“HIPAA hosting” is a market label, not an HHS certification. A standard cloud service can be used for electronic protected health information (ePHI) when the provider’s role, the business associate agreement (BAA), the specific services, and the customer’s security practices meet HIPAA requirements. The label alone does not establish that a workload is compliant.
What makes a cloud provider a business associate?
A cloud provider is generally a business associate when it creates, receives, maintains, or transmits ePHI on behalf of a HIPAA covered entity or another business associate. HHS explains this in its Guidance on HIPAA & Cloud Computing and its guidance on Business Associates.
That can apply even when the data is encrypted and the provider does not possess the decryption key. If the provider maintains ePHI for the customer, encryption alone does not remove its business associate status.
Can you use standard cloud hosting for ePHI?
Yes. HHS says a covered entity or business associate may use a cloud service to store or process ePHI if the required BAA is in place and the organization otherwise complies with HIPAA. See the HHS cloud-service FAQ.

The difference is not simply “HIPAA hosting” versus every other cloud plan. It is whether the provider’s contract and selected services cover the workload, and whether the provider and customer each perform their assigned safeguards. A cloud service should not handle ePHI merely because its provider is well known or offers a BAA for some products.
What a BAA does—and does not do
A BAA sets out required terms for the business associate relationship, including permitted uses and disclosures of PHI, safeguards, and relevant obligations for subcontractors. HHS describes the contractual requirements in its Business Associates guidance.

A signed BAA is necessary where the provider is a business associate, but it is not a compliance guarantee or a transfer of all responsibility to the provider. HHS expects the customer to understand the cloud solution, conduct its own risk analysis, and manage identified risks. The agreement should be read alongside the service documentation and the customer’s actual architecture.
How responsibility is shared
Responsibility depends on the particular service, contract, and configuration. HHS notes that some security features may be the customer’s responsibility and others the provider’s. Provider guidance from Google Cloud and Microsoft Azure also describes shared responsibility. Before putting ePHI in a service, establish who handles each relevant control.

- Access and identity: Determine who configures accounts, roles, authentication, and access restrictions.
- Encryption and keys: Confirm what protections the service provides and who controls configuration and key management.
- Logging and monitoring: Identify which events the provider records, what the customer must enable, and who reviews alerts.
- Incident and support processes: Check how the provider communicates incidents and what assistance or cooperation the agreement and service terms provide.
- Risk analysis: Map the complete environment—including the cloud service and connected systems—so the organization can assess and manage risks to ePHI.
What to compare before choosing a cloud service

Why “HIPAA certified” is not a reliable test
HHS says it does not endorse, certify, or recommend specific technologies or products. There is no HHS-approved cloud-provider HIPAA certification that makes a service automatically suitable for ePHI. AWS, Google Cloud, and Microsoft also explain that there is no recognized or approved HIPAA certification program for providers in their respective guidance: AWS, Google Cloud, and Microsoft Azure.
Instead of relying on a certification badge or a “HIPAA hosting” claim, verify the actual BAA, covered services, configuration requirements, and division of responsibilities. Vendor documentation describes the vendor’s stated position; it does not independently assess whether your implementation is compliant.

Due-diligence checklist
- Identify where ePHI will be created, received, maintained, or transmitted, including connected cloud services.
- Confirm whether the provider is acting as a business associate and obtain a BAA that covers the relationship and intended services.
- Check the provider’s current service-eligibility list and read any conditions or exclusions for each service that will handle ePHI.
- Document which party configures and operates each relevant security control in the selected architecture.
- Conduct and maintain your organization’s risk analysis and risk-management processes for the complete environment.
- Review operational terms, including service-level expectations, incident communications, and support arrangements.
- Recheck current provider terms and service documentation before deployment and when the architecture or services change.
