Healthcare AI can use information from a patient’s record alongside medical knowledge to produce summaries, alerts, diagnostic support, or other decision support. Records may also be analyzed to study treatment histories and outcomes. In the United States, privacy protections depend on what information is used, why it is used, which organizations handle it, and what safeguards and oversight apply—not simply on whether a tool is described as AI.

How healthcare AI systems use medical records

Clinical decision support (CDS) is a broad category of digital tools that provides timely, person-specific information to support care. The U.S. Office of the National Coordinator for Health Information Technology (ONC) describes systems that combine patient information with computer-usable medical knowledge. They may be built into an electronic health record (EHR) or offered separately.

Depending on the tool and its intended task, the output may include:

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.
  • A summary of information in a patient’s record
  • Diagnostic support or clinical reference material
  • Alerts, guidelines, or order sets
  • Documentation templates

AI can also analyze records containing treatment histories and outcomes to help inform care plans for people with similar conditions. That does not mean every AI tool trains on identifiable patient records. Whether a particular system uses data for training, retains what it processes, or sends it to another organization depends on how that system is deployed and its terms and technical configuration.

Why data quality and workflow matter

An AI output is shaped by the information available to the system. NIST’s healthcare AI overview explains: “Data is the fuel, and AI is the engine. Data quality is the key to AI because the accuracy, reliability, and relevance of the outputs generated by these systems are directly dependent on the quality of the data that they are trained on; essentially, ‘garbage in, garbage out’.” In practice, incomplete, inaccurate, outdated, or irrelevant information can affect what a system returns.

Safe use is also an organizational and workflow issue. ONC’s SAFER Guides address AI-enabled EHR systems used in administration, diagnosis, treatment, and care management, as well as configuration, validation, maintenance, APIs, patient identification, and CDS. A system’s output needs to fit the real clinical process, including how clinicians review and use it; a privacy notice or a model’s design alone does not establish that the deployment is safe.

When HIPAA applies—and what it does not mean

This explanation uses the United States as its legal frame. HIPAA is not a worldwide privacy law, and its application depends on the organization, the information, and the purpose involved. The HIPAA Privacy Rule applies to health plans, healthcare clearinghouses, and healthcare providers that conduct certain electronic transactions. Relevant HIPAA requirements also apply to business associates handling protected health information (PHI) for covered entities.

The Privacy Rule sets limits and conditions on uses and disclosures of individually identifiable health information. It permits some uses or disclosures for treatment, payment, and healthcare operations under specified conditions. Some exchanges can occur without a specific authorization when those conditions are met; other uses or disclosures may require authorization or be subject to additional rules. There is no single consent rule that covers every AI-related use.

HIPAA does not automatically govern every health app or technology company. Businesses outside HIPAA may still be subject to other protections, including the Federal Trade Commission Act and, in some cases, the FTC Health Breach Notification Rule. The FTC Act also bars deceptive or unfair representations about consumer health information. A company’s lack of HIPAA coverage does not by itself mean that no privacy protections apply.

What safeguards can protect records used by AI?

ONC describes safeguards under the HIPAA Security Rule that may include access controls such as passwords or PINs, encryption, and audit trails recording who accessed information and what changed. Healthcare organizations can also use security risk assessments to identify and manage risks. These measures can reduce risk, but no single control guarantees that a system or record is secure.

The HIPAA minimum-necessary rule generally requires covered entities to take reasonable steps to limit PHI uses, disclosures, and requests to what is needed for the purpose. Its application depends on context, and broader access may be appropriate in circumstances such as treatment. It should not be read as a universal technical requirement that every AI system can receive only the smallest possible snippet of a record.

Can records be de-identified before AI uses them?

HIPAA recognizes two methods for de-identification: Safe Harbor and Expert Determination. De-identification is intended to make information no longer individually identifiable under the HIPAA standard. HHS cautions that the risk of re-identification is very small, not zero. Whether a particular AI use involves identifiable or de-identified information is a system-specific question.

Computer Privacy Screen Filter for 24 Inch 16:9 Aspect Ratio Monitor
  • Privacy Screen Filter Size: If the visible area of your display has the following dimension: Width x Height (Exclude Frame/Arrow 1 to 3 mm errors): 20 15/16" x 11 13/16" (532 mm x 299 mm), then this filter is good for you. Very Important to double check your screen's Width and Height excluding frame before ordering. It's not recommended to make your selection based solely on your screen's diagonal size
  • Left and Right Privacy: Not block visibility directly behind you, regardless of distance. The privacy filter makes the screen appear dark when looking at it from an angle (left and right 30 to 180 degree), but clear when looking directly at it. To change the privacy levels, simply adjust your monitor's brightness level accordingly
  • Matte and Glossy Sides: It's a reversible privacy screen filter, giving you the flexibility to choose glossy or matte finish. The matte side will have less glare, however the glossy side will have stronger privacy
  • Perfect for Open Workspaces: Ensure your working space is bright and well lit. Privacy screens do not work in dimly lit areas
  • Two Installation Option: Option 1 uses clear double side adhesive strips that securely attach to any computer screen. Option 2 (for computer screens with a raised bezel only) uses slide mount tabs that easily stick to the display frame, allowing you to take out the privacy screen filter easily as needed

What rights do patients have to records?

People generally have a right to access PHI in designated record sets maintained by or for a HIPAA-covered entity. This can include relevant records held by a business associate on the entity’s behalf, subject to limited exceptions. Patients may generally obtain copies and, under the Rule’s conditions, request amendment of information they believe is inaccurate or incomplete.

Questions to ask a provider or AI company

If you want to understand how a particular tool handles information, ask questions tied to its actual use:

  • What records or data fields does the tool use for this function?
  • Does it process identifiable information, or information de-identified under a recognized method?
  • Which organization operates the AI, and is it acting for a HIPAA-covered provider or health plan?
  • Is information retained, reused, or disclosed beyond the immediate care purpose? If so, on what basis?
  • Who can access the data, and what access controls, encryption, and audit logging are in place?
  • How does the organization validate and monitor the system, and how does its output fit clinician review and decision-making?

The answers should describe the specific tool and deployment. General statements about AI or HIPAA cannot establish how a particular system handles data.

How to compare healthcare AI systems

For two or more tools intended for clinical or administrative use, compare their documented practices and purpose rather than relying on the AI label alone.

What to compare What to establish
Clinical task and intended users What the system is designed to do and who is expected to use its output.
Inputs and record scope Which patient-specific information the function uses and whether it needs identifiable data.
Use, retention, and disclosure Whether information is retained, reused, or disclosed beyond the immediate function, and the basis for that handling.
Safeguards and oversight Who can access information, which controls are used, and how the organization validates and monitors the system.
Data quality and timeliness Whether information is accurate, relevant, reliable, and current enough for the task.
Clinical workflow How outputs reach clinicians, how they are reviewed, and how the system is maintained in the organization’s workflow.

Public guidance establishes useful questions about purpose, data handling, safeguards, and oversight, but it does not rank specific vendors. A comparison of named products requires documentation about those products and their particular deployments.
