Under India’s GST regime, input tax credit (ITC) is eligible tax credit recorded in your electronic credit ledger and generally used to reduce output tax payable. A GST refund is a payment back allowed on a specific legal ground; unused ITC does not automatically qualify. The right route depends on whether the balance is in your cash or credit ledger, what you supplied, and which statutory refund ground applies. The linked CBIC Act texts reproduce the 2017 legislation, so check subsequent amendments, notifications, current portal instructions, and your transaction facts before relying on a specific eligibility rule.

GST refund and ITC are different things

ITC is a credit that an eligible business may use against output tax, subject to statutory conditions, restrictions, and any required reversals or attribution. It remains in the electronic credit ledger until used or otherwise dealt with under the rules.

A refund is money returned after a claim under a recognized legal ground. Section 54 of the CGST Act does not make every unused credit balance refundable. For unutilized ITC, it principally provides for qualifying zero-rated supplies made without payment of tax and specified accumulation caused by an inverted rate structure, subject to restrictions and exclusions. The statutory grounds and restrictions are set out in the CGST Act.

Which route should your business investigate?

Business situation Route to investigate Key check
Eligible input tax and current output tax payable Use ITC through the electronic credit ledger under the applicable payment rules. Confirm eligibility, restrictions, and any required reversals or attribution. CGST Act
Export or supply to an SEZ unit or developer Investigate the zero-rated supply options: supply under bond or Letter of Undertaking (LUT) without payment of IGST and claim unutilized ITC, or pay IGST and seek a refund of tax paid, subject to conditions and safeguards. Confirm qualifying zero-rated status, current conditions and evidence, and whether a statutory exclusion applies. CGST Act; IGST Act
Inputs taxed at higher rates than taxable outputs Investigate a refund of qualifying ITC accumulated because of an inverted rate structure. Check current eligibility for the goods, services, and inputs involved, and use the prescribed formula for the claim period. CGST Rules
Money remaining in the electronic cash ledger Investigate a cash-ledger balance refund through the return route specified in the rules. This is cash, not unused ITC; identify the correct ledger and route before filing. CGST Rules
Wrong tax paid, final assessment, deemed export, or another recognized ground Investigate the refund provision for that specific ground. Eligibility, claimant, timing, and evidence vary by ground. CGST Act; CGST Rules

Start by identifying which ledger holds the amount, the outward supply involved, and the particular legal ground. Do not treat “excess GST” as a sufficient basis for an ITC refund.

How to claim a GST refund

  1. Identify the ground and eligible claimant. Refund grounds in the rules include exports of goods or services, supplies to an SEZ, deemed exports, qualifying unutilized ITC, finalization of provisional assessment, and amounts arising from orders. Some grounds specify whether the supplier or recipient claims. Check the applicable requirements in the CGST Rules.
  2. Reconcile records and calculate the claim. For unutilized ITC, apply the formula and definitions for the specific ground and claim period; not all credit in the ledger necessarily belongs in the refund base. The rules prescribe different calculations for qualifying zero-rated supplies and inverted-rate accumulation. CGST Rules
  3. Assemble evidence for that ground. Depending on the claim, required particulars may include shipping bills and export invoices; export-service invoices and evidence of bank realization or foreign inward remittance; SEZ endorsements and proof; deemed-export particulars; or received and issued invoice details for specified unutilized-ITC claims. CGST Rules
  4. File through the appropriate electronic route. The general refund application route in the cited rules is FORM GST RFD-01 on the common portal, directly or through a notified facilitation centre. A cash-ledger balance uses the relevant return route specified in the rules. Confirm current portal steps and requirements before filing. CGST Rules
  5. Check the ledger and track the decision. A claim against unutilized credit debits the claimed amount from the electronic credit ledger. If the claim is rejected in whole or part, the rejected amount is re-credited through the prescribed process. CGST Act

Timing and supporting details for exports and SEZ supplies

For goods exports, the cited rules place the application after delivery of the export manifest or export report. For goods supplied to an SEZ, the supplier applies after full admission of the goods for authorized operations is endorsed. For SEZ services, evidence of receipt for authorized operations is required. Check the current rules and portal guidance for the relevant claim.

The GST portal guide says that shipping-bill details need not be present to file export invoices in GSTR-1 if they are not readily available; once received, those details can be reported through GSTR-1’s amendment section. That GSTR-1 allowance is not a blanket waiver of evidence required for a refund claim. GST portal export FAQs

Formula and processing-time cautions

The CGST Rules prescribe a formula for zero-rated supplies made without payment of tax using turnover of zero-rated goods and services, Net ITC, and adjusted total turnover. A separate inverted-rate formula uses turnover of inverted-rated supply, Net ITC, adjusted total turnover, and tax payable on that supply. Use the rule text, definitions, and eligibility conditions applicable to the claim period; the cited rules have changed over time. CGST Rules

Section 54(7) of the CGST Act states: “The proper officer shall issue the order under sub-section (5) within sixty days from the date of receipt of application complete in all respects.” This is an order period triggered by receipt of a complete application, not a guaranteed payout period measured from the first submission of an incomplete claim. The Act also provides for a provisional refund of ninety per cent in specified zero-rated cases, subject to qualifications and prescribed conditions; it is not universal. CGST Act
