When a state changes its sales tax nexus rules, the date you must register, start collecting tax, or file a return may change too. Recheck the state’s effective date, threshold, sales counted, measurement period, marketplace rules, and any physical presence your business has there. Then confirm the registration and filing instructions with that state’s revenue department; there is no single nationwide threshold or start date.

What should you do first when a state changes its nexus rule?

Review each state separately. A rule change may alter whether your business has an obligation, how its sales are measured, or when a new obligation begins. A threshold summary is a useful starting point, not a substitute for the applicable state law or revenue department instructions. The Streamlined Sales Tax (SST) Governing Board says its state guidance does not override state law; use its remote seller state guidance and state tables as comparison aids, then verify the rule with the state.

  1. List the states to review. Include states where you make sales and states where you may have staff, property, inventory, or other physical presence.
  2. Record the new rule and its effective date. Check whether it includes a transition provision or changes a transaction-count test.
  3. Match your sales data to the rule. Use the state’s defined sales measure and measurement period, and assess marketplace transactions as the state directs.
  4. Check for physical presence separately. Do not assume a remote-seller threshold resolves obligations where you have an in-state presence.
  5. Confirm the operational dates. Find out when to register, when collection must begin, how often returns are due, and how to report facilitator-collected sales.
  6. Keep a dated record. Save the state guidance and the sales calculation used for the decision so you can revisit them if the rule changes again.

Which parts of the changed rule can affect your filing duty?

Effective date and transition

Identify when the change takes effect and whether it applies to sales or threshold calculations from a particular point onward. A rule’s announcement date is not necessarily its effective date. If the state describes a transition for sellers that met an earlier test, follow that transition language rather than assuming the new rule applies in the same way to every seller.

Threshold and the sales that count

Do not compare your revenue with a dollar figure until you know what the state counts. Depending on the rule, the measure may be gross sales, gross receipts, taxable sales, retail sales, or another defined amount. SST explains that when a threshold is based on gross sales, exempt, nontaxable, and resale transactions may still count. Check the state’s definition and its treatment of each sales category before calculating whether you crossed the threshold. See SST’s remote seller threshold terms.

Measurement period

States may use the current calendar year, the preceding calendar year, a rolling twelve-month period, or another period. The same sales history can produce a different result under a different window, so apply the period specified by the state instead of assuming that one calendar-year total answers the question. The Streamlined Sales and Use Tax Agreement, Article I, describes differing measurement-period approaches.

Direct sales, marketplace sales, and physical presence

A marketplace facilitator may collect and remit tax on transactions it facilitates, but that does not necessarily remove the seller’s registration or return obligations. Marketplace sales may also count toward the seller’s remote-seller threshold, depending on the state’s rules. Assess your direct sales and marketplace sales under the applicable state guidance, and check whether returns require reporting facilitator-collected transactions. SST provides an overview for marketplace sellers and for marketplace facilitators; each points back to state-specific requirements.

Physical presence is a distinct basis for nexus. SST says sellers with physical presence are generally required to register regardless of sales amount. That means a remote-seller threshold alone is not a sufficient check for a business with in-state staff, property, or inventory.

How do state examples show why the details matter?

The examples below come from SST’s state guidance summaries. They illustrate rule changes, not a substitute for the controlling state rule; confirm current details with the state revenue department before making a filing decision.

State Change listed in SST guidance Why to review it
Illinois SST lists an effective date of January 1, 2026, and a threshold of $100,000 or more in cumulative gross receipts from Illinois sales of tangible personal property. Check the effective date, the gross-receipts definition, and the state’s current registration and collection instructions.
Alaska SST lists an effective date of January 1, 2025, for a $100,000 statewide gross remote-sales threshold in the previous or current calendar year, with the prior separate transaction test removed. Recheck both the measurement period and whether a transaction-count test still applies under current state guidance.
Indiana SST records a change effective January 1, 2024, to a $100,000 gross-revenue threshold and describes transition handling for sellers that previously met only the transaction test. Look for transition rules if your earlier obligation depended on a test that changed.

These figures and descriptions are SST summaries, not a universal rule for other states. The state guidance index can help locate a state’s summary; use the relevant state revenue department’s current instructions to confirm the rule that applies to your business.

When do registration, collection, and filing begin?

Do not treat crossing a threshold as the only date that matters. Find the state’s registration deadline, the date collection must start, the first return period, and the assigned filing frequency. The SST Governing Board’s threshold terms page states: “You are responsible for collecting and remitting sales tax to each state beginning with your ‘registration date’.” Treat that as SST guidance and check the state’s own registration and timing instructions for your circumstances.

Registration, collection, and filing are related but distinct tasks. A marketplace’s collection on facilitated transactions does not by itself answer whether you must register or file, particularly if you also make direct sales. Confirm how the state wants facilitator-collected transactions handled on returns rather than assuming they can be omitted. SST’s remote sellers FAQ provides additional threshold context, but state instructions control the actual filing duty.

What records help you apply a changed rule correctly?

  • The rule’s effective date and the source of the state’s current instructions.
  • The exact threshold language, including the sales categories included and excluded.
  • The measurement period and the dates included in your calculation.
  • Sales totals split by state and, where useful, by direct and marketplace channel.
  • Any in-state staff, property, or inventory that could establish physical presence.
  • The registration date, collection start date, first return due, and filing frequency given by the state.
  • How facilitator-collected transactions should be treated on your return.

When comparing a new rule with the old one, keep the two calculations separate and use each rule’s own definition and time window. This makes it easier to identify whether the change itself altered your result and to explain the decision later.

Where can you verify your state’s actual requirement?

Start with the state revenue department for the state where you may have nexus. Look for its current remote-seller or economic-nexus guidance, registration instructions, and return guidance. Use SST’s comparative state tables to spot what may have changed, then confirm the effective rule and timing directly with the state before registering, collecting, or filing. Your outcome depends on the state, your presence, sales channels, product taxability, sales volume, and the applicable measurement period.
