There is no single international script for a coast guard encounter with a fishing vessel in disputed waters. What officers may do depends on the vessel’s activity, the legal zone, the enforcing state’s laws and claims, and any bilateral or provisional arrangement. A coast guard may monitor and signal a vessel, coordinate with other agencies, or—where applicable law authorizes—board and inspect it. In an EEZ, fisheries enforcement powers are subject to UNCLOS safeguards.

Why the location and activity matter

“Disputed waters” is not a legal category that automatically determines what officers can do. The first questions are where the vessel is, what it is doing, and which rules apply there. Fishing, transiting, and an alleged fisheries violation can raise different issues.

An EEZ is not the same as territorial waters

Under the UN Convention on the Law of the Sea (UNCLOS), a coastal state has sovereign rights in its exclusive economic zone (EEZ) to explore, exploit, conserve, and manage natural resources, including fisheries. Other states retain navigation and related freedoms, subject to the Convention. Both the coastal state and other states must have due regard for the rights and duties of the other. Those EEZ rules should not be treated as if the zone were territorial waters.

Fishing enforcement has defined limits

UNCLOS Article 73 allows a coastal state to take measures such as boarding, inspection, arrest, and judicial proceedings to enforce fisheries laws adopted consistently with the Convention. If a foreign vessel is arrested or detained, the state must promptly notify the flag state. The vessel and crew must be promptly released on reasonable bond or other security. These requirements are part of the enforcement framework, not optional details.

What may happen during an encounter

Published national practices show several possible parts of an encounter, but they do not establish a universal sequence. The evidence supports monitoring, communication, interagency coordination, and, when authorized, checks aboard a vessel.

  1. Monitor and coordinate. The Indian Coast Guard describes using surveillance, intelligence gathering, information sharing, and coordination with other agencies. Its account concerns India’s coastal-security remit; it is not a general rule for international boundary disputes.
  2. Signal or communicate. Canada’s Coastal Fisheries Protection Regulations list methods that include flag, light, sound, and hand signals; voice, with or without a loudhailer; and radiotelegraphy or radiotelephony. The regulation’s list is a Canadian example, not a worldwide protocol.
  3. Board or inspect where the law allows. The Indian Coast Guard says its regular boarding operations check fishers’ identity cards and vessel-registration documents. UNCLOS Article 73 supplies a separate international-law framework for fisheries enforcement in an EEZ; the applicable domestic law and circumstances still matter.
  4. Use any further enforcement measure under the applicable rules. Canada’s regulations specify warnings and an opportunity to stop in defined cases involving foreign fishing vessels. In those cases, specified force is subject to consideration of less violent means and whether those means could stop the vessel. These provisions cannot be generalized to other states.

The U.S. Coast Guard identifies fisheries enforcement and monitoring compliance with international living-marine-resource regimes among its missions. That describes agency responsibility, not a prescribed script for a particular encounter.

Can a coast guard board a fishing boat in a disputed EEZ?

It may be able to, but the fact that an area is disputed does not by itself settle the question either way. UNCLOS Article 73 recognizes boarding and inspection as possible measures to enforce fisheries laws consistent with the Convention. Whether a particular state may lawfully exercise that authority at a particular location depends on the applicable legal regime, the vessel’s conduct, the state’s claimed and exercised authority, and any relevant arrangement between the states. The materials available here do not establish jurisdiction for any specific disputed area.

UNCLOS Article 74 calls on opposite or adjacent states to delimit their EEZs by agreement to achieve an equitable solution. While they are awaiting agreement, they are to make every effort to enter practical provisional arrangements and not jeopardize or hamper a final agreement; any such arrangements do not prejudice final delimitation. This is not a categorical ban on enforcement in every disputed area. A bilateral fisheries agreement, provisional arrangement, domestic statute, or established practice may be relevant.

What happens when a fishing vessel crosses a disputed maritime boundary?

Crossing a line claimed by one state does not, by itself, tell an outside observer which state has the stronger legal claim or what response is authorized. The states may disagree about the boundary’s location or even the legal status of the waters. The relevant questions remain where the vessel was, whether it was fishing or merely transiting, what conduct is alleged, and which applicable rules or arrangements govern.

A concrete example is the Canada–United States fisheries agreement. It calls for each party to take measures consistent with international law so its nationals, residents, and vessels do not violate the other party’s fisheries laws in that party’s waters and zones. It also says each will endeavor to inform fishers operating near maritime boundaries about expected enforcement practices. At the same time, it expressly preserves the parties’ positions on disputed boundaries and the legal status of waters or zones. This illustrates how an agreement can shape expectations without resolving a boundary claim; it is not a rule for other maritime disputes.

How the documented examples differ

What a specific incident report needs to establish

For a particular encounter, a coast guard’s account should be read alongside the other state’s account and the legal instruments relevant to that location. Useful details include:

  • Coordinates and the claimed or agreed status of the location.
  • Whether the vessel was fishing, transiting, or accused of violating a fisheries rule.
  • Which state exercised authority and what domestic law or fisheries rule it invoked.
  • Whether a bilateral agreement, provisional arrangement, or established practice applied.
  • What response was documented—such as communication, monitoring, inspection, arrest, release, or diplomatic follow-up—and whether UNCLOS safeguards were relevant.

Without those details, saying that a vessel “crossed a boundary” or that a coast guard “had the right to board” can make a disputed legal question sound settled when it is not.
