No cryptocurrency exchange can be called safe based on a registration badge, reserve disclosure or history of successful withdrawals alone. Before depositing, identify the exact legal entity serving you, verify its authorization for your location and activity, read its custody and insolvency terms, and check whether you can withdraw the specific asset over the network you need.
The rules depend on where you live and which entity holds your account. The checks below help you compare providers without treating any one exchange as universally safe or recommending a particular platform.
1. Verify the legal entity and its authorization
An exchange’s brand name may not be the legal entity that holds your assets or provides your service. Find the entity named in the account terms, custody agreement or onboarding disclosures, then search the relevant regulator’s official register. Check that the registration or authorization covers the service and location you intend to use; a listing for a related company or a different activity may not be enough.

- Match the entity name in the regulator’s register to the entity in the contract—not just the exchange’s public-facing brand.
- Confirm the register covers the relevant activity and jurisdiction.
- Check the regulator’s record for restrictions, warnings or status changes, and revisit it before depositing because permissions can change.
2. Read the custody terms before funding the account
Custody terms explain who controls assets while they are on the platform and what the provider may do with them. Look for the entity responsible for custody, whether customer holdings are segregated from the provider’s own assets, whether the provider can lend or reuse them, which law applies, and what the contract says happens in insolvency. If the terms are unclear about any of these points, ask the provider for a written explanation before transferring funds.
The result in a failure can depend on both the contract and local law. FINMA’s 12 January 2026 announcement warns that custody abroad can raise additional legal complexity, particularly if a custodian becomes insolvent; that is a Swiss supervisory perspective, not a universal rule for other jurisdictions. What EU MiCA requires for covered custody providers
For providers within its scope, Article 75 of the EU Markets in Crypto-Assets Regulation (MiCA) requires a custody agreement describing the service, custody policy, communications and authentication, security systems, fees and applicable law. It also calls for client position records, a custody policy designed to minimize loss risks, and position statements at least once every three months and on request. The rules include segregation of client holdings, procedures to return assets or access as soon as possible, and liability for loss attributable to the provider. These are EU requirements for covered providers, not a global standard for every exchange. ESMA: MiCA Article 75, custody and administration

3. Confirm that withdrawals work the way you need
Being able to buy or trade a coin does not establish that you can withdraw it to your chosen wallet. Check withdrawal availability for the exact asset and network, and confirm the current minimum, fee, limits, address rules, identity checks and any review or hold conditions. These details may vary by account and can change, so use the exchange’s current withdrawal screen and terms rather than an old comparison or forum post.
In the EU, ESMA-hosted European Commission guidance published on 18 February 2026 interprets MiCA Article 75(6): a covered custody provider must return the same type of crypto-asset held when the client requests it, rather than require acceptance of fiat or another token. A conversion can be offered if the client requests it at withdrawal and the conversion service is authorized as applicable. Technical requirements, fees, account or address limits, and conversion conditions belong in the custody agreement and must not make return difficult for most clients. Make a small test withdrawal when practical
If the exchange supports the asset and network you plan to use, a small test withdrawal can reveal operational issues such as an unsupported address format, an unexpected fee or a processing delay. It only checks a transaction under the conditions at that moment. It does not prove that larger withdrawals will be available later, that the exchange has sufficient liquidity, or that access will continue during stress.

4. Investigate interruptions, complaints and support
Look for prior withdrawal interruptions or freezes, especially repeated cases without a clear explanation. A report is a prompt to investigate, not proof by itself that every customer was affected or that a provider cannot be trusted. Ask which assets and networks were affected, why access was restricted, how customers were notified, what conditions lifted the restriction and whether the exchange provides a usable complaint route.

Check how to contact support before a problem occurs. Find out whether the platform offers a documented escalation path for account reviews, withdrawal delays and complaints, and retain copies of account terms, transaction records and support correspondence. 5. Treat reserve disclosures as one piece of evidence
Published wallet addresses or proof-of-reserves may provide useful transparency, but they do not by themselves establish the full picture of customer claims, liabilities, legal segregation, liquidity or insolvency treatment. Read what the disclosure actually covers, who produced it, when it was measured and what it excludes. Do not treat a snapshot as proof that every customer can withdraw every asset on demand.

Likewise, if an exchange advertises insurance or another protection, establish who provides it, which assets and events it covers, and which customers and jurisdictions qualify. Do not infer that a protection covers crypto held in an exchange account unless the terms say so.

Compare the same service and legal entity across your shortlist. A brand-level comparison can obscure differences in authorization, custody arrangements or withdrawal availability between jurisdictions.

A provider that performs well on one criterion may still be unsuitable if it cannot serve your jurisdiction, its custody terms do not fit your risk tolerance or it lacks the withdrawal route you need. Avoid ranking exchanges without current, comparable evidence for the exact entities and services being compared.

7. Know what self-custody changes—and what it does not
With self-custody, you control the private keys rather than leaving the assets under an exchange’s custody. A hardware wallet is one optional tool for people who choose this approach, but managing it means taking responsibility for securely backing up and recovering the keys. Self-custody does not make an exchange process a pending withdrawal, reverse a review hold or protect assets that are still on the platform.
Regional rules are not interchangeable
Local rules can change both what an exchange must do and what rights a customer may have. The EU MiCA provisions above apply to covered providers in scope. Michigan’s guidance is a consumer example, not a statement that all U.S. crypto activity follows one licensing or protection scheme. FINMA’s custody discussion reflects Swiss supervisory concerns. In the UK, the FCA says it published final rules and guidance on 30 June 2026, with those rules applying to cryptoasset firms granted permission to operate under FSMA on or after 25 October 2027; that future application date does not mean the rules already apply to every UK crypto exchange.
