If an e-way bill has expired, do not continue moving the goods on the strength of that bill. Check the status and expiry displayed in the official E-Way Bill System, and, if an exceptional delay qualifies, have the authorised transporter request an extension through the portal within its permitted window. An expired bill does not by itself establish one automatic, fixed GST penalty: a contravention in transit can lead to detention or seizure under section 129 of the CGST Act, with release consequences determined through the statutory process.

What to do when an e-way bill is about to expire or has expired

  1. Check the bill in the official system. Confirm the consignment’s current status and the displayed expiry. The bill’s operational expiry is the one to use for that movement.
  2. If validity has expired, stop movement on that bill. The E-Way Bill System FAQ states: “If validity of the e-way bill expires, the goods are not supposed to be moved.”
  3. If an exceptional delay applies, check the extension window and who can request it. The current transporter generally extends the bill; if no transporter is assigned, the generator may update it. The API documentation describes a window from eight hours before expiry through eight hours after expiry. Confirm the live portal workflow, especially for edge cases.
  4. Enter accurate extension details. Provide a specific reason, the actual current location, approximate distance remaining, and relevant updated Part B transport information. Part A cannot be changed through the extension process described in the FAQ.
  5. Retain the record. Keep the extension confirmation and relevant supporting records of the delay, such as breakdown or disruption documentation, with the consignment papers. If the facility is unavailable or the window has passed, seek advice from a GST professional or the relevant tax authority before restarting movement. Do not assume a new bill or the expired one automatically resolves the problem.

The FAQ gives natural calamity, law-and-order issues, trans-shipment delays, and a vehicle accident as examples of exceptional circumstances. It says the transporter must explain the reason in detail. Its wording describes the option as available “before 8 hours and after 8 hours of expiry”; GSTN/NIC API documentation specifies the operational window as eight hours before to eight hours after expiry.

How e-way bill validity is calculated

Under the CBIC-hosted CGST Rules amended as of 1 January 2022, the ordinary distance rule provides one day of validity for up to 200 km, then one additional day for every further 200 km or part of 200 km. For Over Dimensional Cargo (ODC), or a multimodal shipment with at least one leg by ship, the rule uses one day for up to 20 km, then one additional day for every further 20 km or part.

Movement category Initial validity band Additional validity
Ordinary covered movement One day up to 200 km One additional day per further 200 km or part
ODC or specified multimodal movement with a ship leg One day up to 20 km One additional day per further 20 km or part

The 200 km threshold in the amended rules reflects Notification 94/2020, effective 1 January 2021. The E-Way Bill System FAQ says validity starts when the first transport detail is entered in Part B—vehicle details for road transport or the first transport-document number for rail, air, or ship—and that later Part B entries do not recalculate validity. It also says validity expires at midnight of the last validity day. Because the rule text and FAQ present the time-counting mechanics differently, use the expiry displayed for the particular bill in the official system rather than trying to infer an exact expiry timestamp from distance alone. Check for later amendments or notifications when applying the rule.

Does an expired e-way bill mean an automatic GST penalty?

No single automatic penalty amount follows from expiry alone on the cited provisions. The FAQ says goods should not be moved after expiry; section 129 of the CGST Act addresses goods transported or stored in transit in contravention of the Act or rules. If an officer applies that provision, goods and the conveyance may be detained or seized, and release can depend on the goods, the owner’s choice, and the statutory procedure.

Section 129 provides payment-based release routes and an equivalent-security route. The amount depends in part on whether the owner comes forward, whether the goods are taxable or exempt, and the applicable tax and value calculations. The proper officer must issue notice and provide an opportunity of hearing before determining tax and penalty. A precise liability cannot be calculated without the facts and the law applicable to the case.

This framework is not a guarantee that a short delay will avoid enforcement, nor does it mean every technical expiry produces the same result. The cited section 130 grounds for confiscation include specified contraventions involving intent to evade tax; confiscation should not be described as the routine consequence of an expired bill.

What can and cannot be changed when requesting an extension

The extension request is for an exceptional delay, not a way to revise the underlying transaction. According to the portal FAQ and API documentation, the extension request uses the e-way bill number, reason, current location, remaining distance, and transport details appropriate to the mode. Part A cannot be changed through the FAQ’s described extension workflow. The API documentation also sets a validation restriction against extending a bill beyond 360 days from its generation; that technical limit is not permission to keep an expired bill active without a valid extension.
