Build your home arcade library around authorized re-releases and compilations, and check that each exact game is offered for your platform in your local official storefront. In the United States, owning an arcade board, cabinet, or one copy of a game does not by itself give you permission to download or make additional copies of its software. Emulator software and game files have separate rights, and narrow backup and preservation rules are not a general home-user license for unavailable games.
Start with the games, then choose where to play them
Make a short wishlist of the specific coin-op games you want rather than starting with a console or emulator and assuming it will have the titles you remember. Arcade libraries vary by release and platform, so confirm each game individually in the official storefront for your region.
- Write down the exact titles. Include the version or subtitle if it matters; similar names do not establish that a particular arcade release is included.
- Search official stores and publisher catalogs. Look for a publisher-authorized re-release or a licensed compilation on a system you already own.
- Confirm the listing. Check the exact game, platform, local availability, and whether the offer is a standalone release or part of a compilation.
- Compare how you want to play. Consider the purchase format and control setup, as well as whether buying another platform just for a small number of games makes sense for you.
- Keep a record of what you bought and where. A storefront purchase or licensed physical release gives you a clearer basis for playing than a ROM file whose source and authorization are unknown.
HAMSTER’s official Arcade Archives catalog illustrates why title-by-title checking matters. Its September 24, 2026 listing for Arcade Archives 2 XEVIOUS 3D/G shows Nintendo Switch 2, PlayStation 5, and Xbox Series X|S. That is evidence for this release on those platforms, not proof that every game in the series—or the broadest overall arcade catalog—is available on all three.

Compare options by the exact release, not by platform reputation
There is no established overall winner for a home arcade library here. Use this comparison to narrow the search, then verify the particular title in your regional store.

What U.S. copyright rules mean for a home collection
This legal overview is specific to U.S. federal sources and is not legal advice. The U.S. Copyright Office describes copyright owners’ exclusive rights as including reproduction, distribution, preparation of derivative works, and certain public performances and displays. Buying a cabinet, board, or retail copy is not, on its own, permission to reproduce the game or obtain its ROM from an unrelated website. The Copyright Office identifies purchase or license, applicable statutory exceptions, and public-domain status as distinct routes relevant to using protected works.
Owning a copy is not the same as owning reproduction rights
Title 17, Section 109 generally concerns disposition of a particular lawfully made copy, subject to statutory limits. It does not generally authorize creating another copy. Section 110(e) has a specific rule for certain public performances or displays of a particular lawfully made game copy in coin-operated equipment, with an express limitation when another work embodied in the game has a different copyright owner. These narrow provisions do not make arbitrary ROM downloads lawful.

Software archival copies have conditions
The Copyright Office’s software FAQ explains that Section 117 permits an archival copy of a computer program only under stated conditions: the person must be the legal owner, the copy must be made only for archival purposes, and it must be destroyed or transferred along with the original when the original is transferred. The FAQ also says this provision does not cover other copyrighted works on the computer and advises checking the software’s sale or license terms. It is not a blanket authorization to download a game from a third party.

The Copyright Office’s current 37 CFR 201.40 page describes narrowly defined video-game exemptions. One addresses certain lawfully acquired complete games whose required external server authentication service has ceased, for restoring local gameplay. Another addresses preservation by qualifying libraries, archives, or museums under stated conditions, including limits on access outside institutional premises. These exemptions do not create a general personal-use right to download a game that is no longer sold.

Emulator licensing and game-content rights are separate
MAME’s official legal page identifies its source code as licensed under GPL version 2 or later for the release covered there. That license concerns the emulator code; it does not grant rights to a game’s program, graphics, sounds, or ROM data. Assess authorization for the game content separately.

- Is this the exact game? Confirm the title and edition in the official regional storefront or the publisher’s catalog.
- Is it offered for your system? A release on one console does not establish availability on another, even for games in the same series.
- Is the seller or source authorized? For digital releases and compilations, use the publisher or official storefront. For a physical copy, do not assume the sale includes rights to make extra copies.
- Are the emulator and game file being assessed separately? A permissive emulator license does not answer whether a particular ROM is authorized.
- Are you relying on a backup or preservation exception? Read the actual statutory conditions and applicable license; do not treat a narrow exception as a general ROM-download permission.
Catalogs and storefront availability can change. Recheck official listings before purchasing, especially if you are choosing a new system for a particular release.
