If you receive a GST notice proposing reversal of input tax credit (ITC), first identify the tax period, disputed invoices, legal ground, proposed amounts and reply date in the complete notice—not just a generic checklist or portal summary. Then reconcile each challenged invoice against your books and returns, assemble evidence that answers the stated allegation, and file through the route and form required for that notice. There is no single reply deadline or evidence bundle that applies to every ITC dispute.

What to check in the notice first

Read the full notice and its annexures alongside the portal summary. For each allegation, note:

  • The tax period and each invoice or document reference.
  • The statutory provision and the factual reason the department says the credit should be reversed.
  • The proposed tax, interest and penalty, and how those amounts were calculated.
  • The date and method of service, the stated reply date, and the required filing channel or form.
  • Any earlier reply, payment, reversal, order or correspondence referred to in the notice.

Check whether the detailed notice and portal summary agree. If the notice lists several grounds or invoices, separate them: one invoice may involve a different issue, tax period or evidence from another. Do not assume the applicable law or deadline from a general online checklist; verify the rules applicable to the period and the instructions in your notice.

Reconcile the disputed credit invoice by invoice

Build a working that connects the department’s allegation to your source records, accounting entries and return reporting. Compare the disputed claim with the purchase register and ledger, the relevant GSTR-2B information, GSTR-3B, and any reversal or later reclaim. GSTN advises taxpayers to reconcile GSTR-2B with their books, avoid claiming the same credit twice, and make reversals required by the Act and Rules. Its GSTR-2B advisory also supports reconciliation rather than treating the statement as a substitute for the taxpayer’s records.

For each disputed item, record What to establish
Invoice identity Invoice or debit note number and date, supplier GSTIN, taxable value and tax, and the notice reference.
Claim and return trail When and where the credit was claimed in GSTR-3B, the relevant GSTR-2B period and status, and any amendment, reversal or reclaim with its reporting period.
Transaction evidence Relevant order or contract, receipt of goods or evidence of service, business-use records where relevant, and associated payment details.
Reply position The specific allegation, the facts and legal condition in dispute, the supporting exhibit number, and the amount you accept or contest.

Use the reconciliation to recalculate the proposed amount against the underlying invoices and return periods. Check for duplicate lines, an incorrect GSTIN or period, arithmetic errors, and amounts already reversed or paid. Keep the working and source-to-ledger-to-return trail so each figure in the reply can be traced.

Which records to keep

Keep an indexed folder for each notice and tax period. Include the documents that bear on the allegation; adding unrelated records simply makes the file harder to review. The relevant records depend on the stated ground.

Why GSTR-2B alone does not decide entitlement

GSTR-2B is a reconciliation aid, not a final ruling that a credit is legally available or unavailable. GSTN describes the “ITC not available” classification as covering specified situations, and notes that other legal restrictions may require taxpayer self-assessment. A mismatch or absence in GSTR-2B should therefore be addressed alongside the invoice, books, returns, applicable legal ground and facts—not treated as the only answer to the notice. Likewise, a credit appearing in a statement does not, by itself, answer every possible eligibility issue. See the GSTN GSTR-2B FAQs.

The applicable ITC rule depends on the notice’s allegation and the law for the relevant period. For example, CBIC’s Input Tax Credit Rules describe reversal where a recipient has availed credit but does not pay the supplier the value plus tax within the period specified in the Act, and prescribe methods for certain capital-goods and mixed business/non-business or taxable/exempt-use situations. Those examples do not establish the ground in your case. Identify and answer the provision actually cited in the notice.

How to prepare and file the reply

  1. Separate the issues. List every disputed invoice, period and legal ground from the notice. Confirm the reply date and required route against the complete notice and current portal instructions.
  2. Recalculate the proposed demand. Tie each amount to the relevant invoice and return period. Mark duplicates, incorrect identifiers or periods, arithmetic differences, prior reversals, and payments.
  3. Prepare the invoice-level reconciliation and exhibit index. Show the allegation, your records, the legal condition in dispute, the evidence supporting your position and your conclusion for each line item.
  4. Answer the stated ground directly. Explain the material facts and point to the numbered exhibits that support them. If you accept an error or ineligible portion, distinguish it from genuinely disputed items and discuss any correction or payment with a qualified GST adviser.
  5. Use the prescribed reply form and channel. Under the cited text of CGST Rule 142, a reply to a notice whose summary is uploaded electronically in FORM GST DRC-01 is furnished in FORM GST DRC-06. The rule text also describes DRC-03 for specified payments and DRC-07 as an electronic summary of specified orders. The available CBIC rules PDF is an older consolidated file, so check subsequent amendments, the actual notice and live portal instructions before filing: CBIC CGST Rules, Rule 142.
  6. Save proof of filing and follow the case. Keep the submitted reply, attachments, acknowledgement or ARN and portal receipt. Track later hearing notices, submissions, orders, payment evidence and any applicable rectification or appeal dates.

The deadline and procedure are case-specific; the cited materials do not establish one universal deadline for all ITC reversal disputes. If time is short, the legal ground is unclear, or a material amount is involved, consult a qualified GST practitioner or tax adviser promptly.
