Congressional elections happen every two years. Voters elect all 435 voting members of the House of Representatives and the senators whose six-year terms are expiring—roughly one-third of the 100 Senate seats. The two chambers are elected on different schedules and represent people differently, so the party that controls the House is not necessarily the party that controls the Senate.

How the House and Senate differ

The House and Senate are the two chambers of Congress, but they do not distribute seats or hold elections in the same way.

Chamber Seats What seats represent Term Regular election cycle
House of Representatives 435 voting seats Seats are apportioned among states by population; each state has at least one representative. Two years All seats are contested every two years.
Senate 100 seats Each state has two senators, regardless of population. Six years Approximately one-third of seats are contested every two years.

These totals and term lengths are described by USAGov and the U.S. Constitution. The House’s 435 voting seats are distributed among states according to population; the number assigned to a state can change as its share of the national population changes. Federal law provides for representatives to be elected from districts in states with more than one representative.

Why the House is elected all at once but the Senate is not

House: every seat is up every two years

The Constitution provides for representatives to be chosen every second year. As a result, all 435 voting House seats are contested in each regular congressional election. A representative elected in November begins the term on January 3.

Senate: six-year terms are staggered

Senators serve six-year terms, arranged in three groups, or classes. The classes are staggered so that roughly one-third of the Senate is elected every two years. Most senators therefore continue serving after any one regular election, while the entire House faces voters.

The Constitution originally assigned the choice of senators to state legislatures. The Seventeenth Amendment changed that system to direct election by voters. The Senate says the amendment was ratified in 1913 and the first popular Senate elections took place in 1914. See the Senate’s constitutional history and history of direct Senate elections.

When congressional elections happen

Federal law sets elections for Representatives and Delegates on the Tuesday after the first Monday in November in every even-numbered year. The terms of incoming members begin January 3. Congressional elections take place on the same general schedule as presidential elections in presidential years, but they are separate contests: a presidential result does not determine which party wins either chamber.

Practical voting procedures—including registration, early voting, absentee ballots, and counting—are governed by state and local rules. For a particular state’s deadlines and options, consult its election office; USAGov’s election guide directs voters to state-specific information.

What “control of Congress” means

Control is determined separately in each chamber. The party affiliation of House members determines which party has a House majority; senators’ party affiliations determine which party has a Senate majority. One party may control both chambers, or the House and Senate may have different majority parties. The phrase “control of Congress” is therefore clearer when it specifies House control, Senate control, or both.

To identify control after a particular election, use current official results rather than assuming the outcome from the presidential race or from older reporting. Vacancies and special elections can also change the membership between regular elections. The House Clerk has compiled official federal election vote counts from state and territorial sources since 1920, and mid-Congress vacancies are filled through special elections, as described in the House’s election statistics and history.

What happens if an election is contested?

Each chamber has constitutional authority to judge the elections, returns, and qualifications of its own members. A contested Senate election can be investigated and considered by the Senate under its procedures; that is an exceptional case, not a different routine election schedule. The Senate explains the process on its page about contested Senate elections.
