Brazil’s president leads the federal executive, while the National Congress makes federal law through the Chamber of Deputies and the Federal Senate. The Constitution also gives the president a role in proposing and approving legislation, and gives Congress powers to review executive action, authorize budgets and confirm certain appointments. These formal checks do not guarantee that either side can secure its preferred outcome: political support must still be built bill by bill.

Who does what in Brazil’s federal government?

Brazil is a federal presidential republic. The president heads the executive branch and appoints and dismisses ministers. The National Congress is bicameral: federal legislation involves both the Chamber of Deputies and the Federal Senate. The Constitution describes the Union’s powers as “independent and harmonious among themselves”; in practice, that means separate responsibilities alongside checks and shared procedures. The Constitution of the Federative Republic of Brazil is the controlling source for these powers. The Chamber of Deputies’ English translation is a useful reference for readers who do not read Portuguese.

How do ordinary bills become law?

The president is not limited to reacting to bills written by legislators. The Constitution gives the president initiative in certain legislative matters. Congress debates and votes on federal bills; when a bill reaches the president, the president may sanction and promulgate it or veto it wholly or partly. The exact procedures and exceptions depend on the current constitutional text and the type of measure.

A veto is a check, not an absolute presidential decision. The Constitution provides a process for Congress to consider a veto, so the executive and legislature may disagree over a bill’s final fate. For the precise voting threshold, deadlines and procedural details, consult the current consolidated constitutional provisions rather than assuming that every veto or bill follows identical rules. Can Brazil’s president make laws by decree?

Not through an unlimited general power to legislate by decree. The president can issue a medida provisória, or provisional measure, which has force of law. But the Constitution restricts its use and subject matter, and Congress must consider it. It is therefore a consequential executive lawmaking route with legislative review—not a substitute for Congress or a blanket authority to make any law by decree. Exact deadlines and effects depend on the current consolidated text and applicable procedure. The Chamber of Deputies’ updated constitutional portal provides another official reference.

Who proposes and approves Brazil’s budget?

The president submits the federal multi-year plan, the budget-guidelines bill and the annual budget proposal. Congress considers these proposals through both houses, with examination by a mixed committee of deputies and senators. Congress also has roles in amending and authorizing the budget under constitutional and statutory rules, and in monitoring its execution. The executive has a central role in proposing and implementing spending plans; that does not eliminate legislative scrutiny or approval.

How do appointments and oversight work?

The president appoints ministers and nominates certain senior officeholders. For a number of specified positions, the Constitution requires approval by the Federal Senate. That confirmation role belongs to the Senate, not to Congress acting as a single undifferentiated body.

Congress also examines the president’s annual accounts and has other constitutional accountability powers. The allocation varies by function: some checks involve both houses, while others are assigned specifically to the Senate or the Chamber. These provisions make oversight part of the formal relationship, rather than a power held only by the president or only by one chamber. Why formal powers do not settle political outcomes

The Constitution establishes who may propose, vote on, veto, review and oversee. It does not tell a reader whether a president has a dependable majority in Congress, how parties will negotiate a particular bill, or how budget talks will unfold in a given session. Those are matters of current political composition and bargaining, not permanent constitutional rules. Any account of a governing coalition or legislative majority needs a date and up-to-date evidence about seats and support.

Constitutional provisions can also change through amendments. For an up-to-date legal explanation, check the latest consolidated text on an official Brazilian government or congressional portal; the Portuguese constitutional text controls where an English translation differs.
