Assess employer-provided housing on two separate tracks: whether the home meets the safety rules that apply to it, and whether the cost and connection to your job are fair. The right rules depend on where the housing is, what kind of work you do, and whether your employer requires or controls the accommodation. A checklist can help you spot concerns, but it cannot establish compliance for every home or jurisdiction.

First identify which rules and employment factors apply

Before judging a property, write down its country, state or province, and locality; your worker category or program, if known; who owns or controls the property; and whether living there is required. Note realistic alternatives, including their cost, distance from work, and transportation access. These details affect both the applicable housing standards and how closely the accommodation is connected to your job.

For U.S. H-2A rental or public accommodation, the U.S. Department of Labor describes a concern-by-concern fallback: local standards apply first; where local standards omit a listed essential concern, state standards apply to that issue; and OSHA standards may apply where neither local nor state rules cover it. Covered employer-provided H-2A housing has applicable standards of its own. This is a program-specific framework, not a rule for every employer-provided home.

OSHA’s temporary labor camp standard, 29 CFR 1910.142, concerns temporary job-related housing for workers away from a permanent location. OSHA’s 1981 interpretation gives agriculture and remote oil drilling as examples; its Field Operations Manual also discusses temporary labor camps in agricultural and non-agricultural settings. Check the current local code and enforcement approach before relying on a particular standard.

To assess whether housing is a term or condition of employment, OSHA’s Field Operations Manual lists factors including whether residence is required, the employer’s ownership or control, housing cost, isolation, availability of economically comparable alternatives, distance to work and other housing, and employer benefit. These are enforcement-guidance factors, not a conclusive test for every legal issue.

Inspect the conditions you can observe

Make a dated, room-by-room record. Where it is safe and lawful, take photographs and keep copies of inspection reports, written notices, and messages about repairs. Use the following prompts, then compare any concern with the standards that apply locally or to your program.

Site and shared spaces

  • Look for flooding, poor drainage, standing water, rubbish, or signs of overcrowding.
  • Check whether common areas and routes through the home are clean and usable.

Sleeping and living space

  • Record the number of occupants, usable floor space, beds, storage, and any separation between sleeping areas.
  • Look at floors, windows, and ventilation, and note whether occupants can use the space safely and privately.

Water, sanitation, and food

  • Check access to water and sanitary facilities, and whether there is suitable space and equipment for food storage and preparation.
  • Confirm the locally applicable requirements for drinking water, bathing, laundry, and toilets rather than assuming one checklist covers them all.

Heating, cooking, and emergencies

  • Where needed, check for adequate heat and safe installation of heating, cooking, and water-heating equipment.
  • Check cooking arrangements and the alarms and other fire or emergency measures required by applicable rules. Existing equipment or buying an alarm does not, by itself, establish compliance.

For the defined settings covered by the U.S. Department of Labor’s 2022 fact sheet summarizing 29 CFR 1910.142, the listed standards include 50 square feet of sleeping-room floor area per occupant, a seven-foot ceiling, and beds at least 36 inches apart and at least 12 inches off the floor. The same fact sheet describes a site-distance rule of at least 200 feet from certain standing-water features unless they are treated for mosquito control. These are standards for specified covered settings, not universal measures for every employer-provided home; confirm that the rule applies before using a number to judge a property.

Check whether the arrangement is fair in practice

Read the written offer, job order or contract, occupancy terms, and pay statements together. Record rent, deposits, utilities, deductions, transportation costs, who receives the housing payment, guest and privacy rules, and what happens to the accommodation if your employment ends. Compare the written terms with what you are actually charged and allowed to use.

Ask whether you can decline the housing without pressure, whether it is effectively required to keep the job, and whether a comparable alternative is genuinely accessible by cost, distance, and transport. Employer control, isolation, cost, and the availability of alternatives are among the factors OSHA lists when considering the housing’s connection to employment; none alone answers every legal question.

Do not confuse a wage credit with every housing charge

For the limited U.S. Fair Labor Standards Act section 3(m) question of whether lodging may count toward wages, Department of Labor guidance says the employee must accept the lodging voluntarily and without coercion for the employer to claim the credit. Lodging that violates federal, state, or local law cannot be counted as wages for that credit; the Department’s examples include a missing required occupancy permit or lack of residential zoning. This guidance does not decide every rent deduction, lease, or housing dispute.

Keep international principles in context

A Department of Labor-hosted summary of ILO Workers’ Housing Recommendation No. 115 says employer housing is generally not desirable unless needed, for example when work is far from home. Where employers provide it, the summary says housing should be decent and reasonably priced relative to income, preserve fundamental rights including freedom of association, and not be provided as payment for work. This is a summary of an international recommendation, not automatically binding domestic law.

Decide what to do about a hazard or unfair term

If there is immediate danger

Contact emergency services or the appropriate local fire, health, or housing authority if a condition poses an immediate danger. For other concerns, keep your dated notes and records and seek help from the labor agency, housing inspector, union, worker center, legal-aid provider, or another qualified local organization that understands your location and status.

If you are covered by H-2A protections

The Department of Labor says covered H-2A employers may not threaten, coerce, discriminate against, or retaliate against workers for exercising their rights or participating in an investigation. The correct agency and available remedy depend on your circumstances and legal coverage.

Compare housing options using the same evidence

If you have more than one realistic option, compare each against the same criteria rather than treating a low rent or an inspection document as a complete answer:

  • Applicable legal standard and any inspection or certification evidence.
  • Safety and sanitation, including water, heat, ventilation, and emergency provisions.
  • Crowding, privacy, and access to facilities.
  • Total cost after rent, deposits, utilities, deductions, and transportation.
  • Whether residence is a condition of the job and whether alternatives are practical.
  • Whether you can report hazards or leave without coercion or retaliation.
