, annual dollar limits, and a business-income limit. Determine which specific assets qualify and whether an election makes sense; do not treat all construction, building costs, or project capital expenditure as immediately deductible.
Check section 168(k) dates, property, and elections
IRS Publication 946 (2025) says certain qualified property acquired and placed in service after January 19, 2025 may qualify for a 100% special depreciation allowance, subject to detailed rules. Qualified property includes tangible MACRS property with a recovery period of 20 years or less and specified computer software. The publication also describes an election for a 40% allowance for certain qualifying property in the first tax year ending after January 19, 2025.

For each asset, record both its acquisition date and placed-in-service date, establish whether it meets the qualified-property rules, review applicable exceptions, and evaluate available elections against current IRS guidance. The stated allowance does not mean every building, construction cost, or data-center project qualifies for 100% treatment.
Why do state and local rules need a separate review?
State and local taxes can alter a project’s overall tax picture independently of federal depreciation. A December 19, 2025 Tax Foundation overview describes state and local data-center tax burdens as strongly affected by the treatment of equipment for sales and property taxes, and notes that equipment exemptions are often tied to economic-development conditions. That overview is policy context, not proof of eligibility. For an actual facility, verify the operative statute or regulation and the administering agency’s rules for the relevant tax year.
| Jurisdiction | Illustrative treatment described by the source | Qualification or limitation to check |
|---|---|---|
| Texas | Comptroller guidance describes a state sales-tax exemption for qualifying data centers and qualifying large data-center projects. Covered items include specified tangible property and necessary mechanical, electrical, or plumbing systems. The guidance addresses the 6.25% state sales tax and electricity-use allocation when a meter serves mixed use. | Confirm current program eligibility and assess local tax treatment separately; mixed-use electricity requires attention to allocation. |
| North Carolina | G.S. 105-164.13 addresses electricity used at a qualifying data center and “datacenter support equipment.” The statute defines support equipment by its capitalized tax treatment and enumerated operational purposes, including computer/server, storage, and network equipment. | Read the full current statute and its effective dates before applying the exemption to a project or purchase. |
| Iowa | Department of Revenue guidance describes sales and use tax exemptions for listed purchases or uses by data-center businesses, including electricity. It distinguishes treatment of certain real-property-related items by an operating-date cutoff. | Check current conditions and the project’s start date. |
| Alabama | Department of Revenue guidance describes abatements by local authorities for qualifying projects, including data processing centers, with limits on the taxes that may be abated and the duration. | Local approval and project qualification matter; determine which taxes and time period an approval covers. |
These examples illustrate variation; they do not establish that AI-focused facilities are automatically eligible, that ordinary facilities are excluded, or that benefits are uniform across states. A jurisdiction’s own statutory definitions, thresholds, effective dates, and approval process control.

How can you make a like-for-like comparison?
Use the same project facts and tax year for both facility types. Separate workload-related differences from legal eligibility: for example, higher-density compute may correspond to different equipment or energy and cooling needs, but a tax difference should be attributed to AI only if the applicable rule actually distinguishes AI use.
- Fix the jurisdiction and tax year. Identify the country, state, county or city, relevant tax year, and applicable law version or effective date.
- Map the taxpayer and transaction. Record the owner, tenant, operator, lessor, and purchaser, and identify who bears each tax or claims depreciation.
- Build an asset register. List land, building and structural elements, server/GPU and network hardware, power and cooling equipment, software, and improvements. Determine tax classification item by item rather than relying on book labels.
- Record basis and dates. Track purchase or contract date, construction start, acquisition, installation, and placed-in-service date. Note whether property is new or used and any basis adjustments.
- Test federal cost recovery. Analyze ordinary MACRS treatment, section 179 qualification and limits, section 168(k) qualification and allowance or election, and applicable exclusions.
- Test state and local incentives. Check sales and use tax, electricity, property tax, covered equipment and construction costs, investment or job thresholds, certification, reporting, local approval, benefit duration, and sunset terms.
- Compare workloads only after the rules are mapped. Identify whether any difference follows from equipment, energy or cooling needs, capital spending, or timing. Attribute it to AI only where the cited jurisdictional rule uses that distinction.
What information is needed for a facility-specific answer?
A reliable eligibility or liability conclusion requires more than knowing that a facility serves AI or conventional computing. At minimum, assemble its location, owner/operator and tenant structure, itemized equipment and construction costs, acquisition and placed-in-service dates, investment and job facts, and any relevant prior approvals. Incentives and depreciation guidance can change; verify the operative law and agency instructions before relying on an estimate.
