Choose a crypto custodian by testing the entire arrangement—not just its security claims—against your company’s payment and treasury workflows. Verify which legal entity holds the assets, how your rights would be treated if it or a subcontractor failed, who can authorize transfers, whether the exact assets and networks you need are supported, how operations recover from disruption, and what the service costs. Regulatory status and insolvency treatment depend on the provider, service, contract, and jurisdiction.

Define what your business needs the custodian to do

First decide whether you need safekeeping alone or a combined service that also executes transactions, converts between crypto and fiat, provides liquidity, or supports settlement and payments. Those functions may be offered by different entities, with different contracts and responsibilities. The contract should describe the actual services and charges, not just use a broad label such as “custody.”

Write down the operating requirements before comparing providers:

  • The company legal entity that will use the service and the countries involved.
  • The assets and specific blockchain networks needed by your business and payment counterparties.
  • Expected balances, transaction volumes, payment directions, and transfer frequency.
  • Whether you need fiat funding, conversion, execution, liquidity, or settlement in addition to custody.
  • Who will initiate, approve, and reconcile transactions, and what accounting or reporting integrations are needed.
  • How quickly your team needs access restored after lost credentials, staff changes, or a provider outage.

This requirements sheet lets you assess whether the service fits your real operating model rather than an abstract idea of institutional custody.

Find out who holds the assets and what happens if a provider fails

Identify the exact contracting entity, the entity responsible for custody, the custody location, and every sub-custodian or other critical service provider. Ask how client positions and movements are recorded, in whose name records are maintained, and what the contract says happens if the provider or a sub-custodian becomes insolvent.

Have qualified counsel review the contract, governing law, and custody structure for the jurisdictions relevant to your company. Do not assume that a marketing description such as “segregated” settles whether your assets would be separate from a provider’s estate or recoverable in an insolvency. In its January 12, 2026 announcement, Switzerland’s FINMA highlighted the legal complexity of foreign custody, particularly in insolvency, and the need to ensure customer crypto-assets do not form part of a custodian’s bankruptcy assets. That supervisory warning is not a guarantee about any specific arrangement. Read FINMA’s guidance on risks associated with custody of cryptobased assets.

For covered providers in the European Union, MiCA Article 75 sets out requirements for custody and administration agreements, including the parties, service, custody policy, communication and authentication, security systems, fees, and applicable law. It also requires a register of positions in each client’s name and custody policies and procedures aimed at minimizing losses from fraud, cyber threats, or negligence. Confirm that the provider and service fall within the relevant scope; the rule is not a substitute for reviewing your own contract. See MiCA Article 75.

Test security, approvals, and recovery—not just the storage claim

Ask the provider to explain how key material and account access are controlled, where key material is held, and whether the provider or a third party operates critical systems or stores assets. Find out who can initiate and authorize a movement, what authentication is supported, how staff permissions are granted and removed, and how unusual instructions are reviewed. Ask for relevant independent audit or control reports, incident-notification commitments, continuity plans, and evidence that recovery procedures have been tested.

Map the recovery scenarios that matter to your business: a lost credential, a departed employee, an unavailable approver, suspected account compromise, or a disruption at the provider. Ask who can restore access, what verification is required, how the company can prevent unauthorized recovery, and what communications to expect during an incident. The goal is to understand the provider’s actual controls and recovery process; the cited rules and guidance do not establish one universally best key architecture.

The SEC’s investor bulletin recommends asking how assets and keys are safeguarded, who can access them, and whether the provider uses subcontractors. It is investor education, not a rule for business custodians. Likewise, the federal banking agencies’ July 14, 2025 statement concerns safekeeping by banking organizations; it says safekeeping must be safe, sound, and lawful, and creates no new supervisory expectations. It is not a general licensing rule for every crypto custodian. Read the SEC bulletin on crypto-asset custody basics and the agencies’ statement on crypto-asset safekeeping.

Check that the service can run your payment and treasury workflows

Walk through a real transaction from start to finish: funding, internal approval, signing, network confirmation, receipt by the counterparty, any needed conversion, accounting entry, and reconciliation. Confirm support for the exact asset-and-network combination used by the recipient. A provider supporting a token on one network may not support that token on another, and the two routes should not be treated as interchangeable.

Ask how the provider handles mistaken addresses, network congestion, delayed or rejected withdrawals, and service outages. Verify supported deposit and withdrawal paths, approval and allowlisting steps, operating windows, reconciliation outputs, and integrations. For each part of the flow—custody, execution, fiat conversion, liquidity, and settlement—establish which entity performs it and which entity is responsible when something goes wrong. The sources do not establish a universal settlement-time or service-level benchmark, so assess the provider’s documented commitments against your own operational needs.

If stablecoins are part of the plan, do not infer that a token’s target value makes it risk-free or equivalent to bank money. The UK Financial Conduct Authority describes qualifying stablecoins as cryptoassets seeking stable value by referencing one or more fiat currencies and notes potential payment and cross-border settlement efficiencies. Its CP25/14 page says final rules and guidance on qualifying stablecoin issuance and cryptoasset safeguarding were published on June 30, 2026, and apply to firms authorized under FSMA on or after October 25, 2027. These dates and rules are UK-specific; check the current position and the provider’s status directly before relying on them. See the FCA’s CP25/14 page.

Get written answers on insurance, fees, and service evidence

Insurance

Ask whether insurance applies to your specific custody arrangement and request the policy details. Establish which assets and loss events are covered, who is insured, what limits and sublimits, exclusions, and deductibles apply, how claims work, and whether the customer has direct rights. Record the answers in writing. A general statement that a provider is “insured” does not establish that your assets or the loss scenario you care about are covered. The SEC bulletin advises readers to ask whether insurance exists and understand its terms; it does not promise a standard amount or level of cover.

Fees

Request the full fee schedule and model it against expected balances, transaction counts, transfer frequency, and conversion needs. The SEC bulletin identifies possible annual asset-based, transaction, transfer, setup, and account-closure fees. Ask which apply to your contract, how they are calculated, and whether any other charges apply to the services you need.

Operational and financial evidence

Check customer support and incident escalation channels, relevant financial and operational disclosures, complaints, and material service dependencies. Review the scope and date of any audit or control report rather than treating the existence of a report as proof that the whole arrangement is suitable. A license, bank affiliation, or insurance statement also does not replace diligence on the contract, controls, and workflow.

Understand what the jurisdictional sources do—and do not—establish

United States The July 14, 2025 federal banking-agency statement concerns safekeeping by banking organizations. The OCC’s May 7, 2025 release says national banks and federal savings associations may provide crypto custody and execution and outsource permissible activities subject to appropriate third-party risk management. Whether the provider’s actual legal entity and service have the relevant status. These bank materials do not establish the status of a nonbank custodian or the suitability of a particular provider.
Switzerland FINMA’s January 12, 2026 announcement highlights custody technology risks and legal complexity when assets are held abroad, especially in insolvency. The custody location, applicable law, subcontracting chain, and treatment of customer assets if a provider fails.
United Kingdom The FCA’s CP25/14 page reports final rules and guidance published June 30, 2026, with stated application to firms authorized under FSMA on or after October 25, 2027. The current implementation position and the provider’s authorization and service scope. The stated timing is UK-specific.

Use a consistent decision process

  1. Write the requirements sheet. Define the company entity, relevant countries, assets and networks, transaction patterns, payment counterparties, required service functions, internal roles, integrations, and recovery expectations.
  2. Map the legal and custody chain. Obtain the contracting and custody entity names, custody location, subcontractors, governing law, client-record approach, and contract terms covering provider failure. Have counsel assess the structure for your jurisdictions.
  3. Review controls and recovery evidence. Get written explanations of key access, transfer authorization, authentication, anomalous-instruction handling, incident communications, continuity, and tested recovery.
  4. Walk a representative payment through the service. Validate the exact asset and network, each transfer path, approvals, service windows, conversion or settlement dependencies, reconciliation, and failure handling.
  5. Compare written commercial terms. Model applicable fees against your likely balance and transaction pattern, and document insurance coverage and exclusions as well as support and escalation commitments.
  6. Make the decision against your requirements, not a label. A provider that cannot support essential workflows or whose legal, operational, or cost terms remain unclear is not a fit merely because it advertises institutional custody.
