You cannot determine whether an Nvidia GPU or AI server may be shipped by checking the destination or product name alone. For a U.S. Export Administration Regulations (EAR) review, you need the exact item and transaction details: confirm whether the item is subject to the EAR, establish its current classification, apply the relevant destination and end-use controls, screen the parties, and determine whether a license or license exception is required. If a license is required, it must be obtained before shipment.

This guide covers the U.S. EAR workflow, including exports, reexports, and in-country transfers. Other countries’ export laws, sanctions, import rules, and contractual restrictions may also apply. The examples below reflect BIS materials available as of October 4, 2026; regulations and guidance can change.

Why the destination and GPU name are not enough

“Nvidia GPU” is not an export classification. The exact model, configuration, technical capability, and—in the case of a server—its incorporated components can affect the analysis. The item’s Export Control Classification Number (ECCN) identifies the reasons for control that must be assessed against the destination and other applicable rules.

Nor does a country-chart result decide the whole transaction. Restrictions can also depend on the purchaser, ultimate consignee, end user, ownership, intended use, hosting arrangement, and risk of diversion. BIS does not provide a single product-family-to-destination matrix that replaces this item-specific review.

What to collect before checking the rules

  • Item: Exact GPU model and configuration; server model; incorporated components; and relevant technical specifications.
  • Movement: Exporter or reexporter, shipment route, destination, and any planned onward movement or in-country transfer.
  • People and organizations: Purchaser, ultimate consignee, end user, intermediaries, relevant owners or parent companies, and any organization that will operate or host the equipment.
  • Use: What the equipment will do, who will operate it, whose work it will support, and whether installation, remote operation, or hosted compute is involved.

These details are inputs to the review, not a substitute for confirming jurisdiction, classification, and authorization.

How to check exportability under the U.S. EAR

  1. Define the complete transaction

    Record the item, route, parties, ownership relationships, and actual intended use. Include installation, remote operation, hosting, and onward movement where relevant. The EAR distinguishes exports, reexports, and in-country transfers, and controls may attach to parties or uses as well as destinations.   2. Confirm whether the item or activity is subject to the EAR

    Determine whether the hardware, software, technology, or activity is subject to the EAR and whether another U.S. agency has jurisdiction. U.S.-origin goods commonly remain subject to the EAR after moving abroad, and some foreign-made items can also be subject to it. A non-U.S. warehouse or shipping origin alone does not settle the question. BIS’s About Licensing describes the licensing framework.

  3. Establish the current ECCN for the exact item

    Ask the manufacturer or producer for the ECCN and supporting technical information. Check that the classification applies to the precise model and configuration; BIS cautions that ECCNs can change. A technically qualified reviewer can compare the item with the current Commerce Control List (CCL), or the exporter can request an official classification from BIS through SNAP-R. BIS’s Classify Your Item page and Interactive Commerce Control List are starting points; inspect the technical entry rather than relying on a keyword match. The interactive CCL page was current from eCFR as of October 3, 2026.

  4. Apply destination controls to the ECCN

    For each reason for control listed in the ECCN, check the Commerce Country Chart and then review the relevant EAR provisions, country groups, special destination rules, and any potentially available license exceptions. BIS’s EAR Part 738 and Country Guidance explain this process. The chart alone is not a complete analysis: a favorable chart result does not clear other applicable controls.

  5. Screen all relevant parties

    Screen more than the buyer’s name. Consider the purchaser, ultimate consignee, end user, intermediaries, relevant owners, and organizations involved in deployment or hosting. Investigate potential name matches; similarity is neither automatic disqualification nor automatic clearance.   6. Review end use, end user, and hosted AI compute

    Establish who will operate the equipment and whose work it will support. Some end-use and end-user controls can require authorization regardless of the ordinary country-chart result. BIS’s May 13, 2025 guidance on advanced-computing items also addresses covered items supplied to infrastructure-as-a-service providers when the exporter knows they will be used for AI training for or on behalf of parties headquartered in Country Group D:5 or Macau.

  7. Check advanced-computing rules and parent-company location

    BIS guidance dated May 31, 2026 says a license requirement continues for specified advanced-computing items exported to entities headquartered in Country Group D:5 or Macau, or whose ultimate parent is headquartered there, even when the recipient is located elsewhere. The guidance directs exporters to seek a license unless a specified exception is available. Accordingly, assess the recipient’s headquarters and ultimate parent, not only the ship-to address.

  8. Document the authorization decision before shipment

    If a license is required, determine the applicable review policy and submit the required application through SNAP-R. If relying on a license exception, document why the transaction qualifies and satisfy all applicable conditions before shipment. A policy allowing an application to be reviewed is not itself an authorization. BIS’s About Licensing and Export Compliance Resources provide further guidance.

What the China H200 review policy does—and does not—mean

On January 13, 2026, BIS announced that it would review applications to export Nvidia H200, AMD MI325X, and similar chips to China case by case if specified requirements are met. The announcement identifies conditions including evidence that exports would not reduce semiconductor capacity available to U.S. customers, compliance procedures and customer screening by the Chinese purchaser, and independent third-party testing in the United States.

This is a review policy, not blanket permission and not a finding that every model, buyer, or transaction qualifies. Check the operative regulation and current BIS guidance before relying on it. The announcement attributed this statement to Under Secretary for Industry and Security Jeffrey Kessler: “Export controls should evolve with changes in technology, while protecting national security.”

How to make a practical go/no-go decision

  • Do not decide from a country list or model name. Neither supplies the complete classification and transaction analysis.
  • Keep the evidence together. Preserve the item specifications and classification basis, destination-control analysis, party-screening results, end-use information, and the basis for any claimed exception or license.
  • Pause when a material fact is unresolved. If the ECCN, party identity or ownership, end use, or exception eligibility is uncertain, do not treat the shipment as cleared. Confirm the current rule and obtain qualified export-control advice where needed.
  • Recheck when facts or rules change. A different configuration, recipient, parent company, host, use, route, or onward transfer can change the analysis; so can a regulatory or classification update.

No universal percentage of Nvidia GPUs or AI servers that can be exported follows from the cited BIS material. The outcome depends on the item and transaction facts and the rules in effect when the transaction is assessed.
