Data center tax incentives can lower the cost of building AI infrastructure by reducing taxes on qualifying purchases—such as construction materials, servers, software, or other equipment—or by providing property-tax relief. They do not automatically discount every project expense. The actual benefit depends on where a facility is built, which costs qualify, whether the project meets the rules, and how long it complies.
What a tax incentive actually reduces
A sales- or use-tax exemption reduces tax on specific eligible purchases; a property-tax abatement reduces taxes on qualifying property under its terms. These are different tax bases, and a program may cover one, several, or only part of them. A project’s AI purpose does not, by itself, make every expense eligible: the facility and purchases must meet the jurisdiction’s definitions and conditions.
For example, Texas’s ordinary qualifying-data-center route temporarily exempts qualifying purchases from the 6.25% state sales tax, while local sales and use taxes remain due. If a project made $1 million in purchases that all qualified under that route, the state-tax portion avoided at that rate would be $62,500; that illustration excludes local tax and does not imply that all construction spending qualifies. The applicable tax treatment depends on the purchase and program rules.

That distinction matters because a facility budget also includes costs that may not be in an incentive’s tax base, such as labor, land, utility interconnection, power supply, and financing. A project model should calculate tax relief against eligible purchases or property—not apply a blanket percentage to total construction cost. No universal percentage reduction in the total cost of building an AI data center is established by the cited state-program examples.

How state programs differ
Official state materials illustrate why an incentive’s headline description is not enough to estimate its value. The eligible costs, entry requirements, duration, and current availability can all differ.
| Jurisdiction and source | What the cited program material establishes | What to check for a project |
|---|---|---|
| Texas, ordinary qualifying-data-center guidance | At least 100,000 square feet, a commitment to invest at least $200 million over five years, and at least 20 qualifying jobs in the county. The exemption applies to necessary and essential purchases and covers the 6.25% state sales tax; local sales and use taxes remain due. | Certification and registration, the exemption certificate for covered purchases, whether each purchase qualifies, and local tax treatment. |
| Texas, qualifying large data-center projects | The state describes a 20-year exemption whose term depends on investment, with a five-year review of investment and job creation. | How the project’s investment affects the term and what the review requires. This is a separate route from the ordinary qualifying-center thresholds above. |
| Minnesota, data-center exemption guidance | New data centers need at least 25,000 square feet and at least $30 million invested within 48 months, along with specified facility characteristics. The guidance describes a 35-year exemption for enterprise IT equipment and software used to operate qualified data centers. | Whether the facility meets the other stated characteristics and which purchases qualify under current rules. Electricity purchases ceased to qualify beginning July 1, 2025. |
| Alabama, Chapter 9B guidance | The state describes sales-tax and property-tax abatements for eligible projects, including a data-processing-center provision that allows a longer potential property-tax abatement period subject to conditions. | Which abatement applies, what the project must do to qualify, and the conditions attached to any extended property-tax period. |
| Massachusetts, data-center guidance | The state describes an exemption for eligible expenditures and requires a cost-accounting report documenting actual eligible expenditures. | Which expenditures are eligible and what records are required to substantiate them. |
| Illinois, DCEO program page and regulatory text | Illinois DCEO says it stopped processing applications for its data-center program beginning July 1, 2026. Regulatory text says property used in construction or operation must remain in qualifying use; conversion to nonexempt use or relocation to a nonqualified location can make it taxable. | Application availability for the project date and location, the current rules, and the tax consequences of changed use or relocation. |
The Texas, Minnesota, Alabama, Massachusetts, and Illinois terms above come from state program or regulatory materials. A summary of those terms is not a substitute for checking the rules that apply to a particular project and purchase.

How to estimate a project’s potential savings
- Define the project and location. Identify the state, county, municipality, facility footprint, planned investment schedule, and job commitments. Some routes set minimum facility size, investment, or job requirements.
- Build a cost schedule by tax category. Separate construction materials, servers and other IT equipment, software, electricity, real and personal property, labor, land, interconnection, power supply, and financing. Do not assume an incentive covers a category unless the governing program says so.
- Apply the tax rules only to qualifying costs. For each purchase or property category, establish the relevant state and local tax treatment and whether the project satisfies the program’s definitions. An exemption from state tax does not necessarily remove local tax.
- Model timing and duration. Match eligible purchases to the construction and operating schedule. Account for the incentive’s term, sunset, application cutoff, and any different treatment for electricity or replacement equipment.
- Include compliance costs and risk. Track certification, registration, exemption certificates, cost-accounting reports, audits, investment and job commitments, continuing-use requirements, and potential tax recapture. Estimate a benefit only for periods and purchases the project can document and keep eligible.
- Compare net tax relief, not headline labels. Calculate the tax avoided on each eligible cost, then account for local taxes, program conditions, reporting, and any repayment exposure. Compare jurisdictions using the same project schedule and cost categories.
Why eligibility and compliance change the economics
Meeting an entry threshold is only one part of the calculation. Texas’s ordinary route requires certification and registration, plus an exemption certificate for covered purchases; its large-project route includes a five-year review of investment and job creation. Those obligations can affect whether a project qualifies and remains eligible.
Do these 3 things before closing this tab:
1Scan for outdated or missing drivers - takes under a minute2Clear out junk files and repair common Windows errors3Fix the driver behind crashes, sound loss and screen glitchesOther rules affect both the cost base and the useful life of the incentive. Minnesota’s stated 35-year exemption covers enterprise IT equipment and software used to operate qualified data centers, but electricity stopped qualifying on July 1, 2025. Massachusetts requires cost accounting of actual eligible expenditures. In Illinois, property that leaves qualifying use or moves to a nonqualified location can become taxable under the cited regulatory text. Program terms and application status should therefore be checked for the project’s jurisdiction and date before the benefit is included in a financing model.

What the available figures do—and do not—show
A count of programs is not a measure of savings. A 2026 Alaska Legislature document states that 38 states offer dedicated data-center incentives. That is a dated count in a legislative document, not a timeless inventory, and it does not establish that the programs offer comparable benefits.
Fiscal revenue figures also should not be mistaken for tax relief granted to developers. The Georgia Department of Audits and Accounts’ December 2025 summary reports FY 2025 tax revenue of $34.6 million from data-center construction and $6.9 million from data-center operations. Those are revenue amounts, not estimates of project savings or net public benefit.

The cited official materials show how selected state programs work, but do not provide a nationally comparable project-level estimate of net savings or a percentage by which incentives reduce total AI data-center construction costs. A meaningful location comparison requires a project’s state shortlist, eligible purchase mix, construction schedule, and local property-tax assumptions.
