Courts limit executive action through law, parliaments scrutinize government decisions, and independent media bring public attention to what government does. They are complementary checks, not interchangeable institutions: their powers and practical effectiveness vary by country.

How do courts limit executive power?

Courts can assess whether government action complies with the constitution and other applicable law. Depending on a country’s legal system, a court may hear challenges brought by individuals or groups, determine whether a government decision is lawful, and provide a remedy. The scope of review and available remedies are set by each jurisdiction; courts do not have identical powers everywhere.

South Africa offers a specific constitutional example. Section 165 says: “The courts are independent and subject only to the Constitution and the law, which they must apply impartially and without fear, favour or prejudice.” The Constitution also bars interference with the courts’ functioning. Under section 167, the Constitutional Court has final authority on specified constitutional matters; section 172 sets out powers courts may use when deciding constitutional issues. Parliament of South Africa describes courts as a way for individuals and groups to test and enforce their rights. This gives people a route to challenge government conduct, though bringing a case and obtaining a remedy depend on the applicable law and circumstances. How does Parliament hold the government to account?

Parliamentary scrutiny is political and public as well as procedural. In the UK, Parliament identifies questions to ministers, debates, and committee investigations as principal ways MPs and peers scrutinize government. Ministers are expected to explain and defend policies and decisions publicly. UK Parliament: Government scrutiny.

  • Questions give legislators opportunities to ask ministers about government actions and choices.
  • Debates put policies and decisions before parliament for public discussion.
  • Committee investigations allow focused examination of government activity.

These methods describe the UK example, not a universal parliamentary procedure. The authority to investigate, obtain information, or compel cooperation—and the staff, time, and expertise available to use that authority—differ among legislatures. A formal power matters only insofar as members can exercise it in practice.

Why does independent media matter in a democracy?

Independent media can make government conduct visible to the public by reporting on decisions, scrutinizing official explanations, and covering contentious issues, including corruption. The Council of Europe says editorial decisions should not be influenced by governments, regulators, commercial interests, or media owners, and that media should not be prevented from covering such issues. Media are not a formal branch of government. Their checking role depends on the ability to make editorial decisions freely and report without being blocked. Legal protections, political conditions, and ownership influence can all shape that independence; the Council of Europe principles do not establish that every country provides the same protections.

How do the three checks work together?

The institutions can reinforce one another without doing the same job. Reporting can bring a government action to public attention; legislators can question ministers or investigate it; and courts can decide a legal challenge where the issue falls within their jurisdiction. Parliamentary scrutiny and media coverage are not substitutes for a court’s legal judgment, and a court’s ruling does not replace legislative oversight or public reporting.

The relationship between courts and legislatures can itself be debated. In a UK government speech, the Lord Chancellor said: “Judicial review is of course a vital check on unbridled power, and it is precisely for this reason that we should review how it operates – to ensure that there remains that essential balance between Parliament and our courts.” This is the perspective expressed in that speech, not a universal rule governing the relationship between courts and parliaments. What determines whether these checks are effective?

Constitutional text and formal authority do not, by themselves, show how much accountability works in practice. A comparison between countries needs to consider the actual legal scope and remedies of judicial review, the legislature’s powers and capacity to investigate or secure information, and the legal, political, and ownership conditions that protect editorial independence. It also matters whether government respects court decisions.

South Africa’s constitutional provisions illustrate one explicit model of judicial independence and constitutional authority; UK parliamentary materials illustrate particular scrutiny methods and a debate about judicial review. These examples do not establish a comparable global ranking of effectiveness. The sound comparison is between the powers each system grants and the conditions that let its institutions use them.
