Emulation and game ROMs are different things—and neither automatically makes the other legal. An emulator is software that lets a game designed for one platform run on another device. A ROM is a copy of the game software. In the United States, the emulator program, the way a game copy was made or obtained, any sharing, and any bypassing of access controls raise separate legal questions. Owning the original game does not by itself establish that a ROM downloaded from an unauthorized source is lawful.

What is the difference between a ROM and an emulator?

Emulation is what the software does

An emulator imitates enough of a game system’s hardware or software environment to let programs made for that system run elsewhere. The emulator is a program; it is not the game itself. Nintendo’s UK explanation describes emulators as software that permits software to run on a device for which it was not originally created: Nintendo’s emulator software statement. That page expresses Nintendo’s position as a rights holder, not a neutral court ruling. Nintendo also says some unauthorized emulators circumvent security measures; that characterization should be attributed to Nintendo rather than treated as a universal legal conclusion.

A ROM is a copy of the game

“ROM” is commonly used for a digital image or copy of a game program. A game may be run in an emulator, but the emulator does not establish whether that particular game copy was authorized. Making, downloading, hosting, or sharing a copy can raise copyright issues independent of the emulator’s legality. Are emulators illegal in the United States?

There is no sound blanket answer that all emulators are illegal. The program’s function alone does not resolve whether a game copy used with it was lawfully made or obtained, or whether access controls were bypassed. Analyze those questions separately. Federal law includes a limited interoperability provision: under conditions in 17 U.S.C. § 1201(f), a person who lawfully obtained the right to use a computer program may circumvent a measure to identify and analyze elements needed for interoperability of an independently created program, where the acts do not constitute infringement. This is not a general license for consumers to copy games or obtain ROMs.

Is a ROM legal if you own the original game?

Owning a cartridge or disc does not automatically authorize downloading a ROM copy from an unrelated website. The legal analysis depends on the jurisdiction, the copy’s source and how it was made, whether it is distributed, and whether technological access controls were circumvented. The sources here do not establish a general U.S. rule that personal ownership makes every backup, download, or conversion lawful. A ROM being available online—or being used only in an emulator—does not answer those questions.

Making a copy and downloading one are distinct situations

A copy you make from a lawfully acquired game and a copy downloaded from an unauthorized source involve different facts. Do not assume that permission to possess the original settles the copyright status of a new copy, or that a rule concerning one copying method applies to another. U.S. anti-circumvention law can also apply separately when a technological measure controlling access is bypassed.

Sharing creates additional copyright concerns

Uploading or distributing game files is not the same activity as privately running a game. WIPO recounts the 2021 RomUniverse litigation, in which a U.S. court found the site operator liable for direct infringement by uploading Nintendo ROMs, contributory infringement by facilitating downloads, and vicarious infringement in connection with financial benefit and the ability to prevent infringement. That outcome concerns the operator’s distribution conduct; it does not decide every private-emulation or personal-copy scenario.

What does U.S. anti-circumvention law change?

Copyright and anti-circumvention rules are separate layers. Section 1201 of the Digital Millennium Copyright Act generally prohibits circumventing technological measures that control access to copyrighted works. The U.S. Copyright Office explains that Congress created a temporary exemption process for particular classes of works and noninfringing uses: “Section 1201, however, also directs the Librarian of Congress, upon the recommendation of the Register of Copyrights following a rulemaking proceeding, to determine whether the prohibition on circumvention is having, or is likely to have, an adverse effect on users’ ability to make noninfringing uses of particular classes of copyrighted works.” See the Copyright Office’s Section 1201 rulemaking overview.

An exemption from § 1201’s circumvention prohibition does not itself grant permission to infringe copyright under other rules. Exemptions are limited by their wording, qualifying users, purpose, and conditions; they are not a broad exemption for game copying or downloading.

Which video-game preservation exemptions apply?

Current 37 CFR § 201.40 contains specific temporary exemptions involving video games. Among the covered situations are access to a lawfully acquired complete game for local gameplay when a required authentication server has ceased service, and certain preservation activity by eligible libraries, archives, or museums. Separate provisions address eligible institutions preserving certain lawfully acquired games that are no longer reasonably available commercially. The regulation defines when server access counts as ceased and sets conditions on institutional activity and access.

These provisions are narrow. They do not establish a general personal right to download ROMs, and satisfying a § 1201 exemption does not, by itself, settle copyright questions about making or distributing a copy. The Copyright Office’s 2024 rulemaking concluded with a final rule dated October 28, 2024; its current proceeding overview describes renewals for October 2027 through October 2030. Because exemption terms and periods can change, consult the current regulation and Copyright Office proceeding information for the rule applicable to the date and activity in question.

Why does the answer change by country?

Copyright and circumvention rules are territorial; the U.S. discussion is not worldwide legal advice. Canada provides one example of a different approach: Copyright Act § 30.6 permits specified adaptation or backup acts for certain computer programs under conditions that include personal use and destruction of the adaptation or backup when the person ceases to own or hold a licence for the copy. That provision is not a complete answer to every Canadian video-game or technological-protection-measure issue. The Act page states it is current to September 21, 2026.

How to assess a particular game-and-emulator setup

For a specific title, work through the relevant facts instead of relying on the shorthand “I own it” or “it’s just emulation.”

  1. Identify the country whose law applies. Rules and exceptions differ by jurisdiction.
  2. Identify the game copy. Determine whether it was lawfully acquired or licensed, and whether the emulator will use that copy or a new one.
  3. Check how any new copy was made or obtained. Personal copying, a download from a third party, and copying from an unauthorized upload are not interchangeable facts.
  4. Ask whether copies are being shared. Uploading, hosting, or distributing files raises separate concerns from running a game locally.
  5. Check for access controls. Bypassing a technological measure may raise an anti-circumvention issue even where the copyright question is considered separately.
  6. Verify any claimed exception against its exact terms. For U.S. video-game preservation or server-related activity, consult the current text of 37 CFR § 201.40; do not treat a narrow exemption as a general ROM exception.

If the goal is simply to play a particular older game, a currently licensed re-release may avoid uncertainty about an unauthorized ROM source. Verify that the release is authorized and available for your region and platform; availability and terms vary by title.
