GSTAT has reportedly set aside a ₹1,57,516 penalty under Section 129 after an e-way bill expired during a Gujarat-to-Ayodhya journey. The reported ruling treats expiry alone as insufficient to establish an intention to evade tax on the facts of this case—not as a general exemption from penalties for expired e-way bills.

What happened in the GSTAT case?

In Om Fuels v. Pawan Kumar Jeewani, Proprietor & Ors., case APL/151/LCK/2026, the Lucknow Bench reportedly allowed the appeal and set aside both the penalty order and the first appellate order that had upheld it. Taxscan identifies the decision as 2026 TAXSCAN (GSTAT) 195, dated 28 September 2026, with Santosh Kumar Srivastava (Judicial Member) and Arvind Kumar (Technical Member) on the bench. The underlying signed order was not available for independent verification; case details and the reported holding below are therefore attributed to Taxscan’s report.

According to that report, Om Fuels was transporting goods from Gujarat to Ayodhya, Uttar Pradesh, with a tax invoice and e-way bill. The e-way bill was valid until 22 October 2025 at 11:59 PM; the vehicle was stopped on 24 October at about 6:00 AM. A proper officer initiated proceedings under Section 129 and imposed a penalty of ₹1,57,516. The first appellate authority upheld it before GSTAT allowed the appeal.

Taxscan says the appellant argued that the Ahmedabad-to-Ayodhya trip was roughly 1,300 km and that festive-period transport delays caused the bill to expire. The appellant also relied on the declared destination and transaction documents and argued there had been no diversion, suppression or fictitious transaction. Those points are reported as the appellant’s submissions, not as independently verified findings. The revenue’s reported position was that goods in transit had to be covered by a valid e-way bill and that this bill had expired by the time of interception.

Why did GSTAT reportedly set aside the penalty?

Taxscan attributes the following reasoning to the tribunal: “The mere expiry of the e-way bill, by itself, does not conclusively establish that the appellant intended to evade tax. A procedural or documentary lapse and an intention to evade tax are distinct matters and must be examined on the basis of the facts and evidence of the case.”

The distinction is between a document that is out of date and evidence supporting an inference of evasion. As reported, the tribunal found no independent evidence of tax evasion in this case and said the penalty could not be sustained on expiry alone. Taxscan also attributes this statement to the tribunal: “The penalty imposed merely on account of the expiry of the e-way bill, without any independent evidence of tax evasion, is not sustainable in the facts and circumstances of the present case.”

The report says the appeal was allowed, the earlier orders were set aside, and any amount deposited by the appellant was to be dealt with according to law. This is a decision on the reported facts; it does not establish that every Section 129 penalty involving an expired e-way bill must be cancelled.

Does an expired e-way bill automatically prove tax evasion?

Not according to the reasoning Taxscan attributes to GSTAT in this appeal. Expiry was not treated as conclusive proof of intent by itself. The reported analysis instead distinguishes a procedural or documentary lapse from evidence of evasion, such as diversion or a fictitious movement, and assesses the matter on its facts.

That distinction does not make expiry irrelevant or guarantee that a penalty will be overturned. The report describes the result in this particular appeal; it does not supply a universal test covering every factual situation or establish the version of the rules applied to the movement. A taxpayer facing proceedings should consider the full record, including the invoice, destination, movement documents and any evidence cited by the officer, and obtain advice on the applicable law.

How long is an e-way bill valid, and can it be extended?

CBIC’s Rule 138 page gives a distance-based validity table and says validity is counted from the time the e-way bill is generated. The cited page lists these periods:

Distance Validity listed on CBIC page
Less than 100 km One day
100 km or more but less than 300 km Three days
300 km or more but less than 500 km Five days
500 km or more but less than 1,000 km Ten days
1,000 km or more Fifteen days

A separate CBIC-hosted CGST Rules PDF dated 14 November 2019 contains a proviso for exceptional circumstances, including trans-shipment: the transporter may extend validity after updating Part B of FORM GST EWB-01 if required. The cited text provides for extension within eight hours from expiry.

These materials are not necessarily the same version of the rules. The distance table and the PDF’s extension text should not be read as proof that every figure or procedure remains current for every movement. Before acting, check the rules and amendments applicable to the movement date and the current official guidance. The Taxscan report does not establish which rule version was applied to the October 2025 journey.

What should a transporter do if a journey is delayed?

Do not assume that a later tribunal decision will cure an expired document. Check the validity shown on the e-way bill and the applicable extension process before the bill expires. If exceptional circumstances arise, consult the current Rule 138 requirements promptly; the cited 2019 rules text’s eight-hour window is version-sensitive and should not be relied on without confirming it still applies.

If goods are stopped after expiry, preserve the invoice, e-way bill, transport and destination records, and evidence explaining the delay or route. Those materials may be relevant to the facts, but this case does not promise a particular outcome in another proceeding.
