U.S. Director of National Intelligence Tulsi Gabbard criticized a reported British demand for Apple to provide access to encrypted iCloud data, calling it a threat to Americans’ privacy and civil liberties. The UK government has not confirmed or denied that it issued the notice, and the reported terms remain undisclosed.
What Gabbard criticized
On February 27, 2025, the Associated Press reported that Gabbard had “serious concerns” about Britain’s reported demand. She was responding to concerns raised by Senator Ron Wyden and Representative Andy Biggs, and argued that a foreign government’s pressure on a U.S. technology company could violate Americans’ rights. In her response, she said: “This would be a clear and egregious violation of Americans’ privacy and civil liberties.” Associated Press Gabbard’s statement
What the reported demand involved—and what is not confirmed
The underlying notice was not made public. The AP account described a Washington Post report, based on anonymous sources, that British security officials sought a way to view fully encrypted material. A May 2025 congressional oversight letter also discussed the alleged scope, but it reflected lawmakers’ concerns and reporting; it was not an independent determination or confirmation by the UK government. The reported technical capability notice was associated with the UK Investigatory Powers Act 2016. In the House of Lords on March 31, 2025, Lord Hanson of Flint said: “I cannot confirm or deny any notices, and I have to stick to that position today for the House and for national security issues.” He also described the Act as having safeguards and independent oversight. Why Apple changed Advanced Data Protection availability in the UK
Advanced Data Protection (ADP) is an opt-in iCloud feature that uses end-to-end encryption for covered data, including files, photos and notes. Apple said in February 2025 that it would stop offering ADP to new UK users and would eventually disable it for existing UK users. The change affected feature availability; it does not establish what any secret notice required. Associated Press
The dispute raises a distinction between seeking access to a particular account and requiring a technical capability that could reach encrypted data more broadly. Critics’ privacy concerns address the risks of the latter; the UK government has pointed to safeguards and oversight. The public record described here does not disclose enough about the notice to determine its exact scope or how those safeguards would have applied.

What Gabbard said happened later
On August 19, 2025, Gabbard said the UK had agreed to drop its mandate for Apple to provide a “back door.” The Washington Post reported that details of the deal had not been disclosed and that the Home Office would not confirm or deny the existence of a technical capability notice. Its statement said: “We will continue to build on those arrangements and we will also continue to maintain a strong security framework to ensure that we can continue to pursue terrorists and serious criminals operating in the UK.” The Washington Post
Accordingly, Gabbard’s account is evidence of what she said the two sides agreed, not public confirmation that a notice was formally withdrawn or that the dispute was conclusively resolved. Apple’s position, quoted by Euronews, was: “We have never built a backdoor or master key to any of our products or services and we never will.” That is Apple’s stated policy, not a disclosure of the notice’s terms. What remains unresolved
- The UK has not publicly confirmed or denied issuing a technical capability notice relating to Apple.
- No public copy of the alleged notice or full account of the August agreement is available in the cited reporting.
