For Ryujinx homebrew, no hacked Switch is needed. For commercial Switch games, the Ryujinx FAQ says you need access to a Switch running custom firmware (CFW) to dump the system firmware, keys, and legally purchased games from that console. Access to a compatible console is what the FAQ requires; it does not say you must own one. Whether dumping or using those files is lawful depends on where you live and on your specific circumstances, and the setup question is separate from that legal one.
Homebrew and commercial games have different requirements
Ryujinx is an emulator, and its FAQ separates two kinds of software. Homebrew applications, which are community-made programs rather than retail Nintendo titles, can run in Ryujinx without a Switch. Commercial games are a different case, because the emulator needs files that only a Switch can supply.

What “dumping” means in Ryujinx’s documentation
The FAQ uses “dump” in a narrow sense: transferring files from a hacked Nintendo Switch to a PC. It names two transfer routes, a microSD card and a USB-C cable. It also names nxdumptool, a homebrew tool, as the method for dumping games, updates, and DLC. Those three categories are the files the FAQ identifies as coming off the console.

The emulator is not claiming that a Switch can be emulated by copying a game image from the internet. In the project’s own description, the console is the source of firmware, keys, and game files, and the FAQ places those on the console side of the process.

Do you need a hacked console?
Yes for commercial games, if you follow the route the Ryujinx FAQ describes. The FAQ’s wording is that users need “access to a Switch compatible with custom firmware (CFW).” Three points follow from that wording:
- It is a compatibility requirement, not a model list. The FAQ does not say every Switch model can be modified, so do not assume that any unit you find will qualify.
- Access is enough. The FAQ does not require personal ownership of the console, only access to one that is compatible.
- Homebrew is not affected. Running homebrew does not require the console at all, according to the same FAQ.
The project does not describe console modification steps, and this article does not either. The FAQ also states that the project does not support piracy and prohibits requests in its repositories or Discord for copyrighted games, firmware, keys, or shaders. Readers looking for those files elsewhere should know that the project itself does not provide or endorse them.

Technical setup is not the same as legal permission
A workable technical route does not answer whether the activity is lawful. Those are two separate questions, and the sources treat them separately.

The U.S. Copyright Office’s 2024 overview of section 1201 of the Digital Millennium Copyright Act explains that the statute generally makes it unlawful to circumvent technological measures that control access to copyrighted works. The same overview says the statute provides for limited, temporary exemptions, which the Copyright Office adopts through rulemaking.

What the codified exemptions cover
The current regulation, 37 C.F.R. § 201.40, lists specific video-game circumstances. They include certain lawfully acquired games whose outside authentication server support has ended, and preservation work by eligible libraries, archives, or museums. These are narrow, enumerated conditions. They do not establish a general exemption for an individual who dumps a currently available Switch game for personal emulation.
Owning a cartridge or a purchased digital copy does not, on the sources reviewed here, make circumvention or a copy lawful. Those sources do not support a blanket conclusion of that kind, and the answer can change with the facts and with the jurisdiction. Readers outside the United States should look to their own copyright and anti-circumvention laws.

Nintendo’s position in its DMCA notice
Nintendo’s June 30, 2026 DMCA notice, filed on GitHub, states that Switch games are encrypted and depend on proprietary keys such as prod.keys. It also alleges that emulator repositories enable circumvention. That is Nintendo’s position as the rights holder. A takedown notice is a claim by one party, not a court ruling, and it should be described that way.
Transfer accessories are optional
If you do use a microSD card or USB-C data cable to move files between a console and a PC, these are the transfer methods the FAQ names. The FAQ does not specify a card capacity, brand, speed class, or cable model, so no particular purchase is required. Treat them as ordinary storage and data accessories, not as part of any modification.

Bottom line
For homebrew, you do not need a hacked Switch. For commercial games, the Ryujinx FAQ says you need access to a Switch compatible with custom firmware to dump system firmware, keys, and legally purchased games, and it does not require you to own that console. Whether that activity is lawful is a separate question. In the United States, the codified exemptions are narrow and do not clearly cover personal dumping of a currently available game, and other countries have their own rules.
