There is no single GST demand time limit that applies to every tax period or notice. Start with the period involved, the provision and grounds cited, and the notice or order stage. If you want to appeal a CGST adjudication order, the general statutory period is three months from communication, with a possible further month for sufficient cause; payment and refund rules depend on the disputed amount and the refund category.
How to assess a GST demand notice
For a demand under India’s Central Goods and Services Tax Act, 2017 (CGST Act), first identify the tax period and the legal provision named in the notice. Then check the alleged basis for the demand, the procedural stage, and the dates of the relevant returns, notices, orders and communications. These details determine which limitation rules and payment routes may apply.
- Tax period: The applicable law may have changed between periods. Corresponding State GST and Union Territory GST laws may also be relevant, so a central-law reference alone may not settle a dispute.
- Ground alleged: Sections 73 and 74 distinguish certain demands not based on fraud or wilful misstatement or suppression to evade tax from demands alleging those grounds.
- Stage: A notice, an adjudication order and an appeal each present different questions and deadlines.
- Record: Keep the notice, order, return and service records together. The relevant date may depend on the statutory step and communication record, not simply when you first noticed a document.
The CBIC-published CGST Act text sets out sections 73, 74, 107 and 54. The applicable statutory version and notifications should be checked for the particular period and jurisdiction.
How long does the department have to raise a GST demand?
The answer depends on the tax period, applicable version of the law, provision invoked, relevant return due date, and whether the matter concerns a notice or an order. Sections 73 and 74 contain statutory steps and limitation periods, but a single deadline cannot safely be applied to every GST demand. Extensions, exclusions and special provisions can also affect the calculation.
For periods from FY 2024–25 onward, the official material available for this article did not establish the definitive commencement and operative consolidated text of section 74A. Do not assume that the older section 73 or 74 timelines govern those periods. Check the current central statute and applicable notifications, as well as the relevant State or UT enactment, before relying on a deadline. The CBIC Act page is a starting point, not a substitute for verifying the law applicable to the period.
If you believe an older demand is time-barred, build a dated chronology for the specific tax period and the statutory steps taken. The age of a demand by itself does not establish that it is invalid.
How long do you have to appeal a GST demand order?
Under section 107 of the CGST Act, a person aggrieved by an adjudicating authority’s decision or order generally has three months from the date the order is communicated to appeal to the Appellate Authority. The authority may allow a further period of one month if satisfied that sufficient cause prevented filing within the original period. These are the statutory framework periods; calculate the deadline against the order and communication or service record for the case.
The Act’s appeal provision covers decisions or orders under the CGST Act and corresponding State GST or UTGST Acts. The text is available on the CBIC CGST Act page. If a deadline is near, get case-specific advice promptly rather than relying on a general calendar calculation.
What is filed?
CBIC’s Appeal Rules describe filing an appeal in FORM GST APL-01 and issuance of FORM GST APL-02, along with supporting documents and a certified copy as specified by the rules. Portal instructions and form requirements can change; check the current official instructions before submitting.
Do you have to pay before appealing?
Section 107 requires the appellant to pay the full amount of tax, interest, fine, fee and penalty that the appellant admits, plus a statutory pre-deposit linked to the remaining disputed tax. The Act states that payment of the required amount has a stay consequence for recovery of the balance. Do not calculate a pre-deposit from the total demand alone: identify the admitted and disputed amounts, the demand components and the provision in the current text that applies to the order.
Rank #4
Use the current CGST Act and the order to verify the calculation. A State or UT proceeding may require checking its corresponding law as well.

Can you pay a GST demand in instalments or get a reduced penalty?
Demand provisions may provide payment routes at specified stages, with penalty consequences depending on the demand ground, timing and conditions. The amount due also depends on the tax and interest calculation and the current statutory text. An early-payment option or reduced penalty is not automatic merely because a taxpayer pays quickly; verify the exact provision and its conditions against the notice or order.

Past section 128A relief
CBIC Circular 238/32/2024-GST describes section 128A relief for qualifying section 73 demands pertaining to FY 2017–18, FY 2018–19 and FY 2019–20, subject to prescribed conditions. The circular specified payment of the full tax demanded by 31 March 2025 to avail the benefit. That date has passed; this is not an open payment opportunity. See CBIC Circular No. 238/32/2024-GST for its scope and conditions.

Section 54 covers different refund grounds, including specified exports, unutilised input tax credit and other statutory cases. The claim deadline is generally tied to a “relevant date,” and that date varies with the refund ground. Before filing, establish which category applies, who is entitled to claim, what date starts the limitation period and what evidence the rules require.
- Identify the refund ground. Match the facts to a category covered by section 54 rather than treating every credit balance or payment as an automatic refund.
- Calculate the relevant date. Apply the statutory rule for that specific ground; do not assume one common start date for all refund applications.
- Collect supporting evidence. The refund rules prescribe documentation and the applicable refund process. Consult the current CBIC Refund Rules and the relevant Act provisions.
- Check adjustments and entitlement. Refunds may be adjusted against eligible outstanding amounts, and the Act includes restrictions related to unjust enrichment.
Under the general unjust-enrichment rule, a refund is generally not paid to an applicant who has passed the incidence of tax and interest to another person, subject to statutory exceptions. An appellate or other order, or a payment made earlier, does not by itself make a refund automatic; the claim still has to fit a statutory category and meet its application and evidence requirements.
When can interest be due on a delayed GST refund?
Section 56 provides for interest on qualifying refunds that are not paid within 60 days after receipt of the application. It also addresses qualifying refunds arising from an order that has attained finality. The applicable notified rate and calculation depend on current rules and the facts of the claim; verify them against the relevant notification rather than assuming a rate from this general deadline. See the CGST Act and current notifications.
Quick Recap
What to check before taking action
- Confirm the tax period, jurisdiction and statutory version that govern the demand or refund.
- Read the provision and grounds stated in the notice or order, and identify the current procedural stage.
- For an appeal, record the communication date and calculate the filing period from the service record.
- Separate admitted tax and other amounts from disputed tax before assessing the payment requirement.
- For a refund, identify its statutory category, relevant date, supporting documents and possible adjustments.
- Verify current Act text, notifications, rules and portal instructions. For an active deadline or case-specific calculation, consult a qualified GST professional.
